Department of the Army Limited Source Justification
Omnibus III Task Order: W56HZV-12-A-A904 0001
1. Contracting Activity: Army Contracting Command – Warren (ACC-WRN) is the procuring activity for this action.
2. Description of Action: This Limited Source Justification authorizes the use of an exception to the fair opportunity process for ACC-WRN. ACC-WRN proposes to modify OMNIBUS III blanket purchase agreement (BPA) W56HZV-12-A-A904, task order 0001, GSA-Schedule 874-MOBIS, as a logical follow-on to extend the period of performance and increase the contract value. ACC-WRN awarded Task Order 0001 to Allen Corporation on 07 July 2012 for $292,908.48. Allen Corporation is currently performing task order 0001 on a Firm-Fixed Price (FFP), level of effort term basis. The logical follow on effort will be a continuation of the current contract type utilizing discounted fixed labor rates from the contractor’s General Services Administration (GSA) schedule.
The proposed modification will extend the current task order by 12 months and will include one 6-month option, increasing the total contract period of performance from a total of one year and seven months to a total of three years and one month. The procurement analyst prepared an Independent Government Cost Estimate (IGCE) in the amount of $225,756.55 and will utilize fiscal year 2014 Foreign Military Sales (FMS) funds for this effort.
3. Description of the Supply or Service Purchased: The requirement is to provide a FMS Operations and Media Officer (OPNS/Media Officer) and a Supply Clerk to support FMS case management within the Program Manager Armored Brigade Combat Team (PM ABCT). The contractor shall provide one full-time operations and Media officer proficient in all major Microsoft Office products, primarily PowerPoint, Excel, Outlook and Word. The contractor shall occasionally travel to support FMS missions. The contractor shall provide one full-time supply clerk technician to perform basic technical database entry and retrieval, data mining and report development, and trend tracking for Iraq, Afghanistan, and other Global War on Terrorism (GWOT) programs. The contractor shall perform essential entry level supply technical assistance to permit PM ABCT to meet its responsibilities in the management of assigned GWOT and FMS programs.
4. Authority Cited:
a. The statutory authority permitting other than full and open competition is 40 U.S.C.
501 and Federal Acquisition Regulation (FAR) 8.405-6. This acquisition is conducted under the authority of the Multiple Award Schedule Program and FAR 8.405- 6(a)(1)(i)(C), “In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures.
The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.”
b. The Government determines that in addition to FAR 8.405-6 (a)(1)(i)(C), the circumstance found in FAR 16.505(b)(2)(i)(C) also exists, “The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.”
5. Reason for Authority Cited:
a. ACC-WRN will issue this order on a sole source basis in the interest of economy and efficiency as a logical follow-on modification to task order 0001 under Contract W56HZV-12-A-A904. ACC-WRN awarded Task Order W56HZV-12-A-A904/0001 to Allen Corporation on 07 July 2012 in accordance with Federal Supply ordering procedures, after all OMNIBUS III contractors were given a fair opportunity to be considered for award.
b. The current period of performance for Task Order W56HZV-12-A-A904/0001 expires 31 December 2013. ACC-WRN is unable to compete and solicit the requirement on a full and open basis or provide for a fair opportunity under the existing OMNIBUS III mechanism before 31 December 2013. The only way to ensure we have a continued support for this Task Order, without a lapse in service, is to do a modification to the current task order on a sole source basis. When the requirement materialized in March of 2013, ACC-WRN determined that it was more economical and more efficient to compete the requirement on OMNIBUS III’s successor contract TACOM Strategic Solution (TS3). Due to circumstances unknown and outside of the Task Order Contracting Officer’s cognizance, the anticipated award date for TS3 has been changed to April 2014; therefore, ACC-WRN plans to execute an 18 month extension (12 month base and one 6-month option) to the current Task Order. The proposed 18 month extension will provide a reasonable amount of time to construct the next competitive action in a more efficient and economical manner than is currently available.
c. It is more efficient and economical to award this requirement to the current contractor, Allen Corporation, even though planning of the successor contract is in process because ACC-WRN does not anticipate award of the TS3 contract, the successor to the Omnibus III, until April 2014. An average of 6 to 8 months is needed to compete and award a task order once the new TS3 contract is awarded. This would result in a task order award occurring in the the June-August time frame. Competing this requirement with the shortened period of performance currently available in the Omnibus structure would result in inefficiencies and would not be economical.
Government subject matter experts have determined, based on previous tactical and technical experience, that the learning curve and ramp up period for these efforts is, at a minimum, six months in length, during which time a new contractor would not be fully performing the tasks in the Performance Work Statement (PWS). A new contractor would experience inefficiencies because of the time required for the two positions involved in this effort to gain knowledge of this requirement, such as working in an FMS environment as an OPNS/Media Officer and conducting supply operations in relationship to GWOT. Due to the period of performance only being 12 months, with a 6-month option period, a new contractor’s inability to fully perform for the first 6 months would result in, at most, only one year of full performance if a new contractor were to perform this effort. This would create a substantial disruption to mission in the following areas:
OPNS Media officer setting up FMS meetings and scheduling, operating and maintaining FMS facilities.
Supply Support - Failure to retrieve, input and mine contract, supply and technical data.
6. Market Research: The logical follow-on exception, FAR Part 8.405-6(a)(1)(i)(c), Limited Sources, permits the continuation of service to the incumbent on the basis of economy and efficiency. An ABCT Procurement Analyst conducted market research in the form of informal surveys of ACC-WRN Procurement Contracting Officers (PCOS) who are knowledgeable of the industry on 18 November 2013. This market research shows other sources can do this effort. Therefore, after this follow-on contract action is awarded, the effort will be competed under the new TS3 contract. The TS3 effort is not expected to be awarded until April 2014.
7. Other Facts: Allen Corporation has been performing this effort successfully since July 2012.
8. Action to Increase Competition: The subject logical follow-on task order modification is intended to provide continuity of Operations Media and Supply services for a sufficient period to allow subsequent re-procurement through the competitive TS3 solicitation.
