CMO Control No.:13-165
Department of the Army Limited Source Justification Multiple Award Task Order
Under OMNIBUS III Contract W56HZV-10-A-A902/0001
1. Contracting Agency: Army Contracting Command Warren (ACC-WRN) is the procuring activity for this action.
2. Description of Action: This Limited Source Justification authorizes the use of an exception of the fair opportunity process for ACC-WRN. ACC-WRN proposes a logical follow on direct award to Quantum Research International, Inc. (QRI) as a modification under task order W56HZV-10-A-A902 0001. QRI is a Blanket Purchase Agreement (BPA) holder under OMNIBUS III Multiple Award Task Order (MATO) Contract. QRI is currently performing task order 0001 on a Firm-Fixed Price, Level of Effort (FFP-LOE) term basis.
The period of performance for the current task order will be increased by one 12-month ordering period and a 6-month option period, increasing the total contract period of performance from a total of 3 years to a total of 4 years and 6 months. In accordance with the Independent Government Cost Estimate (IGCE), Program Manager Armored Brigade Combat Team (PM ABCT) estimates a total contract value increase by $1,951,470.83 from $3,547,752.67 to $5,499,223.50. Thus, twelve months will be added to ordering year 3 for $1,275,471.13 and a 6-month option is available in the amount of $675,999.70.
Fiscal year 2013 Procurement of Weapons and Tracked Combat Vehicles (2033) funds and Other Procurement (2035) funds will be combined and used for this effort. The logical follow on effort will be a continuance of the current contract type; a Firm-Fixed Price (FFP), Level of Effort (LOE) type contract utilizing the discounted fixed labor rates from the contractor’s General Services Administration (GSA) schedule.
3. Description of Supply or Service Purchased: Task order 0001 was awarded 04 August 2010 to QRI for operations and graphics support to the Program Manager Armored Brigade Combat Team (PM ABCT). Under task order 0001, the Government acquired 1,920 hours of labor for a task leader; 5,760 hours of labor for Systems Analysts; 3,840 for additional labor for Systems Analysts; 5,760 hours of labor for a Technical Typist and 5,760 hours of labor for a Graphics Specialist to support PM ABCT in the area of operations and graphics support. Under this task order the contractor provides services for various operations and activities of the Program Manager and Deputy Program Manager which includes detailed planning related to various complex management projects, issues and initiatives. The services also include coordinating projects and assuring that priority actions are coordinated, staffed and properly executed throughout the PM to assure timely, cohesive and accurate execution of work.

4. Authorities Cited:
a. 40 U.S.C. Section 501 and FAR 8.405-6. This acquisition is conducted pursuant to the authority of Multiple Award Schedule Program and FAR 8.405-6(a) (1) (i) (C), “In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must have been previously issued under sole-source or limited- sources procedures.”
b. In accordance with DFARS 208.405-70(b), the Government determines that in addition to FAR 8.405-6 (a)(1)(i)(C), the circumstance found in FAR 16.505(b)(2)(i)(C) also exists, “The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.”
5. Reason for Authority Cited:
a. ACC-WRN will issue this order on a sole source basis in the interest of economy and efficiency as a logical follow-on modification to task order 0001 under Contract W56HZV-10-A-A902. Task order W56HZV-10-A-A902 0001 was awarded to QRI in August 2010 in accordance with Federal Supply ordering procedures, after all OMNIBUS III contractors were given a fair opportunity to be considered for award.
b. The hours available under task order W56HZV-10-A-A902 0001 will be exhausted on 03 August 2013. ACC-WRN is unable to compete and solicit the requirement on a full and open basis or provide for a fair opportunity under the existing OMNIBUS III mechanism before 03 August 2013. The only way to ensure the Army will have continued support for this requirement, without a lapse in service, is to use a sole source contract. ACC-WRN has determined that it is more economical and more efficient to compete the requirement on OMNIBUS III’s successor contract TACOM Strategic Service Solution (TS3). Due to circumstances unknown and outside the control of the Task Order Contracting Officer, the anticipated award date for TS3 has been changed to April 2014; therefore, ACC-WRN plans to execute an 18 month extension (12 month base and one 6-month option) to the current task order. The proposed 18 month extension will ensure continuation of the task order W56HZV-10- A-A902 0001 services without the inefficiencies which would result from any other contractor due to the ramp up and the learning curve that would be necessary before a new contractor could fully perform the current requirement.
c. It is more efficient, and therefore preferable, to award this requirement to the current contractor, QRI. Government subject matter experts have determined based on previous experience with the start up of the incumbent contractor, QRI, that the learning curve and ramp up period for these efforts, at a minimum, is approximately one month in length, during which a new contractor would not be fully performing the tasks. A new contractor would not have the experience with the services tasks covering the five areas of operations that are being performed under task order W56HZV-10-A-A902 0001, whereas the incumbent contractor, QRI, can provide these services tasks, listed below, without interruption or impact on the timeliness of performance.
i. Task Area 1 includes services for various operations and activities of the PM and Deputy Program Manager (DPM) inclusive of coordinating with higher level staffs:
Army Materiel Command (AMC); Assistant Secretary of the Army for Acquisition, Logistics and Technology (ASA(ALT)); Department of Army (DA); Office of the Secretary of Defense (OSD); The Army Research and Development Command (RDECOM); project/product managers; various product and/or service teams engaged in research, development and/or engineering (RD&E); senior Life Cycle Management Command (LCMC) officials, General Officers, members of the Senior Executive Service and industry executives.
ii. Task Area 2 services involve preparation, review and transmission of agendas, briefings, tasks, minutes, calendars and action items.
iii. Task Area 3 involves development of government briefing packages, documentation packages, spread sheets, word documents, certificates and awards.
iv. Task Area 4 is the development, integration and presentation of task oriented schedules into comprehensive schedules with enough details to allow for program management decisions to be formulated.
v. Task Area 5 is dedicated to coordinating all deployment requirements for PM ABCT personnel, DA Civilian and Military travelling overseas.
If the performance of the above-stated services tasks is interrupted or is provided at less than full performance, PM ABCT will experience harm due to resulting communication issues. The communications between the various operations and activities of the PM and the higher level staffs will experience a break down. Such a lapse in communication will cause projects to not be properly coordinated, staffed and prioritized. As such, the operations and graphics support will not be provided on time and will not be accurately executed. For example, security clearances required for deployment of civilian and military personnel overseas will be delayed. Therefore, at this time, it is in the best interest of economy and efficiency for the Government to award a sole source action to QRI to bridge this effort.
6. Market Research: The Strategic Service Solutions (TS3) contract, the successor to the Omnibus III, is not reasonably anticipated for award until April of 2014. It is estimated that it would take an average of 6 to 8 months to compete and award a task order under TS3 which results in the earliest possible task order awards under TS3 contract occurring in the October-November 2014 time frame. An 18 month extension to the current task order will provide a bridge to the TS3 contract and allow sufficient time to construct the next competitive action.
Market research for this modification, consisting of an examination of the GSA Schedule 871, indicates there are several potential sources for this type of work, but as indicated above, the incumbent is the only feasible source for providing the interim extension without a break in provision of necessary services. Market research has been conduct-ed to support TS3, which is being competed for future services and targeted for award in April 2014. This research confirms that there are sources that provide these types of services, however no other source could do so within the required timeframe because it would take at least six months to put them on contract.
7. Other Factors: QRI has performed these services for three years under this contract. It has highly qualified personnel and the desired knowledge to perform the required services. They have performed professionally and efficiently to date.
8. Actions to Increase Competition: ACC-WRN is working on a new competitive action that will provide continued support for PM ABCT’s mission. The plan is to compete the action among the Omnibus III contractors and award in April 2014. Details regarding the competitive action will be posted on ProcNet website to obtain a maximum amount of competition among Omnibus contractors.

11. Contracting Officer’s Fair and Reasonable Determination: I hereby determine the cost to the Government for this procurement action will be fair and reasonable and is the most advantageous method of fulfilling the Government’s need, price and other factors considered, in accordance with FAR 17.207(c)(3). Use of the existing contracted rates is required by FAR 52.217-8. Those rates have already been found to be fair and reasonable through competition when established on 1 June 2010. The basis for the initial determination was an analysis in accordance with FAR 15.404 -1(b) and (c).
