DEPARTMENT OF THE ARMY

Limited Source Justification

Omnibus III Task Order: W56HZV-09-A-A904 0011

1. Contracting Activity: Army Contracting Command-Warren (ACC-WRN)

2. Description of Action: This Limited Source Justification authorizes the use of an exception to the fair opportunity process for ACC-WRN. ACC-WRN proposes to modify OMNIBUS III blanket purchase agreement (BPA) W56HZV-09-A-A904, task order 0011, GSA-Schedule 874-MOBIS, as a logical follow-on to extend the period of performance and increase the contract value. Task Order 0011 was awarded to Jacobs Technology INC.on 25 August 2010 for Integrated Logistics Support services. Jacobs is currently performing task order 0011 on a firm-fixed price, level of effort (FFP LOE) term basis, the logical follow on effort will be a continuation of the current contract type utilizing discounted fixed labor rates from the contractor’s General Services Administration (GSA) schedule. The proposed modification will extend the current task order by 12 months and will include one 6-month option, increasing the total contract period of performance from a total of 3 years to a total of 4 years and 6 months and it will increase the task order value by $7,352,694 from $11,134,012. to $18,486,706. An Independent Government Cost Estimate (IGCE) was prepared for this effort and fiscal year 2013 APA funds will be used for this effort.

3. Description of Services: The requirement is for Integrated Logistic Support for Project Manager (PM) Armored Brigade Combat Team (ABCT) tactical vehicles to include: ABRAMS, BRADLEY, KNIGHT, Paladin Integrated Management (PIM) Self- Propelled Howitzer Systems (SPHS) and Armored Multi-Purpose Vehicle (AMPV).

These requirements typically include Integrated Logistics support services that include;

Integrated Logistics Support, Fielding Support, New Equipment Training, Total Package Fielding Support, Electronic and Automation Support, and other logistical support services required per Army Regulations for proper execution of fielded PM ABCT systems. This scope is intended as a framework for conducting the sustainment of all current and future fielded PM ABCT vehicle platforms that shall support the Reliability, Maintainability, Availability (RMA) Program Management Team. Performance requires analysis of data, review and critique of program plans, conference and meeting participation, audit of contractor field failure analysis and corrective action program, and researching alternative solutions for performance or reliability issues. Additional duties include preparation and update of all Integrated Logistics Support (ILS) program documentation for the current acquisition phase. The contractor shall coordinate the Manpower and Personnel Integration (MANPRINT) program for the assigned PM to ensure incorporation of all seven domains of MANPRINT (i.e., Manpower, Personnel, and Training (MPT), System Safety (SS), Human Factors Engineering (HFE), Health Hazard (HH), and Soldier Survivability (SSV) into the program.

4. Authority Cited:

a. The statutory authority permitting other than full and open competition is 40 U.S.C. 501 and FAR 8.405-6. This acquisition is conducted under the authority of the Multiple Award Schedule Program and FAR 8.405-6(a)(1)(i)(C),“In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.”

b. In accordance with DFARS 208.405-70(b), the Government determines that in addition to FAR 8.405-6(a)(1)(i)(C), the circumstance found in FAR 16.505(b)(2)(i)(C) also exists, “The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.”

5. Reason for Authority Cited: ACC-WRN will issue this order on a sole source basis in the interest of economy and efficiency as a logical follow-on modification to task order 0011 under Contract W56HZV- 09-A-A904. Task Order W56HZV-09-A-A904/0011 was awarded to Jacobs on 25 August 2010 in accordance with Federal Supply ordering procedures, after all OMNIBUS III contractors were given a fair opportunity to be considered for award.

The current period of performance for Task Order W56HZV-09-A-A904/0011 expires 19 July 2013. ACC-WRN is unable to compete and solicit the requirement on a full and open basis or provide for a fair opportunity under the existing OMNIBUS III mechanism before 19 July 2013. The only way to ensure we have continued support for this Task Order, without a lapse in service, is to do a modification to the current task order on a sole source basis. When the requirement materialized in March of 2013, ACC-WRN determined that it was more economical and more efficient to compete the requirement on OMNIBUS III’s successor contract TACOM Strategic Service Solution (TS3). Due to circumstances unknown and outside the control of the Task Order Contracting Officer, the anticipated award date for TS3 has been changed to April 2014; therefore, ACC- WRN plans to execute an 18 month extension (12 month base and one 6-month option) to the current Task Order. The proposed 18 month extension will provide a reasonable amount of time to construct the next competitive action in a more efficient and economical manner than is currently available.

It is more efficient and economical to award this requirement to the current contractor Jacobs Technology, even though planning of the successor contract is in place, however, ACC-WRN does not anticipate award of the TACOM Strategic Service

Solutions (TS3) contract, the successor to the Omnibus III, until April 2014. An average of 6 to 8 months is needed to compete and award a task order once the new TS3 contract is awarded. This would result in a task order award occurring in the October- November 2014 time frame. Competing this requirement with the shortened period of performance currently available in the Omnibus structure would result in inefficiencies and would not be economical.

Government subject matter experts have determined, based on previous tactical and technical experience, that the learning curve and ramp up period for these efforts is, at a minimum, six months in length, during which time a new contractor would not be fully performing the tasks in the Performance Work Statement (PWS). A new contractor would experience inefficiencies because of the time required for the numerous positions involved in this effort to gain knowledge of this requirement, such as the vehicle fielding, acquaintance with vehicles and how they operate, and also because of on the job training. Some specific tasks would include being current on all variants of the ABRAMS and BRADLEY, up to date with ABCT modified table of organization and equipment, current on all variants of tank training devices, and conduct unit assessments. Due to the period of performance only being 12 months, with a 6-month option period; a new contractor’s inability to fully perform for the first 6 months will result in, at most, only one year of full performance if a new contractor were to perform this effort. This will create a substantial disruption to mission, specifically in the following areas:

The disruption to service at current operation tempos, will inhibit Training and Doctrine Command (TRADOC) Capability Manager’s (TCM) generation of military tactics, techniques and procedures and collaboration of systems capability development (performance requirements) documents for all ABCT weapons systems. The disruption or latency of TCM’s official assessments and reporting of user feedback (after action reports) of fielded weapon systems and support equipment in order to resolve issues, improve fleet readiness, and validate specification/capability requirements will fragment the process and delay system safety and performance change approvals, affecting the readiness of soldiers in the field.

Mounted Requirements Division (MRD) will have their ability to conduct real-time threat data analyses compromised. This data is compared to Ground Combat Systems weapons systems portfolio performance capabilities that dovetail into generation of future Ground Combat Systems analyses of alternative/capability gap requirements documents as delegated in Joint Capabilities Integration and Development System framework.

PM ABCT unit multi-site fieldings will experience disruption and delay of M1200 Armored Knight per DA strategic modularity goals. Additionally, a critical disruption in logistics lifecycle planning and implementation of DA Approved M1A2 Abrams SEP V2 and M2A2 Bradley FOV Modernization (ECP), Armored Multipurpose Vehicle (AMPV), and Self-Propelled Howitzer Systems (Paladin

Integrated Management/PIM) Programs will significantly impact DoD’s National Defense Strategy objectives.

In addition to the above inefficiencies, it is not in the interest of economy to award this bridge effort to a new contractor. Utilizing the applicable GSA/Omnibus labor rates, current for the period of performance in question, it is estimated that the additional costs due to a new contractor’s inefficiencies would be approximately 2.4M. These costs are based on an Independent Government Estimate detailing the estimated six-month cost of performance for a new contractor. The additional cost estimate takes into account the numerous positions and experience needed to fully perform the PWS. This includes the additional efforts for a new contractor to gain knowledge of this requirement, such as the vehicle fielding, acquaintance with vehicles and how they operate, and on the job training. Therefore, at this current time, it is in the interest of economy and efficiency for the Government to award sole source to Jacobs Technology for this bridge effort.

6. Market Research: The logical follow-on exception, FAR Part 8.405-6(a)(1)(i)(c), Limited Sources permits the continuation of service to the incumbent on the basis of economy and efficiency. Market research in the form of informal surveys of ACC-WRN Procurement Contracting Officers (PCOs), who were knowledgeable of the industry, was conducted on 12 MAR 2013 by an ABCT Procurement Analyst. This market research shows other sources can do this effort, therefore, after this bridge contract action is awarded this effort will be competed under a new TACOM Strategic Service Solution (TS3) contract. The TS3 effort is not expected to be awarded until April 2014.

7. Other Facts: Jacobs Technology has been performing this effort successfully since December 2008.

8. Actions to Increase Competition: The subject logical follow-on task order modification is intended to provide continuity of integrated logistics services for a sufficient period to allow subsequent re-procurement through the competitive TS3 solicitation.
