MEMORANDUM FOR PROSPECTIVE OFFERORS
SUBJECT: Non-Tactical Vehicles (NTV) Services, Request for Participation
1. This Memorandum for Prospective Offerors is to advise that the 409th Contracting Support Brigade (CSB), intends to establish a Hybrid (Firm-Fixed Price & Time and Material) Multiple Award Blanket Purchase Agreements (BPAs) for the Rental of Non-tactical Vehicles (NTVs). The ordering period will be for three (3) year’s total, beginning on the date the Contracting Officer issues the BPA which is tentatively set for 17 June 2024. The 409th CSB is establishing the BPAs in accordance with Federal Acquisition Regulation (FAR) 13.303 and Subpart 16.7. Per FAR 13.303-1(a), a BPA is a simplified method of filling anticipated repetitive needs from NTV qualified sources. The maximum ceiling value for all BPAs will be $49,999,999.99. The maximum limit of individual BPA Call Order will be set in accordance with FAR 13.500, currently set at $7.5M ($15M for contingency requirements). A BPA is an agreement, not a contract or purchase order. It is like a charge account that sets forth terms and conditions prior to an actual purchase.
The Government is not obligated to purchase any goods or services under this BPA. If a need arises, an authorized representative of the Government may issue an order following the procedures outlined in the BPA. If the BPA holder accepts the order, then a binding contract between the Government and BPA holder will exist for that specific order.
2. NTVs are not pre-priced, an Order Request for Offerors (ORFO) will be sent to all established BPA holders in accordance with paragraph 3(b). For any Call Orders placed, the Contractor shall provide NTV services specified in the Call Order and in accordance with the requirements of Attachment 1 – BPA Terms & Conditions and Attachment 2 – Performance Work Statement.
The Government, however, reserves the right to use a priced or unpriced structure for the NTV(s) during the ordering period of the established BPA. This priced or unpriced structure may be adjusted during the ordering period of the BPA by adding and/or removing NTVs from any pre-priced list, which may be established at a later date with some or all of the BPA holders. The authority to changes will be based upon mutual agreement of the parties.
3. The Government’s acquisition strategy for this procurement is to utilize Federal Acquisition Regulations clauses and provisions associated with FAR Part 13, Simplified Acquisition Procedures, in conjunction with FAR Part 12, Acquisition of Commercial Products and Commercial Services, and supplemented by the Defense Federal
Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS).
a. The Government will determine best value based on evaluation of non-price factors. The Offerors whose submissions are determined to be the most beneficial to the Government, given appropriate consideration to the two (2) evaluation sub-factors, will be offered the opportunity to establish a BPA. The following evaluation criteria will be utilized:
Factor 1: Technical Approach – The Government will evaluate the completeness of the offer based on the documentation provided.
Subfactor 1: Capability – The Offeror shall clearly demonstrate that they have the capability to provide NTV services throughout the European Command (EUCOM) Area of Responsibility (AOR) by providing a brief description of the company’s capability to perform NTV rental services as listed in Attachment 2 – PWS. Capability descriptions shall be limited to no more than ten (10) pages in accordance with paragraph 4 of this memorandum and shall address the following:
1. The offeror shall clearly state their abilities to support Section 1.2 of the PWS by addressing the following:
a. Vehicle types – Provide a list of the vehicle types available to offer for rent where such vehicle types meet the minimum specifications in Section 4.2 and 4.3 of the PWS. Should there be any country limitations for specific vehicle types, please list any exclusions that may prevent the offeror from complying with the requirements outlined in the PWS. Confirm what vehicles are permitted to operate on unimproved roads.
b. Locations for NTV support - Provide a list of all countries for which you can provide NTVs and can comply with all the requirements outlined in the PWS. Offeror must be able to comply with all the requirements outlined in the PWS in at least 20 of the countries listed in its offer.
2. The offeror shall provide a brief explanation of how they will provide a helpline for emergency assistance, during a Call Order’s performance, 24 hours, 7 days a week as specified in Section 1.3 of the PWS as well as a plan to replace damaged vehicles within 24 hours of notification to the Contractor.
3. The offeror shall confirm that when an Order Request for Offer (ORFO) is issued, their price will include delivery, insurance, maintenance, vehicle recovery and roadside assistance, as specified in Section 1.3 of the PWS. Insurance is defined in Section 4.7 and shall include full coverage insurance with a $0 deductible.
Delivery is defined in Section 5.1 of the PWS.
Subfactor 2: Experience – The Offeror shall clearly demonstrate that they have the background and experience within the last three (3) years to perform the required NTV services as described in Attachment 2 – Performance Work Statement. Offeror shall provide a list of up to five (5) individual contracts (can be either private contracts, with the US Government, or both) with NTV rental services consisting of six (6) to twelve
(12) months of service including multiple vehicles and a variety of types as outlined in the PWS. The list of service contracts shall include a variety of EUCOM AOR countries in which the Offeror has provided services. The individual contracts shall consist of a magnitude of at least $10,000 or more; if submitting a local currency equivalent, offeror shall include their rationale for deriving at the stated magnitude. Experience information shall be limited to no more than 15 pages in accordance with paragraph 4 of this memorandum.
b. Price will NOT be requested or evaluated at the BPA level at this time. However, unpriced NTV Call Orders will be competed amongst all BPA holders as an ORFO.
Contractors will receive the specific NTV requirement, which will include details such as country/address of delivery, country/address of pick-up, countries in which the vehicles will operate, period of performance, and quantity/type of vehicles. BPA holders will then have the option to provide an offer and the lowest priced offer that meets the technical specification requirements, will be awarded the order. The US Government will evaluate offerors for orders using the Lowest Price Technically Acceptable (LPTA) source selection process, as described under FAR Part 15.101-2. Multiple BPA holders may be selected to fill the requirements stated in the ORFO at the Government discretion.
4. Interested Offerors shall submit the requested documents electronically via email and shall submit them in Microsoft Word, Excel, or Adobe Acrobat (PDF) format.
Margins shall be no less than 1” all around. WINZIP (zip) files cannot be accepted as they are routinely blocked by the domain firewall. If multiple emails are required, offerors shall number the emails to include the total sent, for example 1 of 3.
