FAR 52.212-2 Evaluation -- Commercial Items

(a) The Government will award one Firm-Fixed Price (FFP) contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government will consider Technical, Past Performance, and Price in determining the Best Value. All evaluation factors other than price, when combined, are approximately equal to price. An award may be made to an offeror who is higher priced if the perceived benefits of their proposal justifies the additional price. In arriving at the award decision, the Government will conduct comparative evaluations of the quotes as allowed under the Simplified Acquisition Procedures (FAR 13) The following factors shall be used to evaluate quotes:

Factor 1 - Technical Factor Factor 2 – Price Factor 3- Past Performance

(b) An offeror is expected to submit sufficient information in response to the solicitation to allow for evaluation of the quotation.

(c) Each of the evaluation factors will be rated as follows:

Factor 1 – Technical: Meet the requirements noted in the Performance Work Statement that demonstrate the ability to fulfill the requirements (In particular PWS Part 1.10.a. Special Qualifications and Part 5 - Specific Tasks).

Factor 2 – Price: The Government will evaluate the lowest evaluated price for each quote for award purposes by adding the total price for all contract line items within the RFQ requirement. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. This amount will be the total evaluated price. The Government may determine that an offer is unacceptable if the base contract period or option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

Factor 3 – Past Performance: The Past Performance rating will be based on an “Acceptable” / “Unacceptable” basis. The following definitions will be used in evaluating the degree the offeror will satisfactorily provide the required services based on past and current performance records. An Acceptable or Unacceptable rating will be determined as follows:

Rating Description Acceptable Based on the offeror’s performance record, the

Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: The offeror shall submit up to two (2) recent and relevant past performance references. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

The Government will focus its inquiries on the offeror’s record of performance as it relates to all solicitation requirements, including cost, schedule, performance and management of subcontractors. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process. Therefore, offerors will be reminded to include the most recent and relevant efforts

(within the past five years) in their quote. The Government may use data provided by the offeror in its quote and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal or commercial contracts for same or similar services as compared to the NAICS 624190 or similar.

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
