COMBINED SYNOPSIS/SOLICITATION INSTRUCTIONS

1. Issue Date: 7 September 2016 Close Date: 12 September 2016 at 1500hrs Central European Time (CET)

2. Requiring Activity: The 409th Contracting Support Brigade/Theatre Contracting Center (409th/TCC)

3. Place of Performance: Kaiserslautern and Baumholder Military Community, Germany

4. Description of Requirement:

This is a combined synopsis/solicitation for services in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice.

The Government intends to issue a firm fixed-price contract and to solicit for a Music & Play Educational Program service under the authority of FAR Part 12 & FAR Part 13. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued.

This combined synopsis/solicitation is unrestricted. NAICS 611610

5. Request for Quotes (RFQ) NO: W564KV-16-T-MB03

This combined synopsis/solicitation is issued as a Request for Quotes (RFQ). This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-83, 02 July 2015.

The objective of this RFQ is to issue a Single Award Firm Fixed Priced (FFP) award a Music & Play Education Program service.

SOLICITATION CLOSING DATE: All quotes must be received by close of business, 12 September 2016 at 1500hrs Central European Time (CET). Offerors must be registered in the System for Award Management (SAM) (www.sam.gov). The System for Award Management (SAM) is a free web site that consolidates the capabilities you used to find in CCR/Fed Reg, ORCA, and EPLS.

52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL

ADDENDUM TO FAR 52.212-1, Instructions to Offerors

Paragraph (b) and (f) are supplemented and paragraph (c) is replaced as follows:

(b) General. The following instruction to suppliers/offerors is to ensure sufficient information necessary for the Government to fully understand and evaluate quotations is submitted.

1. QUOTATION SUBMISSIONS. Submission of Quotes shall be via email to Contracting Specialist SSG Maria Barrow, maria.barrow.mil@mail.mil. The subject of the email shall be: “W564KV-16-T-MB03– Quote”. The quote shall be submitted in PDF, MS Word or MS Excel 2000 or higher, but not greater than MS Word or MS Excel 2013 format. No ZIP files will be accepted. The offeror is responsible for ensuring delivery to the POC.

2. QUESTIONS PERTAINING TO THE REQUEST FOR QUOTE

(RFQ)/SOLICITATION. Suppliers/Offerors are requested to submit any questions or comments via email to Contracting Specialist SSG Maria Barrow, maria.barrow.mil@mail.mil, (alternate Mr. Ryan M. Bunch, email:

ryan.m.bunch.civ@mail.mil). The subject of the email shall be: “W564KV-16-T- MB03– Questions”. Questions shall annotate a reference to the specific solicitation element to which they pertain. All responses will be taken into consideration and answered appropriately in an amendment to the RFQ/solicitation.

3. QUOTE FORMAT AND CONTENT. The suppliers/offerors quote shall contain, as a minimum, the following:

a. Section I. A signed and dated quotation and acknowledgement of all RFQ/solicitation amendments plus a completed copy of the representations and certifications at FAR 52.212-3.

b. Section II. Technical. In order for the Government to determine the offeror to be technically acceptable to meet the Government requirement/specification, proof of the following information shall be submitted:

Music Education Degree - Bachelor’s Degree in Music or Certification of

Music Therapy or Equivalent and One year experience teaching music therapy to young children

c. Section III. Price. This section shall contain the quoted CLIN price and the total price for all items.

(c) Period for Acceptance of Quotes/Offers. The offeror agree to hold the prices in its quote firm for 90 calendar days from the date specified for receipt of quotes.

(d) LATE SUBMISSIONS In accordance with FAR 12.302, section (f) is being supplemented as follows:

a. Late submissions may be accepted in accordance with FAR 52.212-1(f)(2)(i); or

b. The Contracting Officer determines accepting the late quote is in the best interest of the Government; and

c. The late quote is received prior to the start of technical evaluation of received quotes.

The selected offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected Offeror must submit a completed copy of the listed representations and certifications if the Offeror’s Representations and Certifications are not current in SAM; FAR 52.212-4, Contract Terms and Conditions - Commercial Items. 52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)

Addendum to 52.212-2—Evaluation-Commercial Items (OCT 2014)

(a) The Government will award a Firm Fixed Price (FFP) contract resulting from this request for quote (RFQ) under FAR Part 12 to the responsible offeror whose quote conforms to the RFQ and whose quote represents the best value to the Government. Award will be made on the basis of the lowest evaluated price meeting the technical acceptability standards. Technical acceptability, which includes past performance, will be based on a supplier submitting a quotation that demonstrates the supplier’s ability to comply with all of the requirements listed in the RFQ.

(b) Quotes that do not meet the requirements of the RFQ may be rejected without further evaluation, deliberation, or discussion. Quotes will be evaluated for technical acceptability based on the technical acceptability standards below:

Technically Acceptable:

Music Education Degree - Bachelor’s Degree in Music or Certification of Music Therapy or Equivalent and

One year experience teaching music therapy to young children

(c) Price/Options. The Government will evaluate the lowest evaluated price for each quote for award purposes by adding the total price for all contract line items within the RFQ requirement. The Government may determine that an offer is unacceptable if the base contract period are significantly unbalanced.

(d) The Government intends to evaluate quotes and award a contract without further dialog. Therefore, each initial quote should contain the supplier’s best terms from a price and technical standpoint. The Government reserves the right to conduct further dialogs if determined necessary by the Contracting Officer.

(e) A written notice of award or acceptance of a quote mailed or otherwise furnished to the successful supplier within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

(a) Prices set forth in this contract are exclusive of all taxes and duties from which the United States Government is exempt by virtue of tax agreements between the United States Government and the Contractor's government. The following taxes or duties have been excluded from the contract price:

(b) The Contractor's invoice shall list separately the gross price, amount of tax deducted, and net price charged.

(c) When items manufactured to United States Government specifications are being acquired, the Contractor shall identify the materials or components intended to be imported in order to ensure that relief from import duties is obtained. If the Contractor intends to use imported products from inventories on hand, the price of which includes a factor for import duties, the Contractor shall ensure the United States Government's exemption from these taxes. The Contractor may obtain a refund of the import duties from its government or request the duty-free import of an amount of supplies or components corresponding to that used from inventory for this contract.

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (MAY 2013)

(a) Definitions. As used in this clause--

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.

Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.

(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall--

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this Web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via Web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor must use the following information when submitting payment requests and receiving reports in WAWF for this contract/order:

(1) Document type. The Contractor shall use the following document type(s).
