The following have been modified:

CLAUSE 52.212-1 ADDENDUM

INSTRUCTIONS FOR SUBMISSIONS OF OFFEROR

1. The Government intends to award a Firm Fixed-Price (FFP) contract for this requirement based on price and other factors in accordance with FAR 13.106. Offers which do not meet the required technical or delivery requirements will be determined "Unacceptable" and will not be considered for award.

2. Offeror shall include all documents and information in accordance with the instructions herein. Noncompliance with the Request for Quote (RFQ) requirements may hamper the Government's ability to properly evaluate the offer and will result in elimination of the offer from further consideration for award. Offeror is cautioned to follow the instructions carefully and is encouraged to present its best technical offer and prices in its initial submission, as the Government reserves the right to make an award without discussions. Offeror shall submit an offer that is self-sufficient and responds directly to the requirements of this solicitation. If an Offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise deemed unsound, the Offeror shall immediately notify the Contracting Officer (KO) in writing with supporting rationale.

3. All offers, questions, and correspondence shall be submitted in the English language. Proposals submitted in a language other than English will be determined "Unacceptable" and will not be evaluated. Offers that are sent in multiple emails must be numbered sequentially to include the total number of emails sent.

4. The offeror is responsible for ensuring the Government’s receipt of its offer. No late submissions will be accepted. Block 8 of this solicitation provides the due date and time for offers.

5. Submission of multiple offers: Offerors submitting multiple offers IAW 52.212-1(e) shall submit only one offer per email submission. Offerors shall submit all required documentation with each offer submitted, as each offer will be evaluated separately.

6. SYSTEM FOR AWARD MANAGEMENT (SAM) and WIDE AREA WORK FLOW (WAWF): In order to be considered for award, prospective offerors shall be registered in SAM (www.sam.gov) and WAWF (https://wawf.eb.mil/) by the date proposals are due.

7. Submission of proposals shall be via email to the following:

8. QUESTIONS. Offerors shall submit any questions via email to Mr. Lamon Whitfield and SSG Maria Barrow by 1600 Central European Time at least ten (10) calendar days prior to the solicitation closing date. Questions shall annotate a reference to the specific solicitation element to which they pertain. All responses will be taken into consideration and answered appropriately in an amendment to the solicitation, if necessary.

9. DELIVERY INFORMATION:

Delivery Terms: FOB Destination OCONUS (Outside Continental US), which means the seller must deliver the supplies on its conveyance at the destination specified by the Purchase Order and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination.

10. Period of Acceptance. The contractor shall annotate its agreement to hold its proposed prices firm for 60 calendar days from the date specified for receipt of proposals.

11. The Contractor shall complete the following clauses:

FAR provision 52.212-3 Alt I “Offeror Representations and Certifications” (This provision does not have to be completed (except paragraph (b)) if you have an active SAM registration)

DFARS clause 252.229-7001 “Tax Relief” Complete pricing for each CLIN or Sub-CLIN as required without TAXES Including ALL shipping charges, FOB Destination.

12. SUBMISSION REQUIREMENTS. Refer to FAR 52.212-1(b) for additional submission instructions.

Factor 1: Compliance

The offeror shall provide items compliant with the Trade Agreement Act.

Factor 2: Technical

The offeror shall provide a technical description of the proposed items (electric forklifts) in sufficient detail to evaluate compliance with the requirements in this solicitation. This may include product literature or other documents and/or images if necessary.

The offeror shall provide confirmation it can meet the requested delivery date.

Factor 3: Price

The offeror shall provide a firm-fixed price for all CLINs including OCONUS shipping charges.

The offeror may submit pricing in either Euro or United States Dollars (USD).

Price shall be exclusive of Value Added Tax (VAT) in accordance with DFARS 252.229-7001, Alt 1.

Light system IAW STVZO o Work lights mast mounted;

o Safety light rear 4K;

Aqua system;

Black full rubber tires Operator manual in German and English.

Additional Requirement:

Manufacturer’s warranty for 12 months starting at date of delivery.

All forklifts shall be delivered with chargers configured to be connected to

European current 360 Volts.

All forklifts shall have service points in Germany for easy access to obtain maintenance services and original spare parts.
