52.212-1 - INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

1. General Instructions: These instructions are a guide for preparing your quote. These instructions generally describe the type and extent of information you should provide and address in your quote. You should include in the quote sufficient information to enable the evaluators to determine your understanding of the requirements in each of the evaluated areas. It is the U.S. Government's intent to award a single Firm-Fixed-Price (FFP) contract. A Lowest Price Technically Acceptable (LPTA) process in accordance with Federal Acquisition Regulation (FAR ) 15.101-2 is being utilized to select the successful offeror and no trade-offs will be made. The U.S. Government intends to evaluate quotes and award without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offerors initial response should contain the offerors best terms and price. However; the U.S. Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.

2. Quote Submission and Format: The offeror’s quote shall be prepared and authorized by a person regularly employed by the offeror. The quote should state the name of each person contributing to the authorship of the quote, the person’s position title, phone number, and email address of the person who should be contacted should a contract be awarded. The quote should be prepared in a clear, legible, practical manner. The signature on this solicitation, offer or contract should be the signature of: (a) a Corporate Officer (President, Vice-President, Treasurer, Secretary); or,

(b) an individual authorized in writing by a Corporate Officer to bind the company to a legal documenting addition.

The quote shall be written in English and should be specific and complete as described in these instructions.

Offerors must submit their quotes in electronic format prior to the closing date and time listed on the first page of this solicitation. Quotes may be emailed to the Contract Specialist listed as follows:

Contract Specialist: Sheila Peters, Email: sheila.k.peters2.civ@mail.mil Other formats such as (but not limited to) third party cloud file services, hard copies, CDs, and Drop Box) will not be acceptable.

Failure to provide a complete quote package will result in the offer being determined non-responsive and it will no longer be considered for award.

The following factors will be evaluated:

Factor 1: Technical Factor 2: Price

FACTOR 1: Technical:

Pine Bluff Arsenal is NOT conducting tests on Zinc Oxide samples to ensure compliance. Instead a Certificate of Analysis (COA) will be evaluated based on its contents as described below.

Offeror must submit a Certificate of Analysis (COA) with their offer that shows compliance with the technical data for Zinc Oxide, Grade A, Class 1. Details follows:

As outlined in MIL-Z-291 Revision G, 4 December 1992, Paragraph 3, REQUIREMENTS, the COA is required to show the following information:

1) Table 1, Chemical Characteristics for Grade A

2) Particle Size for Class 1 –

PLEASE NOTE THE MODIFICATION TO THE ZINC OXIDE REQUIREMENT REGARDING

PARTICLE SIZE AS FOLLOWS: 99.9% shall pass through a 140 sieve and 99% shall pass through a 170 sieve.

3) Moisture Reabsorption

4) Apparent Density

TO CLARIFY: The COA shall be actual results of Zinc Oxide that has been tested since it is required to be an actual representation of the material that will be submitted.

A. If the offeror does not submit a COA with their offer, the offeror will be determined to be non-responsive and no longer considered for contract award.

B. If the offeror submits a Technical Data Sheet (TDS) and/or a graph with their offer instead of a COA, the offeror will be determined to be non-responsive and no longer considered for contract award.

C. If the offeror submits a COA that does not include all REQUIREMENTS in Paragraph 3 of MIL-Z-291 Revision G, 4 December 1992 that are applicable to Grade A and Class 1 as listed above to include the noted modification, the offeror will be determined to be non-responsive and no longer considered for contract award.

PLEASE NOTE: The offeror is responsible for information on the COA. If the offeror forwards an incomplete or incorrect COA provided by a supplier, the offeror will be determined to be non-responsive and no longer considered for contract award.

4. Factor 2: Price A Firm-Fixed-Priced (FFP) shall be entered for Contract Line Item Number (CLIN) 0001 in the solicitation. The proposed unit price is limited to two decimal places.

Price shall be submitted on a FOB Destination basis. The price proposed will be binding. The price shall be valid for 60 days after date of quote. The Government reserves the right to require the submission of any data other than certified cost and pricing data, as set forth in FAR 15.403-3(a), as necessary to determine the price is fair and reasonable.

END OF 52.212-1 - INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

52.212-2 – EVALUATION – COMMERCIAL ITEMS

EVALUATION CRITERIA

1. Basis for Contract Award: The U.S. Government plans to award a single Firm-Fixed-Price (FFP) contract utilizing the Lowest Price Technically Acceptable (LPTA) source selection procedures with Federal Acquisition

Regulation (FAR) 15.101-2. The evaluation factors include Technical (GO/NO-GO) and Price. The U.S. Government will not rate or rank quotes, but will select the quote that provides the best overall value to the U.S. Government based on the lowest total evaluated price of those quotes deemed technically acceptable.

2. The U.S. Government intends to evaluate quotes and award a purchase order without discussions with contractors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial quote should contain their best terms for technical and price. However; the U.S. Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.

3. Evaluation Factors:

Factor 1: Technical:

GO Rating:

Offeror submitted a Certificate of Analysis (COA) with their offer that shows compliance with the technical data for Zinc Oxide, Grade A, Class 1. Details follows:

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (OCT 2015)

(a)(1) The Offeror certifies, to the best of its knowledge and belief, that-

(i) The Offeror and/or any of its Principals-

(A) Are ( ) are not ( ) presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have ( ) have not ( ), within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and

(C) Are ( ) are not ( ) presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision.;

and

(D) Have , have not , within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has ( ) has not ( ), within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;

head of a division or business segment; and similar positions).

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
