Buyer Office Symbol/Telephone Number: CCRC-AR/(309)782-1583
Type of Contract 1: Firm Fixed Price
Kind of Contract: Supply Contracts and Priced Orders
*** End of Narrative A0000 ***
1. This solicitation, pursuant to the Authority 10 U.S.C. 2304 (c)(3), is for the production of explosives at Holston Army Ammunition
Plant (HSAAP) listed on the attached Price Matrix (Attachment 0001), and will result in the award of a four-year Firm Fixed Price requirements contact. The resulting contract will include the following four ordering periods:
ORDERING PERIOD (OP) 1: 1 OCT 2018 - 30 SEP 2019
ORDERING PERIOD (OP) 2: 1 OCT 2019 - 30 SEP 2020
ORDERING PERIOD (OP) 3: 1 OCT 2020 - 30 SEP 2021
ORDERING PERIOD (OP) 4: 1 OCT 2021 - 30 SEP 2022
2. The contractor shall have the capacity to produce a total of 16.0M pounds (lbs) of explosive per year totaling 64M over the life of the contract. The estimated quantities for each ordering period is as follows: _________
ORDERING PERIOD (OP) 1: 8M lbs.
ORDERING PERIOD (OP) 2: 13.5M lbs.
ORDERING PERIOD (OP) 3: 13M lbs.
ORDERING PERIOD (OP) 4: 12M lbs.
Initial delivery is expected within 12 months after award of each Delivery Order with monthly deliveries thereafter, unless otherwise negotiated on individual orders or individual Contract Line Item Numbers (CLINs). An award resulting from this solicitation in no way obligates the Government to place orders.
3. The Government reserves the right to re-open negotiations for unit prices anytime it is determined it is in the best interest to the Government to do so (e.g., order quantities substantially exceed estimates, completed modernization projects, reduced costs).
4. The Price Matrix (Attachment 0001) contains four OPs and ranges which the contractor shall price each of the CLINs. The Price
Matrix is not an all-encompassing list of items. Should a requirement for an item fall below the minimum quantity range or exceed the maximum range quantity, the Government will request pricing information from the contractor.
5. The below listed Performance Work Statements (PWSs) are the primary contributors to the fixed operation and maintenance costs under the related facility-use contract at HSAAP. These PWSs will continue to remain under the facility-use contract; however, the cost of executing the PWSs will be amortized into the explosive unit prices specified under the Supply Price Matrix.
PWS A - Facility Plans, Strategies, and Analyses*
PWS B - Property in Possession of Contractors (PIPC)*
PWS C - Environmental and Energy*
PWS D - Safety*
PWS E - Security and Anti-Terrorism*
PWS F - Not Used
PWS G - Support of On-Site Government Staff
PWS H - Fire and Emergency Services*
PWS I - Maintenance*
PWS J - Armament Retooling Manufacturing Support (ARMS)
PWS K - Ammunition Material Management
PWS L - Support of Natural Resource Program
6. The cost of executing the PWSs (with asterisk) will be amortized into the explosive unit prices via per pound facility offset charge which will be added to the unit price of each product. Facility offsets will be determined annually (or sooner, if deemed necessary) by the contracting officer after a review of projected and actual production volumes has been conducted. The per pound facility offset charge will ultimately be derived from the facility offset estimation table.
7. Submission Requirements: The contractor shall provide to the Government, annually or at such other times as the Government may _______________________ request, at no additional charge or cost, the following:
a. Copies of the most recent version of all Collective Bargaining Agreements (CBAs) covering its employees at the facility

throughout the term of the contract, to include any options. The contractor understands and agrees that at such time as the
Government solicits or begins the process for solicitation of a new or subsequent contract for all or part of the work covered under this contract, the Government shall have the right to make the most recent copies of the CBAs available through such means as it deems most appropriate for review.
b. Current copies or versions of work schedules, workload projections, and employment and/or layoff projections for each year of the contract. The contractor understands and agrees that the Government may be required to provide such information in response to
Congressional or higher headquarter inquiries or requests. The contractor further understands and agrees that at such time as the
Government solicits or begins the process of solicitation of a new or subsequent contract for all or part of the work covered by this contract, the Government shall have the right to make the most recent copies or versions of such work schedules, workload projections, and employment and/or layoff projections available through such means or media as it deems most appropriate for review. BAEs proposal to this solicitation constitutes agreement to release of the submitted information and gives notice of Executive Order 12600.
8. Contractor Responsibility for Safety: The contractor is responsible for safety in accordance with DFARS 252.223-7002, Safety ____________________________________
Precautions for Ammunition and Explosives, and all other applicable safety requirements within this solicitation. The contractor and its employees are responsible for the safety of contractor operations and for the safety of all persons and property involved with or affected by contractor operations. Subject to all contract requirements, the contractor shall exercise its own independent judgment concerning the safety of its employees and its operations. The Government does not direct or control the manner of the contractor's operations; however, in the interest of preserving required mission capabilities and facilities, the Government has the right to conduct surveillance of the contractor's operations and take appropriate action to ensure that the contractor remedies any and all contract or safety violations.
The presence of Government officials and safety personnel on the installation and the fact that the Government conducts or provides inspections, investigations, surveys, oversight, concurrences, approvals, advice or recommendations concerning the safety of contractor operations shall not affect the contractor's responsibility for safety. The purpose of any Army investigation at the installation is to ensure there are no conditions that adversely affect mission capability or combat readiness. Ensuring the safety of contractor employees is not the purpose of an Army investigation since this is the contractor's responsibility.
9. Installation Commander's Authority: Notwithstanding the contractor's responsibility for the safety of its employees and __________________________________ operations, the Installation Commander has the authority to stop operations or practices that, if allowed to continue, could reasonably be expected to result in death or serious physical harm to personnel, generate major system damage, or endanger the installations' ability to accomplish its mission. This authority allows for shutdown of a suspect operation or practice prior to the elimination of the perceived danger through regular channels, including an immediate shutdown in those situations to which the
Installation Commander determines that an activity presents as imminent hazard to life or property that threatens the mission of the
Government.
10. Delivery Schedule: The Contractor shall provide a monthly Production and Delivery Schedule to include all orders on contract _________________
(including third party DOD and commercial orders) with an award date, CLIN number, contractual delivery dates, anticipated/actual delivery dates, and total contractual quantities. The monthly production schedule shall include material throughput of each building
(CDRL EXHIBIT AP). Orders placed on this contract shall take priority over orders not placed on this contract (e.g., commercial, third party); however, the Government reserves the right to adjust the delivery schedule based on priority.
11. Facilities Use Requirements (Approval for Outside Orders): The Contractor shall request approval from the Government (PCO) prior _________________________________________________________ to accepting outside orders for the production of explosives at Holston AAP whether performed by the contractor or by a third party.
Statements made by other Agencies allowing Holston facility use are not valid.
The contractor shall comply with all applicable provisions of the facilities contract and any additional conditions placed on the individual third party facilities use approval. Failure to comply with the conditions of the facilities use approval will result in revocation of the approval to use the facilities for commercial or third party work. In no case will a Request/Approval for
Facilities Use extend beyond the award contract period.
*In the past, a blanket "Facilities Use Approval" has been granted; however, the Government now requests approval prior to each outside order accepted.
12. Statutory or Regulatory Changes: If, after award of the facility use contract, new laws or regulations are enacted that impact _______________________________ performance or cost, the Contracting Officer will review those impacts on a case-by-case basis and will modify the contract as applicable.
13. Program Management Review (PMR): The Contractor shall conduct PMRs twice a year at HSAAP. 30 days prior to the PMR, the _______________________________
Contractor shall submit an agenda for Government review and comments (CDRL AN). No later than 10 days after the PMR concludes, the contractor shall submit meeting minutes (CDRL Exhibit AO).

CONFIGURATION CHANGE MANAGEMENT DOCUMENTATION_____________________________________________
(a) The contractor may submit Engineering Change Proposals (ECPs) and Requests for Variance (RFVs) for the requirements in the
Government provided Technical Data Package (TDP). The contractor shall prepare and submit ECPs, NORs, and RFVs as required by the accompanying DD Form 1423, Contract Data Requirements List (CDRL). If a Value Engineering Change Proposal (VECP) clause is included on this contract, VECPs shall be submitted in the same manner as ECPs.
(1) ECPs - The contractor may request a permanent change to the requirements specified in the TDP or any other baseline documentation by submitting an ECP. ECPs shall be submitted to include all Notices of Revision (NORs) necessary to completely define the requested change. Each ECP shall be accompanied with at least one NOR per affected document. The contractor shall not present any production items for acceptance incorporating any change to the TDP or other baseline documentation until notified by the Government the ECP has been approved and incorporated in the contract.
