Control No: 13-089 Contractor: Future Research Corporation

Program/Item: Transportation Information System (TIS) Sustainment Est. Dollar Value:

Department of the Army Justification for an Exception to Fair Opportunity

Under Multiple Award Indefinite Delivery Contracts

1. Contracting Activity: U.S. Army Contracting Command, Rock Island (ACC-RI), Rock Island, IL 61299-8000.

2. Description of Contract Action: This proposed acquisition is for the award of a sole source Firm Fixed Price (FFP) bridge task order under the Computer Hardware Enterprise Software Solutions Information Technology Services-Small Business (CHESS ITS-SB) contract to Future Research Corporation (FRC) for ongoing operations, maintenance and engineering support for the Transportation Information Systems (TIS). TIS is a portfolio of systems that addresses all aspects of automating Department of Defense (DoD's) mobility and transportation mission. It interfaces with joint and service systems to provide In-Transit Visibility (ITV) and Total Asset Visibility (TAV) to all branches of DoD. The TIS transportation and distribution system includes:

Transportation Coordinators’ – Automated Information for Movements System II (TC- AIMS II) Unit Move and Deployment NIPRnet Globe Services (NGS) (TIS Globe) TC-AIMS II Theater Operations (TOPS) Automated Movement Flow Tracking – In-Transit Visibility (AMFT-ITV)

This support is currently provided by FRC under contract W912HZ-08-D-0008, Task Order 0013, which expires 25 September 2013. The period of performance (PoP) for this six month bridge contract is 26 September 2013 – 25 March 2014. The total estimated cost of the proposed action is which includes FY13 and FY14 Operations and Maintenance, and Other Contingency Operations Army (OMA and OCO) FY13 and FY14 funds. A bridge contract is required to allow FRC to maintain continuity of these services until a follow-on, competitive task order can be awarded.

Task Order 0013 also provides support for a movement control system. In January 2011, United States Forces – Afghanistan (USFOR-A) published a Joint Urgent Operational Needs Statement (JUONS) CC-0428 requesting PD TIS to implement an enterprise movement control system. The JUONS noted that a single theater system should have the capability to request, track and manage commercial and military air movements; confirm delivery of air cargo; and allow users to monitor both shipments into theater, and surface movements within theater across all services.

Currently, movement requests, surface or air, with one or more destinations, are managed manually using spreadsheets and email. The data is obtained from various in-transit visibility (ITV) systems, web portals and reports that are being used to track inbound cargo. The Transportation Movement Request (TMR) process in TOPS is used to track surface movements in theater. Under Task Order 0013, FRC has been working to upgrade the systems as a result of

JUON CC-0428.

Additionally, FRC is currently performing services under Task Order 0014. Task Order 0014 requires FRC to enhance the existing TC-AIMS II Unit Move module to include development of additional business logic and modification of existing screens, reports and interfaces necessary to address the requirement to improve In-Transit Visibility (ITV) for cargo throughout the Defense Transportation System (DTS) for Time-Phased Force & Deployment Data (TPFDD) movements.

The TPFDD database is used to plan and execute the strategic movement of forces from one geographic region to another.

The Office of the Secretary of Defense (OSD) has directed the creation and handling of a Transportation Tracking Number (TTN). The TTN will provide an association of cargo with Unit Line Numbers (ULNs) for all services (Army, Air Force, Marines, and Navy) via an embedded Transportation Tracking Account Number (TTAN). To accomplish this effort, it is necessary for FRC to have continuing access to the TIS portfolio of products in order to modify the TC-AIMS II Unit Move Module for the completion of Task Order 0014’s requirements by 20 January 2014. Currently, access to TC-AIMS is granted under Task Order 0013. The TTN tasks cannot be completed by FRC if FRC does not have access to the TIS portfolio after 25 September 2013 when Task Order 0013 expires.

3. Description of Supplies/Services: FRC is currently providing support for life cycle sustainment of the TIS portfolio of systems. The baseline code for these systems is a non-commercial, contractor-developed code paid for by the Government, for which the U.S. Army Program Executive Office Enterprise Information Systems (PEO EIS) program office is responsible. The portfolio falls within the DoD mission area of mobility and transportation for DoD passengers and cargo during war and peace. It automates the process of planning, organizing, coordinating, and overall unit-related deployment activities supporting the DoD’s total deployment process. While the code is non-commercial, the services provided by FRC to maintain the code are commercial.

The contractor will provide continued development, maintenance, and engineering support to perform technical assistance and operational support, both on and off-site, for keeping the TIS portfolio of systems stable and operational for the DoD. To support this objective, the contractor shall ensure that all delivered software products are fully tested and designed to be supportable throughout their life cycles.

4. Authority Cited: Section 803 of the National Defense Authorization Act for Fiscal Year 2002 (Pub. L. 107-107), DFARs 216.505-70 and FAR 16.505(b)(2)(i)(B). The order must be issued on a sole-source basis as only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized..

5. Rationale for Limiting Sources: Contract No. W912HZ-08-D-0008, Task Order 0013, issued by the U.S. Army Engineer Research and Development Center (ERDC) contracting office has an expiration date of 25 September 2013. It was anticipated that Task Order 0013 could be extended to allow sufficient time for a competitive follow-on to be awarded and placed on contract through ACC-RI. However there were delays associated with the transfer of responsibility from ERDC to Product Director Automated Movement and Identification Solutions (PD AMIS). To mitigate the possible break in mission services, it was determined that the best course of action was to execute a six-month sole source bridge contract to the incumbent.

The sole source bridge contract will not only afford the Government the proper time required to prepare and execute a follow-on acquisition using competition procedures under the CHESS ITS-SB suite, but will allow for the completion of Task Order 0014 requirements that were also awarded competitively to FRC.

FRC has the institutional knowledge of TIS and the extensive experience providing the technical support services for TIS. FRC has the required essential personnel with information assurance contractor training and certification requirements as described in DFARS 252.239-7001 and required by the contract. FRC personnel meet the following training requirements:

A. Level I Training for information assurance required by DFARS 252.239-7001.

B. Access and General Protection/Security Policy and Procedures C. iWATCH Training

DoD logistics offices are required to use TIS software for troop operations throughout the world.

It would require another contractor, without the benefit of a transition period, approximately 6-8 months to understand TIS and gain the essential knowledge to provide the minimum level of capabilities required to support TIS. Without the ability to continue use and development of this software, DoD would be required to perform troop, supply and equipment movements using out-dated and/or nonfunctional equipment and software which could potentially have catastrophic and costly consequences. Without the TIS, human error will become a significant factor with the ability to compromise troop deployments. Supply chains for food, ammunition and equipment will be disrupted, potentially affecting the life, health, safety and security of soldiers and civilians in areas of operation. Logistical tracking of military assets will be severely hampered, creating scheduling delays and possible mission failure.

Next, without the enterprise movement control system being worked under Task Order 0013, there is a greater chance for input errors, unreliable ITV data and longer work hours because manual input would be required, taking attention away from improving the theater distribution systems and adversely impacting the joint operations in US Central Command Area of Responsibility (CENTCOM AOR). Because the program is using funds directed by Congress to provide assets visibility to the entire transportation community, this effort has Congressional level attention.

Further, if a bridge contract is not awarded to FRC for continuous performance, Task Order 0014 for the enhancement of TC-AIMS II Unit Move module to include TTN cannot be completed on 19 January 2014 as required by OSD. Without the unique TTN that Task Order 0014 is

Program/Item: Transportation Information System (TIS) Sustainment Est. Dollar Value:

providing, the cargo will not be fully traceable throughout the movement process. The TPFDD database will not be available to plan and execute the strategic movement of forces from one geographic region to another which will adversely impact assets (cargo, equipment and personnel) visibility for joint operations in CENTCOM AOR.

Based upon these factors, FRC is the only source for providing the required operations, maintenance, and engineering support services in the short timeline upon the expiration of the current Task Order 0013 on 25 September 2013.

6. Market Research: Market research was conducted in May 2013, for the follow-on effort by PD AMIS. This research indicated that there are other potential sources identified in addition to FRC on the ITS-SB suite of contractors. The other identified sources posses a basic understanding of the technical and operational requirements and have general experience on similar types of programs. Any of these firms could provide the required services if sufficient time were available for a transition. However, with only three months remaining on the current effort, there is not enough time to competitively award a contract. Therefore, a sole source bridge contract to FRC is considered the only option for continuous performance.

7. Actions to Increase Competition: In accordance with AFARS 5139.101(S-90), the Army is to use CHESS to procure commercial IT services and is the preferred source for services, regardless of dollar value. PD AMIS is seeking to compete a follow-on firm fixed price and cost reimbursable hybrid performance based contract using Army CHESS ITS-SB contract vehicle for providing equipment operations, software maintenance, enhancements, and software engineering support and integration in support of this program.
