Addendum to 52.212-1, Instruction to Offerors-Commercial Items
Proposal Submission Instructions:
A complete proposal submission shall include the following:
1. Completed SF 1449 (Blocks 30a, 30b, and 30c) and CLIN pricing.
2. Completed Attachment 1 – Pricing Table
3. Past performance or capabilities statement demonstrating that the offeror possesses the skills, knowledge, and resources to perform the required services.
4. Technical Submission to include sandblast media and paint information sheets as well as Safety Data Sheets (SDS) for the one-time repairs (CLIN 0003) per PWS Section 5.2.5.
Basis of Award: Reference FAR 52.212-2 for evaluation.
SERVICE CONTRACT ACT. IAW FAR 37.107 and 41 USC Chapter 67, Service Contract Labor Standards, provides for minimum wages and fringe benefits as well as other conditions of work under certain types of service contracts. Service Contract Labor Standards are applicable to this acquisition. Prevailing wage rates may be referenced at the following link:

OFFEROR MUST COMPLETE FAR PROVISION 52.204-24 AND FAR PROVISION
52.204-26 AND SUBMIT WITH QUOTE.
Email quote along with supporting documentation to jessica.l.mchugh.civ@army.mil by the date and time specified in the solicitation. Please reference the solicitation number “W51AA1-24-Q-0064” in the email. Email shall include a signed copy of the SF 1449 solicitation, pricing, and all other Items listed above. Complete pricing must be submitted for each CLIN listed in the SF 1449 Line items. No other offers will be considered. Offer shall be submitted and award made by the Government on an all or none basis. Therefore, offers are solicited on that basis only. The Government intends to immediately compare proposals and award a contract without conducting exchanges with offerors. Emails not including all of these items MAY not be accepted.
Emails not received by the date and time specified in the solicitation or not providing all of the required documentation, may not be considered for award. It is the responsibility of the Offeror to verify that the email, to include all attachments, was received by the date and time specified in the solicitation.
Only electronic proposals will be accepted. No hardcopy proposals will be accepted.
Each proposal must be submitted electronically via email to the Contract Specialist, Jessica McHugh at jessica.l.mchugh.civ@army.mil. The size per e-mail must not exceed 9MB. If necessary, offerors may submit multiple emails. If multiple emails are sent, emails must be marked 1 of 2, 2 of 2, etc. To be considered for award, the offeror's complete proposal, including all attachments, must be received in the email Inbox of the Contract Specialist identified in this solicitation before the closing date and time. If a complete proposal, including all attachments, does not appear in the email Inbox of the Contract Specialist identified in this solicitation before the closing date and time, then it is not received, and the offeror's entire proposal is late and will not be considered for award. If the offeror does not receive written confirmation of receipt from the Contract Specialist before the closing date and time, it is the responsibility of the offeror prior to closing of the solicitation to contact the Contract Specialist identified above to confirm their complete proposal has been received. The Government will not consider proposals that were delayed, or otherwise not timely delivered to the Contract Specialist's email Inbox because of an issue with the offeror's or the Government's service providers, to include email maintenance, firewall or delivery to any other email box (e.g. junk). Therefore, offerors should anticipate delays in transmission and are advised to plan ahead and to begin transmitting their proposal in enough time to ensure successful delivery prior to the close of the solicitation.
Questions must be submitted 5 days prior to the close date of the solicitation.
Responses to Questions received will be posted in the same manner as the solicitation.

PERFORMANCE WORK STATEMENT (PWS)
Scale Maintenance and Inspection Service
PART 1
GENERAL INFORMATION
1. GENERAL: This is a non-personnel services contract to provide quarterly preventative maintenance (PM)/Inspection and On-Call repairs to the Commercial Truck Scale located at Building 44, and the Commercial Scale Located at Building 56. The government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Scale Maintenance and Inspection Services as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.
1.2 Background: Tobyhanna Army Depot currently has two (2) Commercial Scales that require regular service and maintenance:

1.3 Objectives: Basic objectives of this service contract include:
Ensure the Commercial Scales are adequately maintained to prevent failures.
Return any damaged or failing devices to service as quickly and efficiently as possible.
Maintain all devices so that they can be relied upon to function when activated.
1.4 Scope: The contractor shall provide service and maintenance for all components of the Commercial Scales listed under Section 1.2 of this performance work statement. Services include:
Quarterly Preventative Maintenance, calibration, and Inspection On-Call/Emergency Repair Calls Miscellaneous Requirements One-time repair to Building 44 Truck Scale
1.5 Period of Performance: The period of performance shall be for one (1) Base Year of 12 months and (two) 12-month option years. These option years shall be exercised at the convenience of the government and are not guaranteed.
1.6 General Information
1.6.1 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.6.2 Quality Control: Quality control shall be the responsibility of the contractor. The contractor shall meet all federal and Tobyhanna Army Depot safety standards at all times. The contractor shall meet all U.S. Army and Federal quality and workmanship standards. The contractor shall install, repair, and maintain all equipment according to manufacturer specifications.
1.6.2.1 Rejection of work. Indication of lack of quality workmanship on the part of the contractor shall be sufficient grounds for the government to reject installed work and to require its immediate removal and complete reinstallation at no additional cost to the government.
1.6.3 Recognized Holidays: The contractor shall be required to respond to emergency repair requests during the following federal holidays:

1.6.4 Hours of Operation: The contractor is responsible for conducting business, between the hours of 0730 and 1600 Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings unless notified of an emergency repair need. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.6.4.1 Coordination. All work shall be scheduled to provide minimum interference with Tobyhanna Army Depot operations. All non-emergency work shall be completed during normal hours of operation as listed in section 1.6.4 of this performance work statement unless otherwise approved by the POC and Tobyhanna Army Depot Security. The contractor shall coordinate all scheduled work with the POC prior to the commencement of work and at the convenience of the government.
1.6.5 Place of Performance: The work to be performed under this contract will be performed at government-owned facilities of Tobyhanna Army Depot.
1.6.6 Type of Contract: The government will award a hybrid firm fixed price / time & materials contract.
1.6.7 Security Requirements:
The contractor and their employees will check in with the POC upon arrival to the depot. If the POC is unavailable, the contractor and their employees will contact the Physical Security Specialist (PSS) or Security POC.
o PSS: Physical Security Manager, extension 5-5063.
o Security POC: Security Shift Supervisor or Desk Sergeant, extension 5-7550.
o POC: Nicholas G. Baldauff (Directorate of Installation Services: 5-6463.
The contractor shall complete and submit to the POC an ELTY 648-C
– Request for Access To Tobyhanna for each contractor employee that will be present on base at any time. This form is available upon request from the POC. This form must be completed prior to the first visit and submitted to the POC for security’s review.
After receiving approval for base access, each contractor employee shall complete and submit an ELTY 648-RE – Application for Identification Badge and submit to the POC for signature. This form is available upon request from the POC. The POC shall be responsible for scheduling an appointment with Tobyhanna Army Depot’s Pass and ID office for the contractor to receive their identification badge.
Each contractor employee requiring vehicle access to the secure area shall complete an ELTY 647 – Parking Pass Request and submit to the POC for signature. This form is available upon request from the POC The POC shall be responsible for scheduling an appointment with Tobyhanna Army Depot’s Pass and ID office for the contractor to receive their identification badge.
The contractor and their employees will be required to display their identification badges and vehicle passes at all times while on Tobyhanna Army Depot property or as otherwise directed.
The contractor and their employees will remove identification badges and vehicle passes when off Tobyhanna Army Depot property.
The contractor and their employees will have a Service Ticket (Work Order) stating all work performed signed by the PSS or POC before leaving the Depot.
A written PM Work Sheet will be furnished to the PSS or POC within 5 days after each visit, including all work performed and a proposal (if required) stating material and labor costs.
Upon completion of the contract, the contractor and their employees will return all identification badges or vehicle passes furnished by the government.
1.6.7.1 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.
1.6.7.2 Key Control. The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer.
1.6.7.2.1. In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the Contracting Officer, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.
1.6.7.2.2. The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer.
1.6.8 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.6.10 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. All contractor personnel shall be required to display their Tobyhanna Army Depot identification badge at all times while on Tobyhanna Army Depot premises.
1.6.11 Data Rights: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government.
These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.
1.6.12 Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart
9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the
OCI.
PART 2
DEFINITIONS AND ACRONYMS
2. DEFINITIONS AND ACRONYMS:
2.1. DEFINITIONS:
2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5. DELIVERABLE. Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.
2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.
2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.9. QUALITY ASSURANCE Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
2.1.12. WORKDAY. The number of hours per day the Contractor provides services in accordance with the contract.
2.1.12. WORK WEEK. Monday through Friday, unless specified otherwise.

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES
3. GOVERNMENT FURNISHED ITEMS AND SERVICES:
3.1 Facilities: During the construction period the contractor shall have limited use of the premises for the performance of his construction operations, including use of the site. The contractor’s use of the premises is confined to those areas where work is to be performed.
3.1.1 Keep driveways and entrances that service the premises clear and available to occupants at all times. Do not use these areas for parking or the storage of materials. Schedule deliveries to minimize space and time requirements for storage of materials and equipment on site.
3.1.2 Owner Occupancy. The employees of each building will occupy all work areas during normal business hours. The contractor shall cooperate with the occupants to minimize conflicts and facilitate usage. The contractor shall perform work so as to not interfere with the occupant’s use.
3.2 Utilities: All utilities in the facility will be available for the contractor’s use in performance of tasks outlined in this PWS. The Contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish cleaning vehicles and equipment.
PART 4
CONTRACTOR FURNISHED ITEMS AND SERVICES
4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.
4.2. Materials: The Contractor shall furnish all materials and supplies necessary to meet the requirements under this PWS.
4.3. Equipment. The Contractor shall furnish all necessary equipment necessary to meet the requirements under this PWS. This includes, but is not limited to, fork lifts, jacks, personnel lifts, ladders, test equipment, hand tools, power tools and safety devices.
PART 5
SPECIFIC TASKS
5. Specific Tasks:
5.1. Basic Services. The contractor shall provide service and maintenance for all components of the gates, barriers, and turnstiles listed under Section 5.2 of this performance work statement.
5.2. Requirements:
5.2.1 Quarterly Preventative Maintenance:
5.2.1.1 The contractor will provide four quarterly preventative maintenances (scheduled at the convenience of the government).
5.2.1.2 The contractor shall inspect all four (4) scale Platforms checking that they are free and clear of any stationary obstructions that may alter the actual displayed total weight.
5.2.1.3 The contractor shall inspect all gap covers and load cell covers for wear or broken mounting hardware.
5.2.1.4 The contractor shall inspect, calibrate, and adjust scale to meet the HB-44 Standard in the National Standards and Technology (NIST) handbook.
5.2.1.5 The contractor shall provide a completed report of an “as found” and “as left” maintenance document of scale reading and scale condition. Report shall also include, but not limited to, the digital indicator and printer. Contractor shall also document any finding that requires replacement or repair of any equipment.
5.2.1.6 The contractor shall submit a preventative maintenance report detailing all procedures completed to the POC within 48 hours of the completion of the quarterly preventative maintenance.
5.2.1.7 All preventative maintenance shall be done according to manufacturer specifications.
5.2.1.8 The contractor shall dispose of any waste materials according to
Tobyhanna Army Depot Recycling Policy.
5.2.2 On-Call/Emergency Repairs:
5.2.2.1 The contractor agrees to provide emergency service 24 hours a day, seven days a week, and all government holidays inclusive.
5.2.2.2 The contractor shall provide non-emergency remedial service calls repairs during normal operating hours unless otherwise approved by the Security POC.
5.2.2.3 The contractor will be on site within 8 hours after notification of an emergency.
5.2.2.4 The contractor will furnish name and telephone number of the technician to be contacted in case of emergency repair need for malfunctioning or non-functioning of equipment listed.
5.2.2.5 The contractor will make every effort to restore the equipment to its normal operation in the shortest possible time.
5.2.2.6 The POC shall be notified of the estimated time required to restore service after an initial visit has been made by the Contractor’s Service Technician.
5.2.2.7 The contractor will prepare an Emergency or Remedial Service Report and will indicate the nature of their service call, response time, a detailed description of the correction applied, and the amount of time required to restore the equipment.
5.2.2.8 The contractor will maintain the systems in satisfactory continuous operation. When replacement parts are required the contractor will use (with government approval) “State of the Art” components that are compatible with the damaged equipment.
5.2.2.9 The contractor shall provide a quote for services and repairs that requires approval from the POC prior to commencement of any emergency/remedial repair work.
5.2.3 Miscellaneous Requirements:
5.2.3.1 The contractor and their employees will remedy damage to the equipment, site, building, or contents that is the result of any failure or damage caused by the contractor.
5.2.3.1.1 If arrangements to repair damaged government property are not made within 48 hours, the government will replace, repair, or otherwise remedy such failure or damage at the contractor’s expense.
5.2.3.2 In the event the system is not made operational on the day of service, the contractor will return the following duty day thereafter until the system is in operational condition.
5.2.3.3 The contractor will provide a parts list including part number and price when needed to make necessary repairs to keep equipment in proper working condition.
5.2.3.4 Upon arrival and departure of each visit the contractor will have the POC or designed representative sign the Preventative Maintenance, Emergency Repair, or Remedial Repair Report with the condition of all equipment repaired.
5.2.3.5 If any Preventative Maintenance reveals a weakness in the degree of security provided by the system, or should show evidence of tampering, moved, or removal of the equipment, it will be reported to the POC or Security POC immediately.
5.2.3.6 If adjustments are necessary on the equipment, they will be performed at the time of preventative maintenance and will be reported to the POC.
5.2.3.7 Additional work will be scheduled with the POC for other hours as required.
5.2.3.8 Contractor shall visit the site of the work if needed, check all dimensions and otherwise acquaint himself with all details and conditions affecting the work, quantities and type of materials and all factors to meet the purpose and intent of these specifications and the terms of the contract.
5.2.4 One-Time Repair to Building 44 Commercial Truck Scale:
5.2.4.1 During the Base year, at a one-time occurrence, the contractor shall make rust remediation repairs to the Building 44 Truck Scale. The repairs shall include:
o Sandblast and paint the Building 44 Truck Scale in its entirety. Dimensions for this scale are 70’ long x 11’ wide and consists of four cells. See Attachments 2-4 for Specs and Drawings.
Paint type: Sherwin Williams Macropoxy 646 or equivalent.
Recoat Thickness: 7-9 mils dry film thickness (DFT) o Remove and replace all existing access cover bolts (approximate quantity- 82).
5.2.4.2 The contractor is responsible for verifying the existing condition and bolt size/quantity.
5.2.4.3 The contractor shall submit a cost estimate/quote to the
Government POC, which shall include the cost of materials, equipment, and labor of the replacement/repair.
5.2.4.4 The contractor requires approval from the Government POC prior to commencement of repairing the Truck Scale.
5.2.5 At the time of proposal:
5.2.5.1 Color chart. At minimum, standard red shall be included.
5.2.5.2 Material submissions.
5.2.5.2.1 Paint Submission
5.2.5.2.2 Sand Blasting Media
5.2.5.3 Initial material SDS (Safety Data Sheets).
5.2.5.4 Qualifications of contractor: Contractor shall submit data showing the contractor has successfully done this type of work as specified herein, or that the contractor has a firm contractual agreement with a subcontractor having such required experience. Data shall include name and locations of at least two installations where the contractor or subcontractor has done this type of work as well as the primary contact at the specified locations.
5.2.6 Post Award:
5.2.6.1 Repair Schedules: Contractor shall submit a repair schedule within 15 days of award.
5.2.6.2 Contractor shall complete rust remediation repairs to the Building 44 Truck Scale within 60 days of base year period of performance (PoP) start date (with approval from the Government POC prior to start).
PART 6
ENVIRONMENTAL CONSIDERATIONS AND SAFETY STANDARDS
6. Environmental Consideration
6.1 ENVIRONMENTAL CONSIDERATION: Standard specifications for
projects under the National Environmental Policy Act (NEPA) in accordance with 32 CFR 651 Proponent AMSEL-TY-RK-E.
6.1.1 Contractor personnel utilizing hazardous materials shall be required to initiate a spill response by dialing 911 on any local Tobyhanna Army Depot phone or by calling (570) 615-7117.
6.1.2 The contractor shall not use materials containing asbestos and shall not disturb or damage any existing asbestos-containing material.
6.1.3 Do not use any ozone depleting substance.
6.1.4 Polyurethane materials containing Trichloroflourethane, Dichloromethane, or Chlorofluoromethane shall not be used. MSDS sheets shall be provided to the POC for each component used.
6.1.5 Title to all removed, dismantled or demolished material and/or equipment including rubble scrap and debris not specified or indicated to be Government salvaged, reinstalled under this contract, or hazardous waste shall be vested in the Contractor upon receipt of notice to proceed.
6.2 RECYCLE/DISPOSAL OF MATERIALS:
6.2.1 Disposal of such material and/or equipment shall be at the contractor’s expense and responsibility at an authorized facility that has been permitted by the Pennsylvania Department of Environmental Protection and the Monroe Country, Municipal Waste Management Authority. The Contractor shall comply with the Monroe Country Solid Waste Management Plan and all local regulations and licensing requirements regarding hauling.
6.2.2. The contractor shall submit a weight receipt for any waste to be disposed of at a landfill, or for any materials recycled outside of Tobyhanna Army Depot. The contractor may utilize Tobyhanna Army Depot’s recycling services upon request.
6.2.3 The contractor shall comply with the Depot’s buy recycled plan in the acquisition of construction material.
6.2.4 The Contractor shall not spill, emit, dump, or otherwise discharge any hazardous, toxic, or harmful material or pollutant into any sink, drain, toilet, utility, or receptacle, without prior authorization from the Contracting Officer.
The Contractor shall protect streams, lakes, and wetlands from sediment discharges caused by the Contractors activities.
6.2.5 Paint containing zinc chromate or strontium chromate pigments shall not be used in the performance of this contract.
6.2.6 Paints containing lead in excess of 0.06 percent by weight of total nonvolatile content (calculated as lead metal) shall not be used.

PART 6.1
SERVICE OR EQUIPMENT INSTALLATION CONTACTOR SAFETY STANDARDS FOR TYAD
Below are some “installation specific” safety standards which contractors are required to adhere to while performing any work on Tobyhanna Army Depot. It is the contractor’s responsibility to always incorporate these particular requirements into their daily operations while under contract and to institute these specifics into their overall site safety controls. These do not substitute or deflect in any way the requirement to institute and adhere to all OSHA 29 CFR 1910 & 1926 and USACE EM385-1 safety standards, as well as all applicable contractual Federal Acquisition Regulations while performing the work under this contract on Tobyhanna Army Depot.
It is the responsibility of the contractor to enforce the below requirements as well as all current revisions of the above referenced standards. Failure to enforce safety requirements on the depot can result in immediate stop works, safety stand down orders and even complete termination of the contract.

S.6.1.1 THE CONTRACTOR IS SOLELY RESPONSIBLE AND LIABLE FOR JOB- SITE
SAFETY
1. Review of the project plans and other documents by any government appointed official does not constitute an acceptance of Federal responsibility or liability for the adequacy of the safety measures identified for the job or for the Contractor's compliance with all applicable safety rules and regulations.
2. The Contractor remains solely responsible and liable for job-site safety at all times during the term of the contract. No outside personnel (other than ET, COR, TYAD Safety, or other government appointed contract personnel) are allowed onto the job site at any time during contract without prior permissions and/or escort by the ET, COR or KO.
3. Tobyhanna Army depot has restrictions on the use of fossil fuels in all buildings. When it is determined that electric or other alternatively fueled vehicles are insufficient or unavailable for movement of material within the buildings on the installation, fossil-fueled vehicles can be used only when all alternatives of accepted electric material movement equipment have been considered, and the last option is use of a fossil fuel vehicle or project failure. This includes any situations where safety of employees and equipment may be jeopardized. Convenience will never be an acceptable justification to utilize fossil-fueled vehicles. The Government Designated Representative (GDR) will notify the appropriate supervisor(s) or leader(s) in the area where the need to utilize a fossil fuel vehicle is required. The supervisor / leader will take the necessary steps to notify the employees in the work area of the option to leave the area during the material movement process. The GDR and Contractor will also document all actions the Contractor took to utilize electric or other alternatively fueled vehicles.
The documentation will specifically state why electric or alternatively fueled vehicles are insufficient and all mitigation efforts used to minimize the effects of fossil-fueled vehicles to include information as to any appropriate scrubbers that can be utilized along with any ventilation or exhaust systems that can be used to externally vented to the outside of the facility. The documentation must be submitted to the TYAD Safety office for approval prior to any equipment being used. A final copy of the Approved documentation will be provided to the TYAD Safety Division.
4. All direct construction supervision, including subcontractors, must as a minimum, complete an OSHA 30-hour safety course for construction. These certificates must be submitted as part of the site safety plan BEFORE construction activities start.
5. RED CARD PROGRAM - Tobyhanna Army Depot utilizes a program to allow employees to stop an action which is considered unsafe. Employees carry small red cards that can be thrown down when employee sees any action, they consider unsafe. Work ceases until TYAD management can decide if it is safe or not. Contractors are required to comply with this program. If a TYAD employee presents the red card to the contractor, the contractor must stop working until the COR and Safety Office can determine if there is a safety hazard or not.
6. All contractor personnel, to include subcontractors, vendors, suppliers, or visitors, when performing any type of work activity, or gaining access through an occupied area or shop - must have all applicable PPE that is required for the area to include, but not limited to, hardhats, safety glasses, hearing protection, and respirator protection. Notify both COR & Area Supervision, for access approval and prior to any work activities being performed.
S.6.1.2 CODE COMPLIANCE
As noted in Tobyhanna Army Depot Safety Regulation 385-1 - TYAD follows all requirements and is certified as an ISO 45001 facility. Accordingly, the contractor shall comply with and maintain these high safety standards and provide full compliance with all applicable safety regulations and standards. The Contractor shall maintain, monitor, and enforce employee compliancewith all applicable rules, regulations, and codes.
Tobyhanna Army Depot requires full contractor compliance with all safety regulations and standards. The Contractor is responsible for maintaining, monitoring, and enforcing all rules, regulations, and codes, by ALL personnel working for the contractor including all subcontractors. These codes include:
Title 29 Code of Federal Regulations-1910 (OSHA General Industry Standards) Title 29 Code of Federal Regulations-1926 (Construction Industry Standards) National Fire Protection Association Codes Uniform Facilities Code

S.6.1.3 JOB HAZARD ANALYSIS (JHA) / ACTIVITY HAZARD ANALYSIS (AHA)
Prior to the start of work, the contractor shall prepare a JHA / AHA for each phase of work that will be done under the contract. This will be completed in accordance with all applicable OSHA safety requirements. A phase is any operations involving a certain type of work. Examples include demolition, excavation, masonry work, concrete pouring, roofing, and electrical wiring. Work done by each subcontractor is also a phase. The JHA / AHA will:
1. List the activity being performed and identify the sequence of work steps.
2. List the hazards associated with each step, and the procedures and training required to eliminate or reduce the risk to an acceptable level.
S.6.1.4 SITE SPECIFIC SAFETY & ACCIDENT PREVENTION PLANS
Contractors will submit a written Site-Specific Safety / Contractor Accident Prevention Plan prior to beginning activities. The plan must follow the guidelines in OSHA 29 CFR 1926 or 1910 as applicable.
1. Who will implement the plan, including who is responsible for safety and accident prevention?
2. A means for coordinating and controlling subcontractors and suppliers.
3. Safety training.
4. Who will investigate accidents?
5. Emergency response.
6. Job site cleanup and safe access.
7. Public safety requirements such as signs and barricades.
S.6.1.5 FALL PROTECTION
1. Personnel performing works at a height of six feet or more from any lower level shall comply with OSHA 29 CFR 1926.500 through 1926.503 safety standards for any type of new installations. OSHA 29 CFR 1910-28 shall apply to any type of servicing on previously installed equipment.
2. There are currently no certified anchorage points or permanent guardrail systems on any TYAD roof.
Most roofs of the depot are more than 20 feet high.
3. Contractors and their employees must be protected from falling off the edge of the roof, regardless of how briefly the employees are at the edge of the roof.
S.6.1.6 ELECTRICAL SAFETY
Follow the current Tobyhanna Army Depot standard. This standard is based on NFPA 70E.
Copies of the TYAD Electrical standard may be obtained by request from the ET, COR or KO on the project or service contract.
S.6.1.7 DEPOT REQUIRED PERMITS / APPROVALS
Permits are required for:
1. Excavation: Contractors must utilize the PA 1 Call system and also coordinate with contracting officer representative (COR) for a TYAD dig permit for any excavations prior to any groundbreaking including digging, drilling, and stake driving.
2. Trenching: Contractors will adhere to OSHA requirements and receive approval from TYAD Safety office before any trenching deeper than 5 feet is performed. Notifications of such activities will be provided to the COR along with required plans, requests and permits prior to any trenching works being performed. Contractor is responsible for field verifying all utilities and underground entities.
Excavation or trench greater than 18 inches in depth that remains open greater than (1) day OR left unattended for any period of time shall have a safety orange construction fence installed around the perimeter of the opening. Caution tape or cones for this purpose is unacceptable.
3. Confined Space: All confined space works on TYAD are to be considered as permit required entries, (unless reclassified by the TYAD Safety office,) and Contractor must first request and be provided with an approved "signed" permit from TYAD Safety Office prior to any confined space entry.
Contractor will refer to all OSHA requirements and must have a confined space plan and all appropriate safety equipment. Contractor is to request approval from TYAD Safety office through COR prior to entry.
4. Burning / fire: Hot work permits must be obtained daily from the Fire Department.
5. Cranes: For use of cranes and all WHE and LHE at TYAD see S.10.13
6. Army Radiation Permits: Non-Army agencies (including other military Services, vendors, and civilian contractors) require an Army Radiation Permit (ARP) to use, store, or possess ionizing radiation sources on TYAD (see 32 CFR 655). Non-Army applicants will apply by letter with supporting documentation to the Depot Commander. The letter should be submitted so that the Depot Commander receives the application at least30 days before the requested start date of the permit. The ARP application will specify start and stop dates for the ARP and describe the intended use of the radioactive material.
For sealed sources of radiation, i.e. Moisture Soil Density Gauges, the application must include a valid Nuclear Regulatory Commission (NRC) Radioactive Materials License that allows the applicant to use the source as specified in the ARP application, current leak test certificates, operator training records and calibration certificates for any equipment that may be utilized at TYAD.
For machine produced ionizing radiation sources, i.e. X-ray Equipment, the application must include the appropriate state authorization that allows the applicant to use the source as specified in the ARP application along with operator training records and calibration certificates for any equipment that may be utilized at TYAD.
ARPs will not be issued for more than 12 months at a time.
S.6.1.8 CONFINED SPACES
1. All Confined Spaces at TYAD are considered as Permit-Required Confined Spaces unless reclassified by TYAD Safety office after a thorough review of the area and the work being planned.
2. Contractors must first notify the COR and receive TYAD Safety office approvals prior to gaining access or opening any confined space area.
3. Contractors must fully comply with all OSHA regulations for Confined Space Operations, including on-site use and availability of a Confined Space Entry Permit / Checklists, along with prior approvals of their Accident Prevention Plan and associated Activity Hazard Analysis (AHAs) for the work to be performed.
4. The contractor and/or the COR will then notify the TYAD Safety office and TYAD Fire and Emergency Services of the Confined Space Entry timelines and schedules.
5 Upon completion, the contractor will notify the TYAD Safety Office and discuss whether any new hazards were added to the Confined Space and will submit the completed Confined Space Entry Permit / Checklist for record.
S.6.1.9 LOCKOUT/TAGOUT PROCEDURE
1. The Contractor shall perform this work in accordance with 29 CFR § 910.147-The Control of Hazardous Energy requirements.
2. The Contractor shall notify the COR that a lockout/tag out system is going to beused.
3. The contractor is to request the COR to notify them if TYAD is using any lockouts / tag outs in the construction area.
4. The Contractor shall locate and identify all isolating devices.
5. The Contractor shall shut down the equipment normally.
6. The Contractor shall isolate all energy using appropriate methodology.
7. After all work is complete, the Contractor shall remove the energy isolating device and restore the equipment to service.
8. The Contractor shall notify the COR that energy is again restored.
S.6.1.10 PROTECTION TO THE DRINKING WATER SYSTEM
1. The contractor will not perform any work on the depot potable water system until prior approval is obtained from the Environmental Branch and the certified operator through the Directorate of Installation Services COR.
