About this file

This document is a set of Questions and Answers related to the Sources Sought notice for the construction and operation of a production facility for 5-15 million pounds/year of TNT. The key details are:

The government is seeking a technology provider who can support all aspects of TNT production, including design, construction, operator training, commissioning, and start-up services. The government is open to a Contractor-owned/Contractor-operated (COCO) TNT production facility at a commercial site. Respondents should provide information on their relevant TNT production capabilities, including technology descriptions, facility requirements, and budgetary cost estimates. The government clarifies that the $1M annual amount for leasing facilities as an ARMS/P3 tenant is a rough estimate, and the actual cost may be more or less. The government also confirms that it has not yet selected a site for the TNT facility and is considering government-owned and commercial locations. The government intends to execute the contract as an undefinitized contract action.

Question USG Response

In the sixth bullet point requesting for the estimated total cost/price to the USG, the USG writes:

assuming no USG direct funding during post-construction operations; including all cost-related assumptions (for example production levels to include commercial demand; make or buy decisions; on-site versus off-site hazardous waste treatment, and, for USG sites, assume a $1M annual amount for leasing facilities as an ARMS/P3 tenant, if not a current facility operator) . . .”

To clarify, for the assumed “for USG sites, $1M annual amount for leasing facilities as an ARMS/P3 tenant, if not a current facility operator” part, is the USG only providing this $1M annual amount for the duration of pre-construction and construction phases only based on the “assuming no USG direct funding during post-construction operations” language? Or will this $1M annual amount extend through the operation phase as well?

For clarification, with regard to the sixth bullet, wherein it states "for USG sites, assume a $1M annual amount for leasing facilities as an ARMS/P3 tenant, if not a current facility operator," that is in reference to the fact that if a follow-on production contract is awarded, the producer will likely have to incur a cost for leasing the TNT facility (as an ARMS tenant or P3 partner) through the duration of the production contract. The amount of "$1M" is a rough estimate that is provided as a plug number for normalizing purposes; the actual cost to the proposed producer/operator for leasing the facility may be more or less than this plug number. For further clarification, it shall be assumed that the USG will not be direct funding the TNT facility.

In the eighth bullet point requesting for “the viability of, and benefits, drawbacks, and risks associated with the potential site,” when the USG refers to “the potential site,” is it still referring to the previously discussed potential USG sites in addition to any commercial site(s)?

The USG has not selected a site for the TNT facility. As provided in previous Sources Sought updates, the USG is primarily considering GOCOs, GOGOs, and interested party proposed commercial locations.

During review of the addendum to the Sources Sought, it was noticed that the opening paragraph stated this would be executed as a sole source 'contract', and not via a 'contracting action'. Does this remove the previous posting and its information related to the potential for this to be executed as a

UCA.

As provided in the updated Sources Sought released on 07 June 2024, the USG intends to execute the proposed contract action as an undefinitized contract action.
