SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

RFQ AMENDMENT 01

1. The purpose of this Amendment is to change the Government’s required delivery schedule terms -- as requested by the customer -- to coincide with the customer's scheduled presence at Fort Hood, Texas on October 1 through October 21, 2023. Note: The customer will conduct inspection of all materials at the facility.

2. Vendor responses shall include PDF full copies of the solicitation and this Amendment. Both documents shall be completed, signed, and dated appropriately. Vendor signature applied to any document submittal is required to be the signature of (a) A Corporate Officer [President, Vice-President, Treasurer, Secretary];

or (b) an individual authorized in writing by a Corporate Officer to bind the company to a legal document.

Vendors are also required to verify and confirm in writing that applied signatures are in accordance with the above requirement.

3. Vendors shall also complete and submit the Attachment 01 Excel spreadsheet. Vendor submittal of a pdf version of the spreadsheet is not acceptable. Vendor submittal of an email that includes the cut-and-pasted content of the spreadsheet is not acceptable. Vendors shall enter all comments about any line item into the 52.211-8 Time of Delivery text in this Amendment. If necessary, the vendor shall attach a continuation sheet of comments with their submittal. It is noted that the 11 CLIN requirements located in the spreadsheet and RFQ solicitation are unchanged.

4. Vendors are required to enter quotations for all solicitation requirements to be eligible for award consideration. Partial quotations will not be considered. Partial quotations are considered non-responsive to solicitation terms and conditions. Therefore, partial quotations will be ineligible for award consideration.

5. A vendor that has submitted quotations prior to this RFQ Amendment may review their quote submittals, extend the validity of their pricing, and review the required/revised delivery terms to confirm in writing that the vendor can meet the revised delivery schedule. Any vendor that fails to respond to this Amendment will no longer be considered for award. Vendor quotations shall be valid for 30 days, starting at the solicitation closing date (See #7, below).

6. As noted in #3 above, FAR clause 52.211-8 Time of Delivery has been updated. FAR clause 52.204-27 Prohibition on a ByteDance Covered Application has been added to solicitation terms and conditions.

7. The solicitation will close at 3:00 PM Central Time on Friday 28 July 2023.

8. All other solicitation terms and conditions are unchanged. Submit all questions in writing to the Government Point of Contact, Mike Perez, at michael.e.perez24.civ@army mil.

SECTION SF 1449 - CONTINUATION SHEET

The following have been added by reference:

52.204-27 Prohibition on a ByteDance Covered Application JUN 2023

The following have been modified:

52.211-8 TIME OF DELIVERY (JUN 1997)

(a) The Government requires delivery to be made according to the following schedule:

REQUIRED DELIVERY SCHEDULE

OCTOBER 1 THROUGH OCTOBER 21, 2023

Item No. Quantity of Contract ALL CLINS

EARLY DELIVERY – IN ACCORDANCE WITH THE SCHEDULE ABOVE -- IS AUTHORIZED AT NO

ADDITIONAL COST TO THE GOVERNMENT.

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

OFFEROR'S PROPOSED DELIVERY SCHEDULE

Within Days

After Date

Item No. Quantity of Contract

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
