DEPARTMENT OF THE AIR FORCE

158TH FIGHTER WING (ACC)

SOUTH BURLINGTON VERMONT

22 Dec 2019

MEMORANDUM FOR RECORD

FROM: 158th Mission Support Contracting

SUBJECT: Justification for Other than Full and Open Competition, W50S9C-20-P-0002, P-19 Fire Truck Repair

1. This acquisition is conducted under the authority of FAR 6.302-2 & FAR 13.106-1(2)(b). The contract will be awarded as a sole source, based on unusual and compelling urgency.

a. The following justification is provided in the structure prescribed in FAR 6.303-2, Content.

(1) The Vermont Air National Guard, 158th Mission Support Contracting, South

Burlington, VT, intends to enter into a contract on the basis of “other than full and open competition.”

(2) The VTANG is having a major repair done to a P-19 Striker Oshkosh Fire Truck. The vehicle needs to have diagnostics completed to determine the full extent of the repair, but the technical experts speculate the power divider and coupler will have to be completely replaced.

(3) The vehicle will have to be transported to the contractor’s facility in order to perform diagnostics and determine the full extent of the damage. The vehicle will then be repaired and transported back to the installation. The estimated repairs include the power divider, coupler, and assorted ancillary components.

(4) FAR 6.302-2, Urgent and Compelling Need is the basis for limiting competition for this acquisition.

(5) The Wing Commander directed this vehicle be repaired as expeditiously as possible, as flight line operations were threatened. Failure to immediately contract for the vehicle repair could have resulted in harm to the government. This fire truck is the only alternate to the primary vehicle that provides Aircraft Rescue and Fire Fighting efforts directly to flight line operations. With this vehicle being down, any potential issues with the primary truck would cause flight line operations to cease for both the Vermont Air National Guard and Burlington International Airport. A local contractor was immediately contacted that is familiar with the vehicle and is an authorized Oshkosh distributor/mechanic. As indicated by Oshkosh, “The Oshkosh Dealer network utilizes a specialized certification program to ensure only the most highly skilled, expertly trained group of individuals services our air field vehicles.”

(6) FAR 6.305(d) Availability of the Justification, mandates this notice be posted to the Government Point of Entry within 30 days of award. It will be posted within the directed timeframe on Beta.SAM.gov and remain posted for a minimum of 30 days.

(7) A determination has been made by the contracting officer that the anticipated cost to the Government will be fair and reasonable. A query of Beta.Sam.Gov and Electronic Data Access revealed one similar. The contracting officer has determined the price to be fair and reasonable based on this comparison.

(8) Market research was conducted as referenced above. The results of the research indicated the estimated price was reasonable and the subject contractor was the best awardee based on their technical expertise on these vehicles, their location relative to the installation, and ability to complete the repair expeditionously.

(9) As mandated, use of FAR 6.302-2 requires rationale be provided as to the extent and nature of the harm to the Government. Flight line operations could potentially cease for both the Vermont Air National Guard and Burlington International Airport without the presence of this vehicle.

(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

TEAM EAGLE, INC.

828 VALENTINE AVE

PACIFIC, WASHINGTON 98047-2152

UNITED STATES

(11) Due to the urgent nature of this acquisition, it would be difficult to overcome any barriers to competition before a subsequent acquisition for similar services.

(12) As the contracting officer, I certify the justification is accurate and complete to the best of my knowledge and belief.
