About this file
This is an Absence of Competition Memorandum for a simplified acquisition procedure under Purchase Request #F6A6CE6079A002. The contracting officer has determined that only one source is reasonably available to satisfy the requirement based on the "only one responsible source and no other supplies or services will satisfy Agency requirements" justification category.
Alpena Roads and Grounds requires procurement of a Bobcat 5600 piece of equipment to maintain base grounds. The justification for sole-source procurement is based on existing fleet compatibility and infrastructure. Alpena currently maintains a small fleet of Bobcat 5600 machines, specialized attachments, and replacement parts specifically configured for these units. Market research determined that Bobcat attachments currently maintained by Roads and Grounds cannot be used on competing brand machines without modification, specifically requiring removal of a 7-pin CanBus controller that has been installed in every Bobcat attachment since model year 2000. This incompatibility with alternative equipment makes Bobcat the only practical source. The memorandum notes that written justification requirements under FAR 6.303 do not apply to purchases using simplified acquisition procedures.

A.03.11.01 Absence of competition memorandum Ver.1 26 May 2017
ABSENCE OF COMPETITION MEMORANDUM
(SIMPLIFIED ACQUISITION PROCEDURES)
PURCHASE REQUEST#: F6A6CE6079A002
1. FAR 13.106-1(b) states that contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source to be reasonably available.
2. I determine only one source to be reasonably available based one of the following circumstances:
Only one responsible source and no other supplies or services will satisfy Agency requirements.
Unusual and compelling urgency
Industrial mobilization
International agreement
Authorized or required by statute
National security
Public interest
3. Justification: The Alpena Roads and Grounds has a need to procure a piece of equipment to maintain the base grounds called a Bobcat 5600. Alpena already maintains a small fleet of Bobcat 5600's, including attachments and a stock of parts that can be used to service and repair this specific machine. Market Research indicated that the Bobcat attachments currently maintained by Roads and Grounds can only be used on other brand machines with modification. Specifically, a 7-pin CanBus controller installed in every Bobcat attachment since model year 2000.
This component needs removal in order for the attachment to fit another machine.
4. Note that this determination satisfies the requirements of FAR RFO 12.102(a) The requirement to prepare a written justification IAW FAR 6.303 does not apply to purchases using simplified acquisition procedures.
