The purpose of this project is to "Replace Boilers" in accordance w ith the Statement of Work dated 14 July 2020.

In accordance w ith FAR 36.204 Magnitude of Construction Projects, the price range of this project is anticipated to be betw een $100,000 and $250,000.

This requirement is being solicited 100% small business set-aside. The NAICS code for this acquisition is 238220 and the Small Business size standard is $16.5M.

NOTICE TO OFFEROR(S): Funds are not presently available for this project. Currently, the Government anticipates funds w ill become available prior to but no later than midnight 30 Sep 2020. This action has been identif ied on the National Guard priority list for aw ard if funds become available and the prices received are w ithin an aw ardable range.

Section 00100 - Bidding Schedule/Instructions to Bidders

INSTRUCTIONS TO QUOTERS

1. Description of the Project:

Provide all labor, tools, parts transportation, tools, equipment, materials, supplies, services, permits, insurance, and supervision necessary to “Replace Boilers” as per Statement of Work, dated 14 Jul 20. Project Number:

DJCF202703 at the 146th AW, Channel Islands ANGS, Port Hueneme, CA.

2. Instructions to Quoters:

2.1. You are invited to submit a quote in response to our Request for Quotation (RFQ) W50S75-20-Q-0026 intends to award a single Firm Fixed Price (FFP) contract to the responsible quoter whose quote will be most advantageous to the Government, considering only price.

2.2. This solicitation is set-aside 100% for small businesses.

3.2. Any explanation desired by a quoter regarding the meaning or interpretation of the solicitation, or quotes, drawings, specifications, etc. must be requested in writing and with sufficient time allowed for a reply to reach quoter before the submission of their quote.

3.3. Any changes to the drawings, specifications, etc. will be issued in the form of an amendment. However, any answers that clarify or provide an interpretation to the drawings, specifications, etc. will NOT be posted via amendment but rather as a response to the RFI on Contract Opportunities at https://beta.sam.gov/.

3.4. Receipt by the quoter must be acknowledged in the space provided on the SF 1442 or by returning a signed copy of the amendment by the time set for receipt of quotes. Explanations or instructions given in a form other than an amendment to the solicitation shall not be binding. Questions (on a non-attribution basis) and answers shall be furnished to all prospective quoter via the web site.

3.5. For security reasons, all technical and engineering data related to this solicitation will be distributed using the Contract Opportunities (https://beta.sam.gov/) system. Contract Opportunities is a web-based dissemination tool designed to safeguard acquisition-related information for all Federal agencies. Interested quoters must register with Contract Opportunities before accessing the system.:

3.6. Amendments, if/when issued will be posted to https://beta.sam.gov/ for electronic downloading. This will normally be the only method of distributing amendments prior to closing; therefore, it is the quoters responsibility to check the website periodically for any amendments to the solicitation. Websites are occasionally inaccessible due to various reasons.

4. Wage Determination:

4.1. Davis Bacon Wage Rates are applicable to this project. Current prevailing wage determination(s) at time of issuance of solicitation are CA2020015 08/07/2020.

4.2. In the event the current prevailing Wage Determination is changed by the Department of Labor prior to the closing date of this solicitation, it is the quoters’ responsibility to insure the most recent determination is used in preparing the quote. An Amendment will not be issued prior to closing to change Wage Determination dates and/or numbers. Should the wage rate change after closing, but prior to award, the updated Wage Determination will be incorporated by amendment and issued to all quoters’ that have not been eliminated from the competition. If applicable, these quoters’/contractors will be given a reasonable opportunity to provide revised quotes solely to amend quotes due to Wage Determination changes. If the wage determination modification does not change any affected wage rates, then the provisions of FAR 22.404-5(c) (4) will apply.

5. Quote Submission Requirements:

5.1. Electronic Submission: With the exception of the original Bid Bond and Power of Attorney, the Quoter shall submit their quote to only the Contracting Officer. Send the complete package to include the bid bond the Contracting Officer using their email address: jennifer.jackson_garcia@us.af.mil

5.2. Bid Guarantee/Bond: In accordance with FAR 52.228-1, Bid Guarantee, one (1) original Bid Bond with original Power of Attorney and is required to be submitted as part of the quoter's submission of a quotation. The Bid Bond must be provided on a SF 24 and physically received by the Contracting Officer by the due date provided in in Block 13 of the SF 1442. Rejection of a bid bond shall be in accordance with FAR 28.101-4, Noncompliance with Bid Guarantee Requirements. Submit the Bid Bond and Power of Attorney to one of the addresses identified below:

5.3. SF 1442: One (1) electronic copy of the SF 1442. Complete the "Offeror" portion of the SF 1442 in its entirety (front and back) and ensure that any/all amendments are acknowledged. In accordance with FAR 4.102, an official having the authority to contractually bind the quoter's firm must sign the SF 1442.

5.4. Section 00010: One (1) electronic copy of the completed Section 00010. Insert the proposed price associated with the project for each line item; all Contract Line Item Numbers (CLINS) must be addressed. For CLINS that will not incur additional cost (i.e., zero-cost items), enter "Not Separately Priced" or "NSP".

5.5. Representations and Certifications, and Section 00600: One (1) electronic copy of the completed Section 00600. If the Quoter's firm has completed their annual Representations and Certifications through the System for Award Management (SAM), the complete and return only those shown in section 00600.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be 20% percent of the bid price or $3,000,000.00, whichever is less.-

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
