About this file
This document is a Justification Review for Limited Competition under FAR 13.106-1(b)(1) for a fall restraint system. The requirement is for a Flexiguard M100 Modular JIB (or equal) and a Counterweight Base without Concrete (or equal) that meets specified criteria including an automatic mast lock, portable design, extended rail length, and power assisted height adjustment. The total estimated price is $XX. The solicitation number is W50S6X-24-Q-0012 and will be posted as brand name or equal on SAM.gov to allow for open competition. The requiring activity is the 166 Mission Support Group Contracting. The contracting officer is Bryan Driscoll, and the technical representative is Christopher Parr. Market research indicated that a brand name or equal description would increase competition compared to the previous RFQ that only used salient characteristics.

IAW DFARS 206.302-1(c)(2) and section 888(a) of the National Defense Authorization Act for Fiscal Year 2017 (Pub. L. 114-328), the justification and approval addressed in FAR 6.303 is required in order to use brand name or equal descriptions.
7. POSTING REQUIREMENTS

8. CONTRACTING REQUIREMENTS
a. Efforts to Obtain Competition
The requirement will be posted on Sam.gov as a brand name or equal requirement and will allow offerors to provide products other than those specifically referenced by brand-name. IAW FAR 6.302-1 (c)(2) allowing prospective contractors to offer other products provides for full and open competition.
b. Actions to Increase Competition

c. Market Research
A previous RFQ was posted on GSA e-Buy using only salient characteristics. Only one (1) quote was received prior to the RFQ close date and the quote was 300% higher than the IGE . Feedback from vendors stated that they didn’t provide quotes because the Government did not specify a specific manufacturer or part number. As a result of this feedback, it was decided that a brand name orequal description would increase competition.
