1. GENERAL
1.1. Scope. This contract includes all operations in connection with supplying one thousand, five hundred (1,500), new ten (10) pound multi-purpose portable fire extinguishers (herein after fire extinguishers). This includes removing Government identified fire extinguishers, properly installing/mounting supplied fire extinguishers in Government identified locations and performing an initial visual inspection of new fire extinguishers and related components (i.e. hangars, inspection tag, etc.)
installed/mounted throughout Tobyhanna Army Depot (TYAD). One thousand, two-hundred and forty-seven (1,247) fire extinguishers shall be returned to the Government.
The contractor shall be responsible to properly dispose of one hundred and forty-six
(146) fire extinguishers. Supplied fire extinguishers shall come complete with a metal handle, metal pull pin, tamper/security seal, metal wall hangar and a monthly (30 day) inspection tag. The contractor shall provide all supervision, labor, equipment, parts and material.
1.2. Existing Condition. Currently, TYAD has approximately one thousand, six hundred (1,600) portable fire extinguishers installed/mounted throughout the installation. Fire extinguishers vary in size and method in which they are installed (hangars, cabinets, etc.). Hangars may be fastened to drywall, steel columns and/or concrete masonry units.
1.3. Non-Personnel Services. The services required hereunder are non-personal services. Contract workers are employees of the contractor and under their administrative control and supervision. The Government shall neither supervise, direct or control contractor employees nor control the method by which the contractor performs the required tasks. Likewise, the contractor, or their workers, shall not supervise, direct, or control the activities of TYAD personnel or the employees of other Contractors. The contractor, through their employees, shall perform the tasks prescribed herein. The contractor is accountable to the Government for the actions of their employees.
1.4. Overtime. Overtime hours are not approved for this contract.
1.5. Place of Performance. All of the fire extinguishers within the scope of this effort are located on-site at TYAD. TYAD is located in Monroe County, Northeast region of Pennsylvania.
1.6. Work Schedule. All work shall be performed during normal business hours, between 0700 and 1600, Monday through Friday, except (a) federal holidays, or (b) other days so designated by the Contracting Officers Representative (COR) or Governments designated Point of Contract (POC). Any work other than these hours or weekend work will be permitted only when advance written approval has been issued by the COR/POC not less than three working days in advance. Technical proposals shall include available resources to meet the requirements of this SOW and include an installation/mounting schedule template covering a normal five (5) day work week.
1.7. Period of Performance. The period of performance is one hundred-eighty (180) business days from commencement of services. It is the sole discretion of the Government to extend the period of performance. Commencement of services occurs once the contractor begins to take delivery of new fire extinguishers and related components and executes the requirements in accordance with (IAW) this SOW.
Commencement of Services shall occur no later than (NLT) sixty (60) business days after contract award.
1.8. Safety. Reference Appendix K, Contractor Safety Standards
1.9. Contractor Identification/Dress Requirements. IAW Federal Acquisition Regulation 37.114(c), all Contractor personnel attending meetings, answering Government telephones and working in other situations where their contractor status is not obvious are required to identify themselves as such to avoid being mistaken for Government officials. Contractors performing work at Government workplaces shall provide their employees with an easily readable identification (ID) badge indicating the employee’s name, the contractor’s name, and the functional area of assignment with a recent color photograph of the employee. Contractor shall require their employees to wear the ID badges visibly when performing work at TYAD. Contractor personnel shall also ensure that all e-mails, documents or reports they produce are suitably marked as Contractor products and/or that Contractor participation is appropriately disclosed. All signature blocks on e-mails shall indicate that the sender is a Contractor employee and include the Contractor's company name.
Contract employees shall be required to practice high standards of personal hygiene and maintain a clean, neat appearance and dress appropriately (casual dress or similar). TYAD is committed to providing a work environment that is comfortable and inclusive for all employees, contractors and visitors. Clothing that Government employees, other contractors and visitors may find offensive or that may make them uncomfortable shall not be permitted. This includes clothing with profane language statements or clothing that promotes causes that include, but are not limited to, politics, religion, sexuality, race, age, gender, and ethnicity.
1.10 Disclosure of Information. This contract may expose the contractor to systems, processes and information proprietary to a Government agency, another Government contractor, or of such a nature that its dissemination would be adverse to the interests of the Government or others. Neither the contractor, nor contractor personnel, shall divulge nor release data or information developed or obtained under performance of this contract. The contractor shall not use, disclose, or reproduce data and information obtained in the performance of this contract.
1.10.1. Social Networking. Contract employees are prohibited from posting, tweeting or otherwise publishing data and information developed or obtained under performance of this contract to social networking sites such as but not limited to Facebook, Tweeter, LinkedIn and Instagram.
1.11. Environmental. Reference Appendix F, Environmental concerns for Contractors.
1.12. The contractor shall be responsible to complete a site visit to acquaint themselves with the necessary details and conditions affecting the requirements of this SOW.
1.13. Within five (5) business days after contract award, the contractor shall provide a detailed electronic report confirming the order IAW this SOW has been placed. This report shall include order numbers, quoted lead times, delivery schedule/dates. This report shall be submitted by email in PDF format to the COR/POC, NLT 4:00 P.M. EST on the date of submission. The contractor shall be required to install fire extinguishers as they arrive as to not delay the installation/mounting of new fire extinguishers throughout TYAD.
1.14. Not less than five (5) business days prior to commencement of services, the contractor shall provide the COR/POC a detailed schedule for installing/mounting the fire extinguishers and related components within TYAD buildings. TYAD operates on a five (5) - four (4) - nine (9) schedule with every other Friday being a Regular Day Off (RDO) for a major percentage of the workforce. Select buildings may be inaccessible on RDO Fridays. The COR/POC will provide a schedule of RDO Fridays covering the duration of the performance period and assist in identifying those buildings which may not be accessible on RDO’s. The COR/POC will also coordinate as necessary in building where escorts are required. The COR/POC and/or his/her designee will be available to provide escorts as needed. The schedule is subject to the approval of the COR/POC. This schedule shall be submitted by email in PDF format to the COR/POC, NLT 4:00 P.M. EST on the date of submission.
1.15. At the contractor’s discretion, drop shipping the new fire extinguishers to TYAD is permitted, however shall be at the contractor’s expense. Building 17A will serve as the Governments designated staging location where the contractor may temporarily stage all new fire extinguishers and related components waiting to be installed/mounted.
Technical proposals must include whether or not the contractor intends to utilize Building 17A to stage new fire extinguishers and related components.
1.16. The Government will have right of first refusal to keep any fire extinguishers and/or related components that are removed as government property before it is discarded, destroyed, or repurposed.
1.17. Within five (5) business days after contract award, the Contractor shall provide a listing of personnel, in order of notification preference, by name and phone numbers, where the government can make immediate contact with management for administrative issues affecting contract performance (.e. non-conformance with the contract requirements). In instances where an answering service is utilized, the contractor shall return all calls within four (4) hours after the time the message is left.
2. REQUIREMENTS.
2.1. Quantity. The contractor shall supply one thousand, five hundred (1,500), new ten
(10) pound multi-purpose fire extinguishers.
2.1. Mandatory Specifications. Each supplied fire extinguisher shall meet or exceed National Fire Protection Association (NFPA) standards, Army Regulation 420-1, CH 25- 33 and meet the following TYAD mandatory specifications.
2.1.1. Underwriters Lab (UL) Rating: 4A:80B: C (ABC). Must be UL listed or Factory Mutual (FM) approved.
2.1.2. Capacity of chemical agent, ammonium phosphate based: Ten (10) pounds.
2.1.3. Minimum six (6) year manufacturer warranty
2.1.4. Rechargeable
2.2. General Specifications. Each supplied fire extinguisher and related component shall meet the following TYAD general specifications.
2.2.1. Multi-Purpose Fire Extinguishers shall be able to be used on Class A, B, or C fires.
2.2.1.1.
Class A: Wood, Paper, cloth, trash, plastics (solids that are not metals).
Class B: Flammable Liquids-Gasoline, oil, grease, acetone (includes flammable gases).
Class C: Electrical: Energized electrical equipment (anything that is plugged in).
2.2.2. Metal handle, metal pull pin and a tamper/security seal.
2.1.2. Metal hangar (mounting bracket). Plastic hangars are unacceptable and will not be considered.
2.1.3. “Fire Extinguisher Must be Inspected Every 30 Days” inspection tag.
Reference 2.1.3.1. Inspection tags shall be attached to the fire extinguisher with a zip tie (bead type) or equivalent method. Technical proposals shall include a sample Fire Extinguisher inspection tag and description of the zip tie or equivalent being proposed.
2.1.3.1. Sample Inspection Tag
2.1.4. Fire extinguishers and related components shall be new. Used and/or refurbished fire extinguishers and/or related components are unacceptable and will not be considered. NO EXCEPTIONS.
2.1.5. Technical proposals must identify
2.1.5.1. The manufacturer and supplier of the fire extinguishers proposed
2.1.5.2. Quoted lead time/delivery schedule from time the order is placed.
2.1.6. Warranties. All fire extinguishers and related components shall free from defects in material and workmanship for a period of not less than six (6) years from the date of purchase. Technical proposals shall include all warranty documentation from the manufacture, supplier and any supplemental contractor warranties.
2.2. Removal. The contractor shall remove all fire extinguishers and related components from Government identified locations throughout TYAD IAW the following requirements.
2.2.1. One thousand, two hundred and forty-seven (1,247) Government identified five (5) pound ABC fire extinguishers and related components shall be removed from Government identified locations. These fire extinguishers and related components shall be returned to the Government. The contractor shall be responsible for the complete removal IAW this section and will be required to relocate/transport these fire extinguishers and related components to a designated staging area/location to be determined by the POC. This area/location will be on-site at TYAD.
2.2.1.1. The COR/POC will provide a detailed listing of all fire extinguishers and related components that are covered under this section. The contractor shall verify the fire extinguisher matches the Government provided list prior to removal. Every effort will be made to ensure the accuracy of this list.
2.2.2 Fifteen (15) five (5) pound ABC fire extinguishers and related components shall be removed from Government identified locations. It shall be the responsibility of the contractor to properly dispose of fire extinguishers and related components covered under this section IAW applicable laws, regulations, TYAD Recycling Policy and this SOW.
2.2.2.1. The COR/POC will provide a detailed listing of all fire extinguishers that are covered under this section. The contractor shall verify the fire extinguisher matches the Government provided list prior to removal. Every effort will be made to ensure the accuracy of this list.
2.2.3. One-hundred and thirty-one (131) ten (10) pound ABC fire extinguishers and related components shall be removed from Government identified locations.
It shall be the responsibility of the contractor to properly dispose of fire extinguishers and related components covered under this section IAW applicable laws, regulations, TYAD Recycling Policy and this SOW.
2.2.3.1. The COR/POC will provide a detailed listing of all fire extinguishers that are covered under this section. The contractor shall verify the fire extinguisher matches the Government provided list prior to removal. Every effort will be made to ensure the accuracy of this list.
2.3. Installation/Mounting. The contractor shall be responsible for the proper installation/mounting of supplied fire extinguishers and related components IAW the following requirements.
2.3.1 Of the one thousand, five hundred (1,500), new ten (10) pound multi-purpose fire extinguishers supplied, the contractor shall be required to properly install/mount one-thousand, three-hundred and ninety-three (1,393) supplied ten (10) pound fire extinguishers IAW the requirements of NFPA 10: Standard for Portable Fire Extinguishers, latest edition and the manufacturer’s recommendations for mounting.
2.3.1.1. Fire extinguishers covered in section 2.3.1 shall be installed in Government identified locations. All fire extinguishers in this section will be installed/mounted in the same location as the fire extinguishers that were removed IAW section 2.2. In any instance where the existing location may not be able to be reused, the contractor shall notify the COR/POC for guidance and/or an alternate location. At the discretion of the COR/POC, a location may be changed if by doing so is in the best interest of the government.
2.3.1.2. Fire extinguishers vary in the methods in which they are installed (hangars, cabinets, etc.). Hangars may be fastened to drywall, steel columns and/or concrete masonry units.
2.3.2. Fire extinguishers shall be secure as to prevent accidental falling of the fire extinguisher.
2.3.3. At the time of installation, the contractor shall be required to perform an initial visual inspection IAW NFPA 10. Visual inspections shall only apply to those fire extinguishers covered in section 2.3.1. The contractor shall annotate the thirty (30) day inspection tag when completing the visual inspection.
2.3.4. Hangars that are not used due to placement of the fire extinguisher in a recessed fire extinguisher cabinet shall be provided to the COR/POC at the conclusion of the contract.
2.3.5. The COR/POC shall make daily random inspections and accept installed fire extinguishers and related components that are installed/mounted and inspected IAW this section.
2.4. Back Stock. Of the one thousand, five hundred (1,500), new ten (10) pound multi-purpose fire extinguishers supplied, the contractor shall be responsible to stage one hundred and seven (107) supplied fire extinguishers and related components at a designated staging area/location to be determined by the COR/POC.
2.3.1. The Government desires to retain these fire extinguishers as back stock for future requirements.
2.3.2. The Government shall be responsible for the installation/mounting and initial inspections for fire extinguishers covered under this section.
2.3.3. The contractor shall be responsible to stage these fire extinguishers and related components covered under this section at the designated staging area/location to be determined by the COR/POC. This includes relocating/transporting these fire extinguishers to the designated staging area/location if required. This area/location will be on-site at TYAD.
2.5. Reporting. The contractor shall comply with the following reporting requirements.
2.5.1. Weekly. The contractor shall provide a detailed electronic weekly report of all fire extinguishers installed/mounted. Reports shall comply with the following requirements.
2.5.1.1. All reports must be computer generated, handwritten reports are not acceptable. All reports shall be free of spelling errors, factually accurate and grammatically correct.
2.5.1.2. Reports shall cover the previous five (5) business days (or more if work was completed on a weekend, etc.). This should list the total number of fire extinguishers installed/mounted and inspected for the reporting period.
2.5.1.3. Reports must also contain a total number of installed/mounted fire extinguishers from contract commencement to present date.
2.5.1.4. Reports shall be submitted through email in a PDF format to the COR/POC, NLT 2:00 P.M. EST every Monday. In instances where the Monday falls on a Federal holiday, the report shall be submitted the next work day.
2.5.1.5. Within five (5) calendar days from the date of contract award, the contractor shall submit to the COR/POC a proposed weekly report template for approval.
2.5.2. Closeout. At the conclusion of the contract, the contractor shall provide a final report that meet requirements listed in this section.
2.5.2.1. The report shall contain a minimum of the following items listed in
2.5.2.2 through 2.5.2.6.
2.5.2.2. All reports must be computer generated, handwritten reports are not acceptable. All reports shall be free of spelling errors, factually accurate and grammatically correct.
2.5.2.3. Contractors Letterhead and/or Company name.
2.5.2.4. Date each fire extinguisher was mounted/installed and inspected.
2.5.2.5. Fire extinguisher make, model, size, serial number, date of manufacture, six (6) year hydrostatic test date and twelve (12) year maintenance due date.
2.5.2.6. Exact location (i.e. Building #, shop name and room number, etc.).
2.6. Site Restoration. In the event that areas of new and/or existing site(s) are disturbed by employees, stored material, vehicles, etc.; and such traffic causes damage (i.e. tire tracks in grass areas, punctures in the floor or pavement, etc.), the contractor shall repair these areas their expense to the satisfaction of the COR/POC prior to completion of the contract. The work site refers to interior and exterior spaces.
3. SECURITY TRAINING REQUIREMENTS.
DEPOT ACCESS:
A background check and approval from TYAD Security Operations Branch is required for all contractor and subcontractor personnel prior to on-site access at TYAD. All persons seeking entrance to TYAD shall submit to and comply with all security standards and requirements in force at the time such persons are seeking entry. All contractors, regardless of resident status or citizenship, will be subject to vehicle search and intense in-processing by TYAD security personnel prior to being granted access to TYAD. This security screening process may be time consuming and access may be delayed or denied. The contractor shall ensure ELTY Form 648-C is completed for all contractor and subcontractor personnel requiring depot access to include warranty services. The TYAD point of contact (POC) will provide ELTY Form 648-C, Request Access to Tobyhanna Army Depot, to the contractor/vendor at least ten days prior to the expected visit date for completion. The contractor/vendor shall return the completed ELTY Form 648-C to the TYAD POC in a timely manner so the same may be submitted to Security for processing no later than seven days prior to the visit. All of the required fields on the form shall be complete and accurate by the contractor/vendor for timely processing. This requirement is inclusive of on-site supervisory or managerial personnel and sub-contractor personnel that the Contractor anticipates will be performing work or visiting on-site. This security screening does not relieve the contractor of any responsibilities to conduct thorough pre-employment background checks and drug screening. Contractor workers will not be granted access to the work site until security screening is completed and access is approved. Any contractor personnel on-site who fail screening will not be permitted further access to TYAD. See “Access and General Protection/Security Policy and Procedures” below.
Please submit the completed ELTY Forms 648-C form(s) to the COR or POC.
SECURITY REQUIREMENTS

All security training certificates shall be provided to the Contracting Officer’s Representative (COR)/Point of Contact (POC) and the Contract Specialist/Purchasing Agent.
Antiterrorism (AT) Level I Training. All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, and controlled access areas shall complete AT Level I awareness training prior to contract report date. This training is required for any additional or new contractor employees, who start after that period. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR/POC within 10 calendar days after completion of training by all employees and subcontractor personnel. Completion of contractor employee training will be documented on ELTY form 583, TYAD On-Post Training Record, or contractor equivalent. As applicable, contractor employees must complete annual AT awareness training as it pertains the length of the contract.
iWATCH Army Training. The contractor and all associated sub-contractors shall brief all employees on the local iWATCH Army Program. This will consist of utilizing the tools and media products on the informational iWATCH Army website to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. Additional guidance and support can be provided by the TYAD Antiterrorism Officer (ATO) at the contractor’s request. The contractor shall notify the COR/POC within 10 calendar days of the completed training for any new employees or subcontractor personnel to assure the ELTY form 583 or contractor equivalent is properly documented. TYAD reserves the right to provide instructor led training and will so advise the contractor within one week of the start of performance or at the time of annual training, if that will be the training approach to be utilized. Completion of contractor employee training will be documented on ELTY form 583, TYAD On-Post Training Record or contractor equivalent.
Operations Security (OPSEC) Training. Per AR 530-1, Operations Security, contractor employees must complete Level I OPSEC training prior to the contract report date and for any additional or new contractor employees, who start after that period. Access and General Protection/Security Policy and Procedures. Contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by TYAD Security Branch. Contractor workforce must comply with all personal identity verification requirements as directed by DoD, HQDA, and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by the government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
4. QUALITY ASSURANCE SURVEILLANCE PLAN.
4.1. This Quality Assurance Surveillance Plan (QASP) has been developed to provide the COR/POC effective and systematic surveillance procedures to monitor contractor performance. It has been developed IAW the requirements listed in the performance-based Statement of Work (SOW) entitled “Portable Fire Extinguisher Replacement”.
4.1.1. This performance-based plan sets forth the procedures and guidelines the COR/POC will use in evaluating the technical performance of the contractor.
4.2. Purpose. The purpose of the QASP is to describe the systematic methods used to measure performance and to identify the reports required and the resources to be employed. The QASP provides a means for evaluating whether the contractor is meeting the performance standards identified in the SOW.
4.3. This QASP is designed to define roles and responsibilities, identify the performance objectives, define the methodologies used to monitor and evaluate the contractor’s performance, describe quality assurance reporting, and describe the analysis of quality assurance monitoring results.
4.4. This QASP sets forth procedures and guidance that Fire and Emergency Services Branch, Risk Management Division, Installation Services Directorate will use in evaluating performance of Contract W25G1V-XX-X-XXXX. It does not relieve the Contractor from non-performance of any task or deliverable described in the contract but not depicted in this document.

4.6. Contract Specialist/Contracting Officer (KO). The KO is the Contracting Officer who performs pre-award functions and awards or executes a contract. The PCO may retain post-award functions or may assign them to an Administrative Contracting Officer.
4.7. COR means an individual designated IAW subsection 201.602-2 of the Defense Federal Acquisition Regulation Supplement and authorized in writing by the contracting officer to perform specific technical or administrative functions. The COR is responsible for monitoring, assessing, and communicating the technical performance of the contractor and assisting the contractor.
4.7. Performance Management Approach.
4.7.1. This contract Portable Fire Extinguisher Replacement for Tobyhanna Army Depot. This includes replacing fire extinguishers identified by the Government throughout TYAD, proper installation/mounting and initial visual inspections. A select number of fire extinguishers will either be disposed of by the contractor and/or returned to the Government.
4.8. Methods of Surveillance
4.8.1. Each month the COR will provide input on the monthly status report.
Any documents or data delivered will undergo 100% inspection on an as required basis.
The COR will be responsible for seeing that any complaints are resolved in a timely manner.
4.8.2. Coordination between the Government COR and the contractor task project leader will ensure mutual understanding of the requirements. Contractor staffing will be judiciously and responsively implemented to maximize resource utilization to satisfy task requirements. The Government COR through periodic interface with the contractor team members shall conduct a 100% inspection of resources provided to ensure regulatory conformance.
4.9. Performance Objectives.

5. PROPOSALS SUBMISSION REQUIREMENTS.
5.1. The Contractor shall show in their technical proposal that they have a complete understanding of the requirement and a well-conceived plan for satisfying this requirement. The technical proposal shall contain a performance plan, including management, quality assurance, and employee’s qualifications/experience to meet the requirements described in this SOW.
5.2. Proposals shall include all-inclusive Firm fixed price to the services IAW this SOW.
5.3. Proposals shall provide the following items as outlined in this SOW.
5.3.1. Reference section 1.6. Pg. 3. Technical proposals shall include available resources to meet the requirements of this SOW and include an installation/mounting schedule template covering a normal five (5) day work week.

1. Air Pollution Control The contractor must control fugitive emissions, including dust, during the course of their contract. The contractor must obtain approval from the Environmental Branch (EB) prior to exhausting equipment to the outside. The contractor must not allow any pollutant or particulate matter to be released to the atmosphere at levels that are visible from outside of Tobyhanna Army Depot (TYAD). The contractor must not perform work that will release pollutants or particulate matter to the atmosphere when the wind speed exceeds ten miles per hour and will result in adverse effects to the surrounding areas. TYAD will monitor the wind speed; it is the contractor’s responsibility to obtain wind speed information through the Contracting Officer Representative (COR).
2. Asbestos The contractor must ensure that all materials used in the performance of this contract are asbestos-free.
Unless specified in the contract, the contractor must not disturb any existing Asbestos- Containing Material (ACM) in the performance of this contract. If ACM, or suspect ACM might be disturbed in performance of this contract, the contractor must avoid coming in contact with the material and immediately notify the COR and the Contract Administrator in writing. The
COR must coordinate with EB to have the material tested to determine if there is ACM. If the material is determined to be ACM and the contractor cannot avoid disturbing the material, the COR will notify the Contracting Officer. The Contracting Officer will direct a change pursuant to the contract clauses entitled “Changes” and “Differing Site Conditions.” If ACM, or suspect ACM has been disturbed, the contractor must immediately notify the COR and call the EB. The contractor will shut down and not move any equipment or supplies near the damaged ACM. The contractor will evacuate all non-contaminated contractor personnel from the immediate vicinity.
Any contractor personnel thought to be contaminated with asbestos must remain in the area until the EB responds. If the damaged material is determined to be ACM and there is potential for further damage, the Contracting Officer will direct a change pursuant to the clauses of the contract clauses entitled “Changes” and “Differing Site Conditions.”
Asbestos abatement required under the contract as originally awarded must be in accordance with United Facilities Guide Specification 02 83 14 00 10 and as otherwise required in the contract. Asbestos abatement not required under the contract as originally awarded, can be incorporated into the existing contract via contract modification, or by the Government taking responsibility for the asbestos abatement. The method of acquiring the abatement is at the discretion of the Government. The contractor must have an asbestos abatement work plan that has been approved by EB prior to beginning any asbestos abatement work.
3. Backflow The contractor shall have a backflow prevention device installed on all contractor equipment that is connected to Tobyhanna Army Depot’s (TYAD) water distribution system. The contractor shall have a water meter installed to monitor water consumption during all phases of the contract.
Water use will be reported monthly to the Environmental Branch.
4. Burning The contractor must not burn refuse and debris anywhere on TYAD.
5. Buy Recycled-Content Materials The Contractor must comply with Resource Conservation and Recovery Act (RCRA) Section 6002 (42 U.S.C. 6962, Federal Procurement) in the acquisition of materials with recycled content to meet the standards of Executive Order 13693, Planning for Federal Sustainability in the Next Decade; March 19, 2015. Specific designated items in this contract for which recycled content standards have been established have been set forth in the specification (e.g., insulation, roofing materials, carpet, carpet pad, paint, floor tiles, shower and restroom dividers). Recovered Material Certification: As required by the RCRA, the contractor must certify that the percentage of recovered materials to be used in the performance of the contract will be at least the amount required by the applicable contract specifications (see Federal Acquisition Regulation (FAR) Provision 52.223-4, Recovered Material Certification). Prior to application for final payment, the contractor must provide a report in accordance with FAR Clause 52.223-9, Estimate of Percentage of Recovered Material Content for Environmental Protection Agency (EPA) Designated Items, to the Contracting Office. Compliance with this program does not relieve the contractor from meeting all other specification requirements.
6. Cultural Resources
The contractor must not adversely affect any property listed on the National Register of Historic Places (NRHP) or properties eligible for inclusion on the NRHP without consultation and approval from the EB through the COR. If there is a discovery of any historic properties, including archeological sites and graveyards, work will cease immediately until requirements of National Historic Preservation Act, as amended, have been met. All archaeological artifacts found at TYAD or TYAD-controlled properties are U. S. Government property until a determination is made otherwise.
7. Demolition Notification If a project involves the demolition of any load-bearing structural members, whether or not asbestos is present, 25 days prior to the demolition, the Commonwealth of Pennsylvania Asbestos Abatement and Demolition/Renovation Notification Form 2700-FM-BAQ0021 must be submitted to EB as specified in the Unified Facilities Guide Specification 02 82 13.00 10. The contractor may obtain a copy of the form from the EB.
8. Drinking Water The contractor must not perform any work on the TYAD potable water system prior to obtaining approval from the EB and the Installation Planning and Maintenance Division certified operator through the COR. If a permit is required due to construction or proposed chemical feed changes, it will be the responsibility of the contractor to obtain all permits associated with the project.
Permit applications will first be reviewed and approved by the Environmental Branch before being submitted to regulatory authorities. Any piping or additions added to the TYAD water system must be disinfected following American Water Works Association circular C651-14 "Disinfecting Water Mains." Construction will be kept outside of drinking water wellhead protection zones when feasible. All new buildings and remodeled buildings will be equipped with a water meter that can easily be read from the exterior of the building.
9. Endangered Species The contractor is responsible for meeting requirements of the Endangered Species Act of 1973.
The contractor must not disturb any endangered species, their habitat or offspring during the implementation of this contract.
10. Emergency/Spills All emergencies and spills must be reported to the TYAD Fire Department by calling 911 from a TYAD phone or (570) 615-7300. If a 911 call is placed on a cell phone, the call will go to the Monroe County Emergency Office. Notify the Monroe County Emergency Office that you are at TYAD and the call will be forwarded to TYADs Fire Department. The contractor must ensure all personnel working on site are trained in the proper procedure according to 29 CFR 1910.120 (if applicable) to initiate a spill response to handle the hazardous substances they are working with. The contractor will take the necessary actions to prevent and contain spills of hazardous materials.
11. Energy Efficiency The Energy Policy Act of 2005 section 109 and the Energy Independence and Security Act of 2007 require all new construction at federal facilities to be 30% better than ASHRAE 90.1.
Energy Policy Act of 2005 section 104 and the Energy Independence and Security Act of 2007 require all new equipment to be Energy Star qualified when available. This is applicable to heating, ventilation and air conditioning equipment, plumbing, building materials, lighting, commercial food service equipment and appliances.
12. Environmental Automation and Control Systems The contractor will not alter, modify, remove or tamper with any environmental automation or control system unless previous arrangement have been made with EB. This includes sensors, programmable logic controllers, equipment housing, power supplies, meters or other hardware/sensor technology.
13. Erosion and Sedimentation Control The contractor shall protect streams, lakes and wetlands from sediment discharges caused by the contractor's activities. The contractor shall also provide (where applicable) an erosion and sedimentation control plan in compliance with state and local laws and regulations, to the COR for approval prior to executing any soil-disturbing activities. The contractor must submit a National Pollutant Discharge Elimination System Permit to the Pennsylvania Department of Environmental Protection (PADEP) prior to any construction activity that encompasses more than one acre. All permits must be reviewed and approved by the EB prior to being sent to any regulatory authority. The contractor shall not disturb any wetlands. Contractor will remove all silt fencing and other temporary control measures once the site is stabilized. Contractor will remove all spoils from TYAD unless a previously approved disposal site has been established.
The contract COR will be responsible for management and control of the spoils disposal site.
14. Fluorescent and Mercury-Bearing Lamps The contractor is to collect, containerize, manage and recycle fluorescent and mercury-bearing lamps in accordance with 40 CFR 273, Standards for Universal Waste Management. A copy of the manifest/Bill of Lading must be given to the EB through the COR five days in advance of shipment by the contractor so that it can be reviewed for accuracy and completeness. The contractor must install low mercury bulbs when available.
15. Hazardous Materials Stored and Labeled The contractor must ensure all hazardous materials (HM) at the work site are properly stored and labeled. The contractor must not leave any HM behind at the completion of the job for any reason. HM must not be stored outside without adequate secondary containment and shelter.
16. Hazardous Waste The contractor must ensure that all hazardous wastes (HW) at the work site are properly stored and labeled in a pre-approved location designated by the EB. The contractor must provide copies of any shipping documents for HW/Universal Waste/Toxic Substances Control Act waste.
If the TYAD EPA number is being used for shipping purposes, only EB is authorized to sign a manifest and the manifest (or copy) must be supplied prior to the day of shipment for review.
The EB will keep originals. If HW or waste requiring special handling (e.g., asbestos) is being turned over to the government for disposal, the contactor must notify the EB through the COR when the waste is ready to be moved.
17. ISO 14001
TYAD is an ISO 14001 certified facility. All contractor and subcontractor employees on site must comply with TYAD Regulation 200-5, “Environmental Management System (EMS).” The contractor may obtain these regulations through the project COR.
18. Limit of Disturbance The contractor must confine the limit of disturbance of the project to the smallest area possible.
19. Mercury-Bearing Equipment The contractor must not install any equipment, switches, or devices (including thermostats) that contain mercury or lead.
