1. Contracting Activity: U.S. Army Contracting Command Aberdeen Proving Ground (ACC-APG) Tobyhanna Division Attn: CCAP-CCT Tobyhanna Army Depot (TYAD) 11 Hap Arnold Boulevard Tobyhanna, PA 18466-5100
2. Description of Action: The proposed action is for the award of a new, Firm-Fixed Price contract for purchase of one automated test station as described in detail below.
Army Working Capital Funds (AWCF) which have been designated for a Capital lnwstment Project (CIP) will be used for this acquisition. The estimated award date for this acquisition is 30 September 2015.
3. Description of Suppfies/Services: TYAD has a mission to repair the Navy Radar Warning System Digital Processor for the AN/APR-39A/B{V)2 legacy Airborne Radar Warning Systems. These systems were originally built by Litton, who was subsequently purchased by Northrup Grumman (NG).
lYAD is required to run automated functional tests as well as Final Acceptance Tests (FAT) in performance of its repair process. n order to meet current workload demands one (1) each additional test station AN/APR-39 Test Set Radio Frequency, Universal Production Data Acquisition Test Equipment (RF-UPDATE) hereafter referred to as "the RF-UP DA TE tester" is now required.
The RF-UPDATE Tester is comprised of a Test Set (lo-Phase Technologies Manufacturer Part Number: 1341689-SYS), Test Program Sets, interface cables, and Interface Test Adapters (ff As). The RF-UPDATE tester will be purchased with maintenance documentation, test program software (source code and executable deployment software) and certificates of calibration.
The required delive is 26 weeks from date of award . The estimated total value of the proposed action is
4. Authority Cited: 10 U.S.C. 2304(c)(1) as implemented by FAR6.302-1 , Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.
5. Reason for Authority Cited: The proposed source for this action is In-Phase Technologies, 401 Bordentown-Hedding Rd. Bordentown, NJ 08505.
lYAD began its mission to repair the Navy Radar Warning System Digital Processor for the AN/APR-39A/B{V)2 legacy Airborne Radar Warning Systems in 2003.
The Navy Program Office provided lYAD with one RF-UPDATE test station as Government Furnished Equipment (GFE). The test set was designed by and built in the mid-1990s by Litton Corp., San Jose CA for the US Navy in support of production of the AN/APR-39A/B(V)2. The documentation was not purchased by the Government for this test station design.
The AN/APR-39AIB(V)2 was integrated on aircraft in the late 1990s and continues to be Integrated as aircrafts are produced. The increased fielded densities and the Global War on Terror maximized the capacity on the GFE tester. To accommodate the increase in work load, lYAD engineers embarked on an in-house effort to develop a second RF-UP DA TE test station. In order to complete the design and fabricate the test station it was determined that contractor services would be r~quired.
Therefore, in 2008 TYAD submitted its requirement to the Communications Electronics Command (CECOM) R2 (Rapid Response) Program Office. The R2 contract was a competitive multiple-award, indefinite delivery, indefinite quantity contract for engineering services. An RFQ was issued for lYAD's task order requirement for completion of the design and test station fabrication of an RF-UP DA TE tester. All R2 contract holders we · · o compete for the order.
task order
-subsequently subcontracted the design and fabrication effort for the lYAD RF-UPDATE tester to In-Phase Technologies, Inc. In-Phase was selected because they were an experienced specialized automated test system provider. In-Phase successfully performed reverse engineering using the Litton Test Station as the design baseline and developed a test platform capable of running the test programs originaUy developed by Litton Corp. The test program executive software was modified for the new test stand while maintaining the same test parameters of the original test program.
It was through performance as a subcontractor of the above task order that kl-Phase has acquired the requisite skills, expertise and most importantly owns the existing design and software code necessary to produce an additional identical RF-UPDATE tester. The performance of this design and fabrication was arduous and technically challenging due in part to the fact that In-Phase was required to integrate OEM proprietary items into the tester. kl-Phase preserved and produced the required RF UPDA TE tester which was tested and accepted by the Navy Program Office, and remains in use at TYAD today. No other contractor is known to have gained the unique qualifications to provide the additional identical unit required by lYAD to perform its mission of repair of the AN/APR-39AJB(V)2.
Neither design data or software code were purchased at the completion of this effort because at the time of procurement, the acquisition of additional lYAD RF-UPDATE testers were not anticipated, nor were funds available for purchase.
Control Nt.mber: CCAP-CCT-15-09
The original RF-UP DA TE tester developed by Litton and the In-Phase redesigned RF-UPDATE tester have been accepted by the Navy program office. A new design effort to utilize standard automated test equipment (A TE) will require a one (1) year verification period with the risk of.. dify and begin the verification process over again at an estimated cost o Design efforts to utilize standard A TE as an alternative was determined by TYA -ring to be cost prohibitive. Standard ATE, such as VDATS, will cost in excess o for hardware and interface devices. The equipment is expected to be 100% uti 1ze on the APR-39 repair line which negates any cost savings for multiple product use. The APR-39 system is estimated to remain in service until 2030.
Dup~cation of the equipment would require the pure~ technical documentation necessary to build it and is estimated at-o purchase. The costs to build and verify the operation of the new RF-UPDATE tester, from this documentation, will exceed the cost of purchasing the test station from In-Phase.
Based upon the above considerations it has been determined that In-Phase has the unique qualifications to fulfill TYAD's requirement for the additional RF-UPDATE tester.
Award to any contractor other than kl-Phase, would also result in duplication of cost and unacceptable delays that are not expected to be recovered through competition.
If TYAD does not purchase the RF-UP DA TE tester, TYAD will not be able to meet customer demands for airborne mission critical equipment. Failure to support demands for Airborne Radar Warning Systems will render US Navy and Air Force aircraft non mission capable.
6. Efforts to Obtain Competition: Market research was conducted, details of which are included in the market research section of this document. On 18 Jun 2015 Sources Sought Announcement {SSA) Number W25G1V-15-R-0013 was posted to the Federal Business Opportunities Page for a period of 15 calendar days. Interested parties were requested to contact the Government and submit a capability statement. The Government received one response to the SSA from In-Phase. No other sources have expressed interest in this requirement to date. This effort did not yield any additional potential sources that can meet the Government's requirements. Therefore, there is no expectation of competition for this requirement.
7. Actions to Increase Competition: This is a one-time requirement for lYAD and no future acquisitions for this test equipment is anticipated. However, if a similar requirement arises, every effort will be made to compete it to the maximum extent practicable.
8. Market Research: Market research was conducted throughout the timeframe of October 2014 to May 2015 by lYAD equipment specialist and engineers in accordance with FAR 10.002. nternet research was conducted and other test stations resident at lYAD were considered for this effort and determined to be not acceptable alternatives due to the specialized nature of the RF-UPDATE tester. The specialized equipment developed by kl-Phase would require the alteration of standard test stations such as LM-STAR, VDATS and NGA TS. The alterations would render the test stations unusable for their present mission. It would also require a significant Non Recurring Engineering (NRE) effort to design and verify the new test station design.
In addition, In-Phase was also asked if any outside competitors were interested or expressed interest in manufacturing the test station from In-Phases technical documentation. In-Phase stated that no other contractors were interested in purchasing the documentation and manufacturing the test station. As stated in paragraph 6 above, the sources sought synopsis did not reveal any additional sources for this requirement.
Therefore, the technical experts concluded that In-Phase is the only source that can provide the required test equipment for testing of the AN/APR-39A/B(V)2. Market research cannot identify any sources beyond In-Phase that can meet the Government's requirements.
9. Interested Sources: In-Phase is the only known source capable of providing the required supplies and services. To date, no written responses have been received to the SSA posted on FEDBIZOPPS; however all offers received shall be considered.
10. Other Facts:
a. As stated above Tobyhanna Army Depot purchased engineeri 'tively awarded ated 2 Oct 2008. This contract was subcontracted by .. to In Phase for engineering, design and test station fabrication at a cost of The contract was awarded under the CECOM R2 prime contract. Equipment was supplied as Government Furnished Equipment.
b. Acquisition Data Availability: The configuration of the RF-UPDATE tester purchased from In-Phase is maintained by In-Phase. The Government does not have sufficient documentation for the hardware and software to maintain or compete the remanufacture of the equipment. It is not advantageous for TYAD to apply the in-house resources to develop technical data packages, specifications, engineering descriptions, statements of work or purchase descriptions suitable for full and open competition as it is anticipated that this will be a final requirement for the test equipment.
In-Phase Technologies was contacted and is wilfing to sell a technical data package sufficient to build a RF-UPDATE Tester for a cost o~ The cost for the technical documentation exceeds the cost of the T~.
This Is a one-time buy with no expectation for future requirements. Therefore, it is not considered to be in the Govemmenf s best interest to purchase the technical documentation for future requirements.
c. Subcontracting Competition: The solicitation and subsequent contract wiU contain the FAR Clauses 52.219-8, Utilization of Small Business Concerns and FAR 52.244-5, Competition in Subcontracting and is applicable to this action.
