ADDENDUM

1. This Request for Quote (RFQ) W25G1V-22-Q-0094 is for rental of various lifts which includes emergency maintenance for Ft. Greely, AK. This requirement is for rental equipment. There were specific rental lifts used in the past which are mentioned by model number in the Statement of Work and also salient characteristics listed. The bid must meet or exceed the model numbers listed and/or the salient characteristics listed in the Statement of Work to be considered. Please include the name and part number of the manufacturer equipment in with your quote. Specs may also be submitted. If your alternate does not meet or exceed the requirement, your bid will not be considered.

2. This acquisition for one Firm Fixed Price Contract that will be conducted on a competitive basis as an unrestricted requirement and pursued in accordance with Federal Acquisition Regulation (FAR) Parts 12 (Acquisition of Commercial Items), and Parts 13, (Simplified Acquisition Procedures).

3. One award will be made for the requirements contained in this RFQ. Provided you are satisfied with the work that was completed please go into WAWF and accept the invoice. If you are not satisfied with the work completed or you feel that all the work was not completed that is on this contract please contact me and I will find out how to proceed

4. BASIS OF AWARD: See 52.212-2 Evaluation – Commercial Items

5. Any amendments issued to this solicitation will be synopsized in the same manner as this solicitation. All Offerors are advised to acknowledge all amendments issued to the solicitation with their proposal by completing and signing page one (1) and including one (1) copy of each amendment with their quotation.

6. CONTRACTOR SUBMITTED QUESTIONS: Offerors are advised to submit any questions regarding this solicitation in writing to the purchasing agent Michael Clark via email: michael.j.clark238.civ@army.mil. Answers to questions will be posted in the same manner in which the solicitation is posted (sam.gov) and be incorporated into the resultant award. Questions will not be accepted within two (2) business days of the solicitation closing date.

7. The Government is not responsible for any costs incurred for contractor’s time or materials expended in preparing a proposal for this solicitation.

8. Bids are emailed before deadline to Michael Clark at michael.j.clark238.civ@army.mil . Only electronic proposals will be accepted. No hardcopy proposals will be accepted. Each proposal must be submitted electronically via email to the Purchasing Agent, Michael Clark at michael.j.clark238.civ@army.mil . The size per e-mail must not exceed 9MB. If necessary, offerors may submit multiple emails. If multiple emails are sent, emails must be marked 1 of 2, 2 of 2, etc. To be considered for award, the offeror's complete proposal, including all attachments, must be received in the email Inbox of the Purchasing Agent identified in this solicitation before the closing date and time. If a complete proposal, including all attachments, does not appear in the email Inbox of the Purchasing Agent identified in this solicitation before the closing date and time, then it is not received, and the offeror's entire proposal is late and will not be considered for award. If the offeror does not receive written confirmation of receipt from the Purchasing Agent before the closing date and time, it is the responsibility of the offeror prior to closing of the solicitation to contact the Purchasing Agent identified above to confirm their complete proposal has been received.

The Government will not consider proposals that were delayed, or otherwise not timely delivered to the Contract Purchasing Agent email Inbox because of an issue with the offeror's or the Government's service providers, to include email maintenance, firewall or delivery to any other email box (e.g. junk). Therefore, offerors should anticipate delays in transmission and are advised to plan ahead and to begin transmitting their proposal in enough time to ensure successful delivery prior to the close of the solicitation.

9. QUOTATION SUBMISSION: Parties interested in responding to this RFQ SHALL:

Submit their offer on a completed standard form (SF) 1449 http://www.forms.gov, BLOCK Numbers 17a, 19 thru 24, 30a, 30b, and 30c. The offer, (SF1449), must be signed by a company official authorized to contractually bind the company.

11. To receive an award, the company must have an active registration in the System for Award Management (SAM) https://www.sam.gov. Prospective offerors must be found to be responsible in accordance with FAR 9.1 and have no delinquent federal debt.

12. All pricing must be FOB Destination and WAWF payment. Please include all charges (shipping charges, etc) in unit cost and include lead time/ delivery time.

STATEMENT OF WORK

STATEMENT OF WORK (SOW)

INSTALLATION OF MODERNIZATION OF ENTERPRISE TERMINALS (MET) LARGE FIXED

ANTENNAS (LFAs) at Ft. Greely, AK, RENTAL OF FORKLIFTS, ARTICULATING BOOM LIFTS AND SCISSORLIFT

Part 1

General Information

1. GENERAL: This is a supply order to rent and provide various lifts such as Articulating Boom Lifts, Telehandler forklifts and one electric scissor lift. Periodic refueling (per the Tobyhanna on-site representative request) is required. Emergency maintenance is an all-inclusive cost to be covered within the firm-fixed price such as parts, labor, transportation, etc. If an emergency occurs, the awardee shall provide a technician on-site to service or replace the lift to operational status within 24 hours. The Government shall not exercise any supervision or control. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. This document will be used for all off site service/ rental contracts up to $150K with the performance by the contractor at an off-site facility. The contractor will not require network access during the life of the contract.

1.1 Description/ Introduction: The contractor shall provide all rental equipment, supplies, transportation, and other items and non-personal services necessary to provide Articulating Boom Lifts, tele-handling forklifts lift with periodic refueling. The contractor shall perform to the standards in this contract.

1.2 Background: Installation of a MET REFLECTOR requires the use of articulating boom lifts, telehandler forklift and scissor lift in order for installation personnel to be able to safely access and work at antenna items that are elevated as much as 60 feet above the level of the terrain that surrounds the antenna structure.

1.3 Objectives: To contract with a provider the items listed below during the period of the Period of Performance as shown in paragraph 1.5.

1.4 Scope: Provide Articulating Boom Lifts, telehandler forklift, scissor lift and refueling of rented lifts, and emergency maintenance as necessary or as required.

1.5 Period of Performance: The Period of Performance reads as follows:

1.5.1 The Telehandler forklift shall be of type or similar in specifications to JLG Model 1255, powered by diesel engine, performance including 4 Wheel Drive with forks of length 72 inches.

1.5.2 In addition, quantity two (2) man-Lift 60 foot, Articulating Boom Lifts. Monday 6 June 2022 through Friday 29 July 2022. The Lifts shall be or of type that are similar to JLG 600AJ, power by diesel engine, performance including 4 Wheel Drive and the SkyPower option.

1.5.3 In addition, quantity one (1) scissor lift similar to Genie GS2632, for inside DSCS building, 11 July 2022 through 9 Sept 2022.

1.5.4 All equipment must be delivered to the DSCS Facility on the MDA missile field. Not dropped off at the missile field entry point parking lot.

1.6 General Information

1.6.1 Recognized Holidays: The contractor is not required to provide service if the date for the regular periodic service falls on one of the Recognized Holidays.

1.6.2 Hours of Operation: The contractor is responsible for conducting business between the hours of 0800 and 1630 Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons.

The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.6.3 Place of Performance: The work to be performed under this contract will be performed at 59th Signal BN, Ft.

Greely, AK, 99731“MET installation”.

1.6.4 Type of Contract: The government will award a Firm Fixed Price.

1.6.5 Security Requirements: Contractor personnel performing work under this purchase order are not required to possess a security clearance. However, contractor personnel entering onto Ft. Greely and the 59th Signal BN SATCOM facility. Immediately contract the Point of Contact (POC) at Ft. Greely, AK once the award is received with the following information.(1)Last Name, (2) First Name, (3) Middle Initial, (4) Name Suffix if any, (5) Social Security Number, (6) Date of Birth including year, (7) Citizenship, and (8) Place of Birth City and State. This information will be provided to Security Personnel at Ft. Greely, AK and the security personnel at the SATCOM facility who may use it to conduct a criminal background check. The contract POC will not maintain copies of this information after the information has been provided to Security Personnel at Ft. Greely.

1.6.5.1 All contractors delivering, operating or servicing equipment are required to meet all local security requirements for access to Fort Greely, Alaska.

1.6.6 PHYSICAL Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use.

1.6.7 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced.

Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.13 Contractor Travel Not Applicable.

DEFINITIONS & ACRONYMS

2. DEFINITIONS AND ACRONYMS:

2.1. DEFINITIONS:

2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.9. QUALITY ASSURANCE Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.1.12. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

SPECIFIC TASKS

5. Specific Tasks:

5.1. Basic Requirement: The contractor shall provide in total quantity two (2) Articulating Boom Lifts per the Period of Performance as shown in paragraph 1.5. The Lifts shall be of type that are similar to JLG 600AJ, power by diesel engine, performance including 4 Wheel Drive. The contractor shall provide one (1) telehandler shall be of type or is similar in specifications to JLG Model 1255,. The contractor shall provide quantity one (1) scissor lift similar to Genie GS2632. The contractor shall be able to provide periodic refueling and emergency maintenance within 24 hours of being notified.

The contractor will also deliver all equipment to DSCS facility within the MDA missile field. Equipment is NOT to be dropped off at the MDA missile field controlled entry point parking lot.

52.204-17 OWNERSHIP OR CONTROL OF OFFEROR (AUG 2020)

(a) Definitions. As used in this provision--

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

52.204-26 COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES--REPRESENTATION (OCT

2020)

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(c) Representations.

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that--

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

BASIS OF AWARD – SUPPLY UNDER SAT

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The award will be based on the best value to the Government, considering price, delivery and past performance, to the responsible offeror otherwise conforming to all solicitation requirements. The Government reserves the right to award to other than the lowest price or earliest delivery.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days of expiration.

52.219-1 SMALL BUSINESS PROGRAM REPRESENTATIONS (SEP 2021) - ALTERNATE I (SEPT 2015)

(a) Definitions. As used in this provision--

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business concern eligible under the WOSB Program.

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

Small business concern--

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (b) of this provision.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13

CFR 121.103.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
