About this file

This document is a Justification and Approval (J&A) for Other than Full and Open Competition under FAR Part 6. The J&A is for a modification to an existing Indefinite Delivery/Indefinite Quantity (IDIQ) Firm-Fixed Price contract with U.S. Ordnance to incorporate the MK19 MOD-4 Grenade Machine Gun (GMG), associated Spare Part Kits, and Barrel Assemblies. The modification increases the contract ceiling by $. This sole source action is justified under 10 U.S.C. 3204(a)(1) and FAR 6.302-1 due to U.S. Ordnance being the only responsible source that can meet the agency's requirements without unacceptable delays. The forecasted demand exceeds the current contract's remaining ceiling. Switching to a new contractor would result in at least delay to meet urgent requirements for both the MK19 MOD-3 and MOD-4 GMGs. The Government intends to modify contract W15QKN-22-D-0013 with U.S. Ordnance to address these requirements.

1. Contracting Activity: U.S. Army Contracting Command - New Jersey

2. Description of Action: ACC-NJ, on behalf of the Office of the Project Manager Soldier Lethality, requests approval of this justification for a modification to the MK-19 MOD-3 Grenade Machine Gun (GMG), Spare Part kits and Barrel Assembly Indefinite Delivery/Indefinite Quantity (IDIQ) Firm-Fixed Price (FFP) contract with U.S. Ordnance, 300 West Sydney Dr., McCarran, Nevada 89434. This modification will incorporate the MK19 MOD-4 GMG, associated Spare Part kits and Barrel Assembly into the contract and increase the ceiling amount by .

This modification is required to allow for purchase of unplanned quantities of both the ground-based MK-19 MOD-3 and the ASV mounted MK19 MOD-4 GMGs.

3. Description of Supplies/Services: The MK19 MOD-3/MOD-4 GMGs are air cooled, blow-back operated, belt-fed, automatic weapons that fire 40MM grenades from ground mounts and vehicles.

This contract was awarded on for the MK 19 MOD-3 GMG, MK 19 MOD-3 Spare Parts Kits, and barrel assemblies. The MK19 MOD-4 is almost identical to the MK19 MOD-3, utilizing the basic MK19 MOD-3 receiver and removing /substituting a total of seven (7) components. The demand for the MK19 MOD-4 GMG was not known/anticipated at the time of the contract award. The cumulative obligation against the current contract is

Currently, there are known , which exceeds the remaining contract ceiling. Table One below depicts the forecasted requirements for the remainder of the contract period of performance.

4. Authority Cited: Title 10 United States Code (U.S.C.) 3204(a)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2)(ii)(B), Supplies may be deemed to be available only from the original source for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements. The Government intends to modify the current Contract W15QKN-22-D-0013 with U.S. Ordnance, by increasing its contract ceiling by .

As detailed in the table below, award of a contract to any source other than U.S. Ordnance will result in unacceptable delays of at least to meeting requirements for both the MK19 MOD-3 and MK19 MOD-4 GMGs. These unacceptable delays would result in the

Government being unable to meet the requirements of These unacceptable delays are comprised of two elements. The ability to execute a new contract through full and open competition and the ability of a new contractor to qualify the ability to safely deliver the MK19 MOD-3 and MOD-4 GMGS.

In addition to unacceptable schedule delays detailed above, award to a source other than U.S. Ordnance introduces further risk that a new source will be unable to meet the performance and safety requirements of producing the MK19 MOD 3 and MK19 MOD 4 GMGs. This risk would further delay deliveries and prevent the Government from meeting the surge of urgent requirements.

6. Efforts to Obtain Competition: The notices required by FAR 5.201 shall be published and any bids or proposals received shall be considered.

a. Effective Competition: Effective competition is not anticipated for this acquisition.

b. Subcontracting Competition. U.S. Ordnance is a small business concern. In accordance with FAR 19.702(b)(1), small business contracting plans are not required from entities that are certified as small. Notwithstanding, U.S. Ordnance continues to rely on other small businesses for material sourcing, business supplies and service support. U.S.

Ordnance will be required to select subcontractors to the maximum practical extent in accordance with FAR 52.244-5.

7. Actions to Increase Competition: Full and open competition is not practical at this time.

The Government awarded contract number W15QKN-22-D-0013 to U.S. Ordnance to provide the MK19 GMG under a full and open competition on . Future acquisitions for the subject items will be under a full and open competition utilizing a Government Technical Data Package (TDP).

8. Market Research: A Sources Sought Announcement was published on FedBizOpps on with a closing date of The announcement was published under NAICS code 332994 – Small Arms, Ordnance, and Ordnance Accessories Manufacturing with a small Business Size Standard of 1,000 employees and Product Service Code 1010 – Guns, over 30mm up to 75mm. , it was determined that U.S. Ordnance provides a low risk to cost and schedule.

Additionally, personnel have surveyed the market for potential sources by reviewing trade journals.
