Justification and Approval for Other Than Full and Open Competition
1. Contracting Activity: Contracting Command – New Jersey
2. Description of Action: This justification is for award of a new firm fixed price contract for procurement of Cylindrical Measurement Machine. Fiscal Year 2020, Army Research, Development, Test and Evaluation (RDTE) funds will be used.
3. Description of Supplies/Services: The Cylindrical Measurement Machine is a piece of hardware that will be used to inspect exterior profiles of a variety of large diameter hardware components to high precision. The contractor shall provide deliverable with the following capabilities, to include installation and training on proper use and configuration of the machine:
Diameter measurement range of 0.2-230mm.
CCD-line with 2kHz measuring frequency.
LED illumination with 50.000 hours life cycle.
Configuration in IP65-housing.
Resolution 0.5m.
Interface boards for computer input.
Standard color: RAL 7035 (structure).
Clamping range of 40mm max.
Load capacity for parts up to 400N.
Center height: 140mm.
Angle and cone measurement.
Diameter and length measurement.
Radius and roundness measurement.
Contour image with extensive zoom functions.
Creation of measurement programs in the graphic mode referring to the original contour.
Single measurement with graphic support of all available evaluation values and elements.

4. Authority Cited: Title 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation (FAR) 6.302-1(c)(1), An Acquisition that uses a Brand- Name Description to Specify a Particular Brand-Name, Product, or Feature of a Product, Peculiar to One Manufacturer.
5. Reason for Authority Cited: FAR 6.302-1(c)(1) applies when the acquisition uses a brand- name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer.
The CCDC AC QE&SA Evaluation Laboratory requires a wide range of equipment repair/installation, instrumentation upgrades, facility maintenance, construction trades/repair and renovation, manufacturing and safety enhancements to support CCDC AC research and developmental projects, production programs and theatre requirements. To continue support of CCDC AC requirements, a full functional Cylindrical Measuring Machine is required with the capability to effectively and efficiency inspect exterior profiles of large diameter ranging from 0.2-230mm hardware components, as well as a variety of hardware components.
Through extensive research, it was concluded Jenoptik is the only provider of such a system that has the larger inspection area that meets the Government’s capability requirements. Jenoptik is a German integrated photonics group that divides its activities into three photonics-based divisions Light & Optics, Light & Production and Light & Safety. The Jenoptik Opticline C1023 machine has the unique capability of measuring exterior profiles of large diameter parts with extreme accuracy and will become an important asset to the QE&SA Evaluation Laboratory located at Bldg.
3150 Picatinny Arsenal.
The Jenoptik Opticline C1023 machine is essential to the Government’s requirement as this is the only known machine, which records a profile with great accuracy while spinning the part to be measured 360 degrees.
For this requirement, technical data packages, specifications, engineering descriptions, statements of work or purchase descriptions suitable for full and open competition were not developed or are not available because this is a commercially available item that can be used on a wide range armament components.
Based on the above, and as described in FAR 6.302-1(c)(1), full and open completion will not be provided for the brand name acquisition of the Cylindrical Measurement Machine and hardware components.
6. Efforts to Obtain Competition:
a. Effective Competition: Because this is a brand name action, effective competition is not anticipated. Jenoptik Automotive North America, LLC is the sole source distributor of the Cylindrical Measurement Machine that meets the requirements of the Government. The notices required by FAR 5.102(a)(6) will be posted with the solicitation.
b. Subcontracting Competition: Subcontracting competition will be achieved by the prime contractor by publicizing subcontracting opportunities, as appropriate, in accordance with FAR 5.206. The resulting contract will include FAR 52.219-8 “Utilization of Small Business Concern” and FAR 52.244-4 “Competition in Subcontracting.”
7. Actions to Increase Competition: Competition for this requirement is limited because Jenoptik Automotive North America, LLC is the sole manufacturer, and distributor of the Cylindrical Measurement Machine in North America. However, the Government will continue to monitor the market to determine if another manufacturer’s products can better satisfy future Government’s requirement for a Cylindrical Measurement Machine to inspect large diameter hardware components. If the Government determines that Jenoptik Automotive North America, LLC products are no longer required, the Government will seek competition to the maximum extent for follow on Cylindrical Measurement Machine requirements.
Market Research: Market Research was conducted in July and August 2019 by the Inspection Methodology Laboratory (IML), office symbol FCDD-ACE-QED, of the Evaluation Laboratory Division to identify potential sources for the requisite Cylindrical Measurement Machine. The IML contacted Government and industry personnel that were knowledgeable in the specific market. Next, they contacted , and to discuss their offered services/expertise, and gain knowledge of any third parties capable of providing similar services. IML operated a similar system to become familiar with the machine and determine the type of instrument needed. They also performed web searches to gain product information, and checked the U.S General Services Administration (GSA) website to determine if the Cylindrical Measurement Machine was offered on GSA. Additionally, the Contracting Command New Jersey, Joint Armaments Division (CCNJ-JA) reached out to the GSA Liaison and confirmed on April 28, 2020 that there were no existing GSA contracts that offered the required equipment. CCNJ-JA also posted Sources Sought Notice W15QKN-20-R-0A7A on 27 February 2020 in Contract Opportunities (https://beta.sam.gov) to determine if there were interested vendors that could potentially meet the requirement for capability to inspect exterior profiles of large diameter hardware components. The notice was posted for seven days, (remaining active for 26 days after it was posted), and no responses were received.
Other providers were reviewed that offered similar capabilities, but none of these meet the size requirements.
is a company specializing in microscopes and microscopy imaging equipment for medical, scientific and industrial use. Vendor fails to meet the requirements as they do not offer a machine of the required size.
is a manufacturer of automation sensors, vision systems, barcode readers, laser markers, measuring instruments and digital microscopes. Vendor fails to meet the requirements, as they do not offer a machine of the required size.
Jenoptik offers measurement systems through its Opticline CS that match the capability requirements, and also provide equipment installation and training. Jenoptik Automotive North America, LLC is the sole provider and distributor for its products in the U.S. This was confirmed by the CCDC Armaments Center, FCDD-ACE-QED, on June 3, 2020 via a signed letter from the Director of Sales, Metrology, for Jenoptik Automotive North America, LLC.
Based on the above Market Research it has been determined that Jenoptik Automotive North America, LLC is the only viable source that can fulfill the government’s requirements.
8. Interested Sources: To date, no other sources have written to express an interest.
9. Other Facts:
a. Procurement history:
(1) Contract was awarded to Hommel-Etamic America Corporation on 30 December 2010
(2) This was competed using simplified acquisition procedures using a lowest price technically acceptable (LPTA) source selection method. The procurement history did not identify any unusual patterns or consecutive urgent buys.
Additionally, no significant changes have been identified in the marketplace, except that Hommel-Etamic America Corp is now the industrial metrology division of Jenoptik Automotive America, LLC.

12. Fair and Reasonable Cost Determination:
I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.
An independent Government cost estimate has been prepared for this requirement. In accordance with FAR 15.404-1(b)(2)(ii) and (v), price analysis will be performed to determine fair and reasonable pricing by comparing the proposed prices to historical prices paid, and to the independent Government cost estimate. Certified cost or pricing data will not be required for this commercial acquisition pursuant to the exception in FAR 15.403-1(c)(3).
