FAR Part 16 Exception to Fair Opportunity Justification Under Multiple Award Indefinite Delivery Contracts

For Actions Exceeding the Simplified Acquisition Threshold (SAT)

1. Contracting Activity: The U.S. Army Contracting Command - New Jersey

2. Description of Action:

a. The U.S. Army Armament Research, Development, and Engineering Center (ARDEC) Financial Management Office (FMO) requests a single source Task Order be issued against a Multiple Award Indefinite Delivery, Indefinite Quantity (IDIQ) contract with Firm Fixed Price Task Orders (W15QKN-13-D-0004) be solicited with Universal Technical Resource Services Inc, 950 Kings Highway North Suite 208, Cherry Hill NJ 08034 for Information System and Infrastructure support Services (Functional Area 3). The Government projects award for May 13th 2016 which will utilize fiscal year 2016-2020, Research Development Test & Evaluation (RDT&E).

b. The Principal Assistant Responsible for Contracting approved an acquisition plan in accordance with DFARS 207.103(d)(i)(B) on 26 March 2012.

3. Description of Supplies/Services:

ARDEC FMO requires highly specialized information systems, information technology (IT) infrastructure technical support, and program management support for mission critical related software, computer server systems, Army Enterprise Defense Business Systems and ARDEC Science and Technology (S&T) programs. These support services are crucial for the ARDEC FMO to execute its overall mission.

a. UTRS has been providing information systems, information technology infrastructure, and program management support to ARDEC FMO for over 15 years. The proposed contract action will allow UTRS to continue to partner with ARDEC FMO in supporting FMO’s IT and program management requirements.

Numerous Army Enterprise Defense Business Systems (DBS) and S&T programs are supported via this collaborative relationship between UTRS and ARDEC.

b. The proposed follow-on contract with UTRS will fulfil ARDEC FMO and its customer’s requirement for highly specialized IT and program management support which can be categorized in two main categories as follows:

(i) IT Technical Support

This category covers the Systems Administration (SA), Systems Technician (ST), IT infrastructure, and DBS Support work. FMO needs technical support for the over 25 mission servers that make up the FMO IT infrastructure environment. The technical support maintains the systems Operating systems and security configurations. This support will manage all of FM’s personnel computing needs related to laptops, monitors, and network configurations. The technical support must be IA certified on the systems supported and comply with all mandatory Army certification and training requirements.

The technical support also covers the numerous DBS’s utilized by ARDEC and tenant PEOs located at Picatinny Arsenal. The DBS technical support manage system accounts, trouble shoot user questions and issues with each system, and maintain support documentation for the systems. Systems include Financial Integrated Reporting Environment (FIRE), Defense Travel System (DTS), Wide Area Workflow (WAWF), General Funds Enterprise Systems (GFEBS), Logistics Modernization Program (LMP), and Automated Time Attendance and Production System (ATAAPS).

(ii) General Program Management Support

This category covers program management in support of S&T and Engineering programs as well as well as general competency management across ARDEC. The support includes, but is not limited to, assisting in scheduling, planning, and execution of program resources, participation in program reviews, and assisting Competency Directorate (CD) assigned missions.

c. Period of Performance: The period of performance will be for two (2) months.

Total Value: $699,486.72

d. The total period of performance for this task order need not exceed two (2) months because that is the amount of time necessary to meet the requirements of the work to be performed and for the US Army Contracting Command – N J on behalf of the ARDEC AMO to enter into another contract for the required services through the use of competitive procedures.

4. Authority Cited: 10 U.S.C. 2304c(b)(1) as implemented by FAR 16.505(b)(2)(i)(A) – The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

5. Reason for Authority Cited:

(a) The proposed acquisition must be accomplished through an exception to fair opportunity, and the authority under paragraph 4 applies. Failure to award the contract for FMO Support Services to UTRS will cause unacceptable damage and delays to FMO mission. Requirements will not be met and critical functions will cease to exist resulting is unacceptable risk to FMO's mission. Most recently, the work has been supported under contract W15P7T-06-D-E401 Task Order 0047. While Booz Allen Hamilton was the prime under this contract, UTRS was the supporting subcontractor. This task order expired on 13 May 2016. Fair Opportunity is being waived for this proposed effort to continue such services from the previous task order to the time at which a follow-on effort can be solicited and awarded.

Technical Services provided from UTRS support numerous Defense Business Systems (DBS) that support the day to day operations for ARDEC and other tenant POEs located at Picatinny Arsenal. Each DBS supports an aspect of program budgeting and execution including planning of resources, establishing resources and funding sources, processing mission support labor (employee time and attendance), processing travel orders, executing “non-labor” program funds, and reporting/analyzing program execution to management. A stoppage of support for these systems will result in severe under-execution and schedule delays of mission critical S&T and engineering programs.

Under-execution of resources in support of the mission essential programs will lead to program failure. UTRS has the resources necessary to support these DBSs.

UTRS also provides systems administration (SA) and systems technician (ST) support to all of FM. ST supports over 300 IT hardware equipment items (laptops, monitors, network cables, etc) as well configures the equipment for each user within 4 of the 5 FM divisions. SA supports IT hardware, over 25 virtual servers and 11 physical host servers, for the entire FMO IT infrastructure. SA is responsible for managing the Operating system on all hardware, as well as remaining in compliance with Army Cyber Security requirements. A break in ST and SA support, as a result of this contract with UTRS not being awarded, will cause FM’s user base hardware and IT infrastructure falling out of compliance with Army Information Assurance (IA) and Cybersecurity guidelines. This would result in FM users’ laptops being removed from the Picatinny Network and those employees would not be able to perform their mission. This would also result in some, if not all, of FM IT infrastructure being removed from the Picatinny network, which would shut down RDECOM’s Budget and reporting functionality within FIRE, as well as data repositories and program execution data used to manage ARDEC mission programs.

The Program Management support currently provided by UTRS is critical to FMO and ARDEC. It supports a wide range of Direct Army RDT&E and OMA programs as well as customer funded programs. The program management support currently provided by UTRS offers an in-depth program knowledge on funding, program milestones, schedules, and resources need to complete each mission. A lapse in support will result in milestone slippage, delays in funding execution, and potential program failure.

(b) Based on the above description, there are no known alternatives to the Government other than waiving fair opportunity in accordance with paragraph 4 above and awarding a task order to UTRS under contract W15QKN-13-D-0004. Suspending operations at ARDEC FMO would significantly increase the risk of ARDEC FMO mission failure.

Currently, there is no “in-house” personnel or experience to cover this workload. By awarding this task order with a two (2) month period of performance will continue the existing services required by the Government while at the same time allow the Government to prepare a solicitation for a follow-on effort. Even if fair opportunity was not waived, it would neither be cost effective or realistic to expect another contractor to perform the same services during this brief interim period.

(c) Based on the potential mission failure detailed above, this acquisition will be accomplished through an exception to fair opportunity. UTRS has the necessary IT certifications and experience managing specific Army DBSs and mission critical programs. Any lapse in support will cause mission failure.

6. Actions to Increase Competition:

For any subsequent acquisition of the above described services, it is anticipated that fair opportunity amongst all the MAC IDIQ contractors in Functional Area 3 will be obtained.

7. Market Research:

The Omnibus suite of contract vehicles were competitively awarded on/about 21 December 2012. The base period of performance for these contracts is still open, and, there is ample ceiling remaining. In accordance with FAR 10.001(a)(2)(v), agencies should conduct market research appropriate to the circumstances prior to awarding a task order under an IDIQ contract for noncommercial services in excess of the simplified acquisition threshold. Market Research on the Omnibus II program was recently completed less than 18 months ago, in August 2015. A representative of ARDEC completed the market research using internet searches on a variety of different websites, such as GSA and FedBizOpps, and found that the current state of the market is still consistent with adequacy of coverage across all Functional Areas within the current pool of contractors.
