2. Basis for Award/Evaluation Criteria: Technically Acceptable Lowest Price.

Award will be made to the Offeror(s) who is deemed responsible in accordance with Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Lowest Priced Technically Acceptable offer.

(a) The Government intends to award a contract without discussions (except for clarification as described in FAR 15.306(a)), as permitted by FAR 15.306(a)(3) and FAR 52.215-1. However, the Government reserves the right to conduct discussions to permit Offerors to revise their proposals, if necessary. Trade-offs between price and non-price factors are not permitted. An unbalanced, or incomplete price proposal may be grounds for eliminating a proposal from competition. The Government will evaluate proposed prices for reasonableness using price analysis techniques. Proposed prices evaluated as unreasonable may be grounds for eliminating a proposal from competition.

(b) Minimum Acceptability: If an Offeror takes exception to any of the terms and conditions of the solicitation, the offer may not be considered for award. All Offerors are urged to ensure that their initial proposals are submitted with the most favorable terms in order to reflect their best possible potential.

(c) The following factors shall be used to evaluate offers. Technical and Price.

Technical Factor – Meeting the requirements of the Scope of Work (SOW). Technical elements are not separately rated but will be used to determine the overall Acceptability of the offeror’s Technical Proposal.

Failure to address all elements will deem your proposal non-responsive and not eligible for award.

(f) Price Inconsistencies. A proposal is presumed to represent an Offeror’s best effort to respond to the solicitation. Any inconsistency, whether real or apparent, between promised performance and price, should be explained in the proposal. Any significant inconsistencies, if unexplained, raise a fundamental issue of the Offeror’s understanding of the nature and scope of work required and his financial ability to perform the contract and may be grounds for rejection of the proposal. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

3. Disclosure of the Magnitude of Construction Projects (FAR 36.204). Advance notices and solicitations shall state the magnitude of the requirement in terms of physical characteristics and estimated price range.
