About this file

This document is a Justification and Approval for Other than Full and Open Competition under FAR Part 6. It describes the U.S. Army's plan to award a 5-year, sole-source, Indefinite Delivery Indefinite Quantity (IDIQ) contract to Extant Aerospace for hardware spares and repair services for the WX-500 Stormscope. The Stormscope is required to support the UH-60M Black Hawk and CH-47G Chinook helicopter fleets. The Government has conducted market research but determined Extant Aerospace is the only responsible source with the necessary knowledge, experience, and technical data to meet the requirement. The IDIQ contract is valued at an estimated amount under the Army Working Capital Fund. Prior contracts for the Stormscope were also awarded to Extant Aerospace on a sole-source basis. The Government will continue efforts to increase competition in the future, such as attempting to obtain technical data rights.

Justification and Approval for Other than Full and Open Competition – FAR PART 6

1. Contracting Activity: U.S. Army Contracting Command

Aberdeen Proving Ground (ACC-APG)

ATTN: CCAP-CCE

6565 Surveillance Loop, Building 6001 Aberdeen Proving Ground, Maryland 21005-1846.

2. Description of Action: The U.S. Army Communications Electronics Command (CECOM) and Integrated Logistics Supports Center (ILSC) – Enterprise Solider Aviation (ESA) Support Directorate proposes to issue a follow-on Five (5) year Firm Fixed Price (FFP), single award, Indefinite Delivery Indefinite Quantity (IDIQ) contract on a sole source basis with Extant Aerospace (Cage Code: 22830), 1615 W Nasa Blvd, Melbourne, FL 32901 for the procurement of hardware spares and repair services for the WX-500 Stormscope. This IDIQ will enable additional Task and Delivery Orders to be issued for the WX-500 Stormscope. The IDIQ ordering period is projected to be from October 2023 to October 2028. The proposed contract is estimated to be valued at

Army Working Capital Funds (AWCF) will be used for this effort.

An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

This action is a follow-on to contract SPRBL1-17-D-0014, which was not competed under authority Far 6.302-1. The previous contract’s procurement history is addressed in Section 10 below.

3. Description of Supplies/Services: The proposed contract will enable Delivery Orders (DOs) and Task Orders (TOs) to acquire hardware spares and repair services for the WX-500 Stormscope. The WX-500 Stormscope has performance requirements that meet the mission needs of the UH-60M Black Hawk and CH-47G Chinook fleets.

The delays associated with the development of the WX-500 Stormscope and an approval of

Supplement (DFARS) 252.219-7003, Small Business Subcontracting Plan (DoD Contracts)-Basic. The clauses ensure that Extant Aerospace considers small business concerns and participation in performance of the proposed contract.

7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if changes have occurred in the marketplace that would enable future requirements for the sustainment of the WX-500 Stormscope to be competed.

Ongoing market research will include posting of SSAs, reviewing trade journals, and attending industry symposiums to stay current on the latest Stormscope technology and Stormscope sustainment services to determine if any additional contractors develop products and services that meet the Government’s requirements.

The on-going efforts are to ensure the maximum amount of competition in the future for the repair of WX-500 Stormscope. The Government is not able to separate the system and workloads for this requirement to increase competition, because it does not own the data rights. In an effort to increase competition, Government inquiry was made to Extant Aerospace to obtain production and repair data to which Extant responded negatively. Therefore, Extant remains the only source for that can meet the needs and requirements of the Government.

Although the Government has never been able to obtain the data rights for Stormscope, they will continue to attempt to obtain them and the Technical Data Package (Level 3, organic, or partial organic) for future competition. This will allow other potential contractors the ability to work on existing systems and the Government will not be locked into a sole-source situation as it is right now.

8. Market Research: In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a Sources Sought announcement for the WX-500 Stormscope was posted on SAM.gov on 22 September 2023 until 2 October 2023 seeking potential sources for this effort. No new responses were received for the Sources Sought Announcement except from the incumbent, Extant Aerospace.

Based on market research, the Government technical experts determined Extant Aerospace is the only responsible source with the required knowledge, experience, and technical data necessary to provide the services. Extant Aerospace also provided similar services on previous contracts and is interested and available to provide similar services under a new contract.

9. Interested Sources: As noted in paragraph eight (8) above, only one source, Extant Aerospace, expressed interest in this requirement. To date, no other sources have written to express interest in the acquisition.

10. Other Facts:

a. Procurement History: Prior acquisition history for the procurement and repair contracts are detailed below. All contracts were awarded on a sole source basis to Extant Aerospace under authority of 10 United States Code 2304(c)(1) as implemented by FAR 6.302-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

Previous Justification and Approvals

For the prior contract, SPRBL1-17-D-0014, a market survey was posted to FEDBIZOPs on July 13th through 24th 2015. There were no other respondents to the market survey other than the current supplier L3 Communications. It was concluded that no other sources were capable of manufacturing this product. Market research has not yielded any other manufacturer that can maintain an LRU that has the same Form Fit Function and Interface requirements as the current Storm Scope at a low cost and with the ability to deliver a qualified LRU to be installed and fly aboard the HH-60M, UH-60M Black Hawk and CH-47G Chinook aircraft.

On September 24, 2015, the Army Technical Expert published a sources sought announcement (SSA) on FedBizOpps for the WX-500 Stormscope, F-6555 Radio Control, and IN-602 Position Deviation Indicator parts. No responses were received. On September 29, 2015, the Army Technical Expert contacted L-3 inquiring if they were interested in the acquisition, and L-3 replied that they were interested. No other sources responded. On September 29, 2015, the Government asked L-3 Communications if they were interested in selling the TDPs. L-3 declined to offer the TDPs for sale.

DLA issued a SSA on November 4, 2015 to cover the final five parts for procurement and the six parts for repair services, with a response date of November 20, 2015. No responses were received by DLA.

The Contract Specialist search WebFLIS on November 23, 2015 and did not find any other manufacturing sources. A search of the Army i2Log on November 24, 2015 did not yield any other manufacturing sources. The Contract Specialist searched the internet in March 2016 and did not find any other manufacturing sources.

Contract SPRBL1-11-D-0012 was awarded on a sole source basis pursuant to the authority of 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1 to L-3 on 11 March 2011.

On 4 August 2011, technical experts within the LRC posted a SSA on FedBizOps seeking potential sources for this effort. Only L3 responded to the SSA. On 6 September 2011, the Government’s technical experts contacted L-3 to see if it was interested in this effort. L-3 sated that it was interested and could meet the Governments requirements. Through Lockheed Martin (LM) and VSE Corporation were previously awarded contracts for the required items, neither company was contacted since LM had purchased the items from BF Goodrich (the original equipment manufacturer of these commercial items; however, it was acquired by L-3 in July 2003, and VSE had purchased the items from L-3. Based upon this research, the Goverment’s technical experts determined that only L-3 can meet the Government’s requirement.

On 14 May 2010, technical experts within the LRC posted a SSA on the FedBizOps Page seeking potential sources for this effort. No responses were received to the SSA. On 14 May 2010, the Government’s technical experts contacted L-3 to see if it was interested in this effort. L- 3 stated that it was interested and could meet the Government’s requirements. Though Lockheed Martin (LM) and VSE Corporation (VSE) were previously awarded contracts for the required items, neither company was contacted since LM had purchased the items from BF Goodrich, and VSE had purchased the items from L-3. Based upon this research, the Government’s technical experts determined that only L-3 can meet the Government’s requirement.

Contract W15P7T-07-D-D401 was awarded on a sole source basis pursuant to the authority of 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1 to L-3 on 23 October 2006.

Contract DAAB07-03-D-B012/0061 was awarded on a sole source basis competed under the Rapid Response (R2) Program to VSE Corporation on 29 September 2005.

Contract DAAB07-03-D-B009/0019 was awarded on a sole source basis competed under the Rapid Response (R2) Program to Lockheed Martin (LM) on 20 May 2003.

Contract DAAB07-99-D-B610 was awarded on a sole source basis pursuant to the authority of 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1 to BF Goodrich on 29 September 1999.
