About this file
This document is an Exception to Fair Opportunity Justification (EFOJ) for Material Fielding and Integrated Product Support (MF&IPS) services. The purpose is to extend the current level of effort on an existing task order to prevent disruption in critical mission support services until the follow-on effort can be awarded. The current contract will expire in less than 60 days, and a competitive recompete is planned but will not be completed in time. An extension of 9 months, including a 6-month base period and one 3-month option, is requested to continue the current services at the existing labor rates. The government plans to issue a competitive Request for Proposal (RFP) under the RS3 Multiple Award Indefinite Delivery/Indefinite Quantity (MA IDIQ) contract for the follow-on effort. The projected RFP release date is and the projected award date is . Market research identified 4 small businesses and 2 large businesses, including 1 small business 8(a) concern, that are capable of performing the required services.

PM TR’s objective for this ongoing TO is to realize rigorous and agile IPS to include Total Package Fielding (TPF) and New Equipment Training (NET) for all systems within the PM TR portfolio at optimal cost while maintaining equipment accountability and velocity of fielding.
The purpose of the proposed modifications, to increase the funding ceiling at the current LOE and to extend the PoP by nine (9) additional months (inclusive of a six (6) month base and one (1) three (3) month option), is to prevent disruption in the above listed services until award of the follow-on TO.

The proposed amounts above utilized current rates from the existing MF&IPS effort, and as such, no additional cost is being included in this estimate. The proposed ceiling increase is to extend the current level of effort (LOE) to continue the critical mission support necessary and associated with the current contract/order. For these reasons, the anticipated cost to the Government has been determined to be fair and reasonable.

b. Subcontracting Competition: , and a subcontracting plan is not required. However, subcontracting competition will be achieved by the contractor seeking to maximize subcontracting opportunities, if applicable, with a focus on subcontracting to small and small disadvantaged businesses.
7. Actions to Increase Competition: To remove and overcome any barriers that led to the exception to fair opportunity, the Government intends to ensure there is competition for the follow-on TO by issuing a competitive request for proposal (RFP) under the RS3 MA IDIQ Contract. The projected release date for this RFP is and the projected award date is . The Government will continue to conduct Market Research to ensure that there will be competition, which is anticipated for the follow-on.
8. Market Research: A Request for Information (RFI) was sent to the RS3 vendors on 11 April 2024 with responses due back 29 April 2024 for the MF&IPS 2 recompete effort. The basis of this RFI was utilized to determine that interested sources are available to support the follow-on. PM TR plans to recompete the follow-on effort to obtain support services from interested vendors; however, due to the timeliness in award and current schedule remaining, it is prudent to establish an extension on the existing order to allow time for the award of a new effort.
As a result of the April 2024 RFI, four (4) small businesses and two (2) large businesses provided a respond with intent to bid. From this April 2024 Market Research, one (1) of the responses was identified as Small Business 8(a). The Government has assessed each from the responses received and determined its perceived capability.
Table 2: Capability Assessment
These 15 capabilities identified above provide the essence of this effort for PM TR.
Each capability identified is integral and correlated to each other. Meaning, each capability is equally important to the other. This is why it is imperative that each respondent specifically support and address their ability to support these capabilities within their response. In order to be determined as capable, the responses were evaluated to determine if the parent response (company) would be able to support on their own, through their partnerships, affiliates, subcontracts, and if their response reflected a history of support doing similar or same type of work of that required by PM TR. A full summation and breakout of each vendor’s response can be found in the Market Research report dated and approved for the MF&IPS recompete effort on 01 July 2024. The Market Research report determined that viable sources are available to support this effort. However, not within the timeframe necessary to support a new award and transition efforts for global activities.
Many respondents stipulated that a 30-day transition, would be the minimum amount of time required to be fully successful performing. Given that, the current MF&IPS recompete award timeframe is approximately 120 days out and the current contract/order ends in less than 60 days ( ), the current timeframe to
Approval
Based on the foregoing justification, I hereby approve the Exception to Fair Opportunity Justification (EFOJ) for Material Fielding and Integrated Product Support (MF&IPS) services in the total estimated amount of a nine (9) month Task Order period of performance extension under an exception to the fair opportunity process pursuant to the authority of Title 10 United States Code (U.S.C.) 3406(c)(3) as implemented in Federal Acquisition Regulation (FAR) Part 16.505(b)(2)(i)(C) – the order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
