JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Agency: U.S. Army Contracting Command
Aberdeen Proving Ground
CCAP-CCC
6001 Combat Drive Aberdeen Proving Ground, Maryland 21005
2. Description of Action: The proposed action is for a three (3) year Firm-Fixed-Priced (FFP) definitive contract consisting of a base year and two (2) option years with an estimated value of $82.5M. The proposed contract will provide up to Small TActical Radar – Lightweight (STARLite) Synthetic Aperture Radar/Ground Moving Target Indicator (SAR/GMTI) systems (a STARLite System consists of one Aviation-Kit (A-Kit) and one B-Kit). The contract will have a base year quantity maximum of systems, and two (2) option years for a maximum of systems each. The appropriation funds utilized for this effort will be Fiscal Year (FY) 13-15 Aircraft Procurement, Army (APA). The anticipated award of this effort is 1QFY14.
3. Description of Supplies/Services: The STARLite SAR/GMTI program is an Acquisition Category (ACAT) III program. Program Executive Officer Intelligence, Electronic Warfare, and Sensors (PEO IEW&S) is the Milestone Decision Authority. The development and acquisition of the STARLite is managed by Product Manager Robotic and Unmanned Sensors (PdM RUS).
The STARLite is a lightweight, high-performance, all-weather, multi-functional radar system that is integrated onto the multi-purpose
The is an Army ACAT 1D Program of Record (POR) and the is a Quick Reaction Capability (QRC) Program meeting an urgent need in . The STARLite generates quality images for use by battlefield commanders for the detection and classification of commercial, wheeled vehicle-size targets, as well as the location and tracking of moving ground targets. STARLite provides a tactically responsive asset with wide area, near real-time reconnaissance, surveillance, and target acquisition capabilities. It operates throughout the UA’s flight mission profile in adverse weather and through battlefield obscurants to provide the battlefield commander with increased situational awareness. When integrated onto the PTDS platform, STARLite incorporates Dismount Moving Target Indicator capability. In order to complete this mission, the herein proposed contract action will provide for the procurement of STARLite Systems. The base year of the proposed effort has an estimated value of $39.4M, with the first option year value estimated at $17.1M, and the second option year value estimated at $26M. The contract options will be evaluated and negotiated with the basic requirements at contract award.
4. Authority Cited: 10 U.S.C. § 2304(c)(1) and FAR 6.302-1, Only One Responsible Source and No Other Suppliers Will Satisfy Agency Requirements.
5. Reason for Authority Cited: The proposed source is Northrop Grumman Systems Corporation Electronic Systems (NGES), 1580B West Nursery Road, MS B585, Linthicum Heights, Maryland 21090. NGES is the Original Equipment Manufacturer (OEM) and the only source that can meet the Government’s requirements. The Government does not possess a TDP that completely defines the form, fit and function of the STARLite system, which is needed to provide total systems support. A tested and qualified production-ready STARLite System was procured by the Government and integrated onto the . As a result of NGES’s development at its own expense of its production ready STARLite prior to the award of contract W15P7T-08-C-P427, In February 2012, the Government contacted NGES to ascertain if it was interested in providing an for STARLite; however, . In order to provide system support services of the STARLite system, a Contractor would either need full access to the TDP or would have to reverse engineer the system. The Government has assessed the feasibility of reverse engineering the STARLite to enable competition; however, the reverse engineering effort is considered extremely high risk. A reverse engineering effort would present unacceptable levels of performance, schedule, and cost risk to the program. In addition, a reverse engineering effort could potentially take up to months with test and validation requiring an additional months lead time. This overall month timeline does not support Government requirements, as the STARLite supportability must seamlessly transition from the current contract, W15P7T-08-C-P427, by August 2013 or unacceptable lapses in production will result. STARLite's procurement schedule is built off of procurement schedule. If we do not deliver on time, we will impact and delay the .
Furthermore, it is also estimated that if a new vendor were to be selected through competition, approximately would be added to the system life cycle cost that would not be recovered. The would be associated with test and integration, platform integration implementation, and the need to manage two logistics footprints while continuing to maintain a sole source relationship with NGES for those STARLite systems fielded to date.
Based on the above, NGES is the only responsible source that could satisfy the Government requirement.
6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document.
7. Actions to Increase Competition: NGES has notified the Government that
. This is a one-time requirement and no future similar acquisitions are anticipated. However, if a similar requirement arises, every effort will be made to utilize competition to the maximum extent practicable. Therefore, the Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be awarded on a competitive basis.
8. Market Research: A Sources Sought Notice (SSN) was published on the Federal Business Opportunities (FedBizOpps) Website on 26 February 2013 in an attempt to identify any potential sources capable of performing in the areas of the required support. The Government received responses: (1) NGES and .
The Government’s technical experts evaluated each SSN response. Below is a summary of responses received for the SSA:
NGES, a large business, is the OEM of the STARLite and the current provider of radar engineering; maintenance; hardware and software support; configuration management; field support; repair parts support and procurement; integration support; and has all the STARLite radar technical knowledge to include the STARLite Technical Data Package (TDP). Their response met all Government technical and program schedule requirements.
Based on the above, the Government’s technical experts have determined that only NGES is the only source that can meet the Government’s requirements.
9. Interested Sources: In accordance with FAR 5.201, this action will be synopsized in FedBizOpps. Any proposals that are received will be evaluated.
10. Other Facts:
Procurement History: The Government has procured a total of
