MEMORANDUM FOR RECORD

SUBJECT: Revalidation of Justification and Approval (J&A) Control Number 08-1001

1. The purpose of this memorandum is to revalidate J&A Control Number 08-1001 for Other Than Full and Open Competition. The Acting Assistant Secretary of Army (Acquisition, Logistics and Technology) approved the subject J&A on 24 April 2009 for a follow-on five-year, Firm-Fixed-Price/Cost Plus Fixed Fee, Indefinite Delivery Indefinite Quantity contract, with an ordering ceiling of $360M, for spare parts and engineering support services for AN/TPQ-48 (V) Lightweight Counter Mortar Radar (LCMR) System. LCMR Systems are providing critical capabilities to Warfighters and enhancing force protecting in Afghanistan and Iraq. The proposed source for this action is SRCTec, Inc. (SRCTec). SRCTec is the only source with the engineering and technical knowledge of the LCMR System needed to meet the Government’s requirements. Award of the contract has been delayed due to changes in the Acquisition Requirements Package and the Performance Work Statement. Consequently, the contract has not been awarded within 180 days from the date of the J&A approval. The current forecast is 30 September 2011.

2. The basis for the justification and market conditions as specified in the J&A have not changed. A pre-solicitation synopsis was published on the Federal Business Opportunities (FedBizOps) Page in accordance with FAR 5.201, on 08 February 2011 and no sources have responded to that synopsis expressing interest in the proposed action.

Additionally, within the past year, PM Radars has published a request for information (RFI), a synopsis on FedBizOps, and a business case analysis (BCA). On 23 March 2011, PM Radars published a RFI on FedBizOps for AN/TPQ-49 Systems and Upgrade Kits to AN/TPQ-49 systems. SRCTec was the only source that responded to the RFI. On 16 July 2010, the technical experts from PM Radars presented the BCA, which analyzed four courses of actions (COA). The four COAs that were considered, included competition based on a performance specification (COA #1), competition based on a technical data package (COA #2), sole source leader with a competitive follower subcontract (COA #3), and a sole source acquisition with SRCTec (COA #4).

Additionally, sensitivity analyses were conducted to determine the impact of potential baseline variations on the BCA results. The result of the BCA was that a sole source (COA #4) provided the best AN/TPQ-50 program strategy. On 12 August 2010, the Government posted a synopsis detailing the intent of the Government to extend W15P7T- 08-D-M405 for one year and to include a cost-plus-fixed-fee line item for LCMR engineering and support services on FedBizOps. SRCTec was the only offeror that responded. Based on this additional market research no additional sources were identified that can meet the Government’s requirements. Consequently, the

Government’s technical experts have determined that only SRCTec can meet the Government’s requirements.

3. In accordance with CECOM Life Cycle Management Center Policy Alert No. 38-01, dated 09 August 2001, and with the approval requirements of J&A Control Number 08- 1001, the Memorandum for Record is provided for review.

4. The Point of Contact for this action is Michael Peduto, DSN 848-4757.

The proposed source for this action is SRCTec, Inc. (SRCTec), cage code 4GHA7, 5801 East Taft Road, Suite 7, Syracuse, NY 13212. SRCTec remains the only source with the engineering and technical knowledge of the LCMR System needed to meet the Government’s requirements. 2. Award of the contract has been delayed due to changes in the Acquisition Requirements Package, the Performance Work Statement and delay in receiving the Defense Contract Audit Agency’s audit. The Acquisition Plan 08-08 was amended to include the updated nomenclature for the LCMR family of systems and to provide Defense Logistics Agency (DLA) with ordering authority under National Maintenance Contract (NMC), W15P7T-12-D-M603. The nomenclature changes are as follows:

Previously New AN/TPQ-48(V)2 AN/TPQ-48 and AN/TPQ-48A AN/TPQ-48(V)2 upgrade AN/TPQ-49

AN/TPQ-48(V)3 AN/TPQ-50

4. The basis for the justification and market conditions as specified in the J&A have not changed. The Government has conducted the following market research over the past year since the previous J&A revalidation on April 2011.

a. Market Research related to the AN/TPQ-50: On 19 April 2012, a sources sought notice, W1P7R-12-R-S702, on FedBizOpps.gov for the LCMR AN/TPQ-50 was posted for the procurement of up to one-hundred and thirty-eight (138) LCMR AN/TPQ-50 systems. The Government received responses from Qineti Q, Thales Raytheon, and SRCTec. The technical evaluation conducted by Intelligence and Information Warfare Directorate (I2WD) determined that the SRCTec was the only to meet all key attributes and presented a low risk for the production of AN/TPQ-50 systems. The

File details come from the government source that posted it. Updated .
