About this file

This is Form W-14, a Certificate of Foreign Contracting Party Receiving Federal Procurement Payments issued by the Department of the Treasury Internal Revenue Service (August 2016 version, OMB No. 1545-2263).

The form serves as a certification document for foreign contracting parties receiving federal procurement payments. Part I requires identification information including the foreign contracting party's name, country of incorporation, permanent residence address, mailing address, U.S. taxpayer identification number (if any), contract/reference number, and the acquiring agency's name and address. Part II addresses exemptions based on international agreements, allowing foreign contractors to claim relief from tax under section 5000C pursuant to qualified income tax treaties with the United States. Part III addresses exemptions based on international procurement agreements or because goods and services are produced or performed in the United States, requiring disclosure of total contract price, nonexempt amounts, and contract ratios. Part IV requires explanations when Parts II or III apply, including identification of relevant countries where goods are manufactured or services provided, applicable international procurement agreements, and methods for allocating contract prices between exempt and nonexempt amounts. Part V contains certification language under penalties of perjury, wherein the foreign person certifies their identity, lack of agent or nominee status, agreement to pay applicable taxes and penalties, acknowledgment of procedural obligations under section 5000C, and confirmation that no transactions were undertaken with the principal purpose of avoiding section 5000C taxes. The form must be signed by the foreign person or authorized representative with date and capacity to act noted.
