COMBINED SYNOPSIS/SOLICIATION ‘COMBO’:
VS-17 Panels
i. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
ii. Solicitation FA800324Q0002 is issued as a Request for Quotation (RFQ).
iii. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-06 effective 29 Aug 2024. The DFARS provisions and clauses are those in effect to DFARS Change effective 15 Aug 2024. The DAFFARS provisions and clauses are those in effect to DAFAC 2024-0612 effective 12 Jun 2024.
iv. This is a total small business set-aside. The associated North American Industrial Classification System (NAICS) code for this procurement is 315990 – Other Apparel Accessories and Other Apparel Manufacturing with a small business size standard of 600 Employees.
v. Wright-Patterson Air Force Base intends to award a firm-fixed price contract for the following:
“Signal Panel”
a. CLIN 0001 – VS-17 Panel Orange/Cerise – QTY: 16 – Unit of Measure: EA
vi. Delivery of panels shall be FOB Destination. Contractor shall include delivery schedule information in their quote.

This requirement is subject to FAR 52.232-18 Availability of Funds. Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability to be confirmed in writing by the Contracting Officer.
System for Award Management (SAM) Registration In accordance with FAR 52.204-7, offerors must be registered in the System for Award Management (www.sam.gov) at the time of quotation submission and shall continue to be registered until time of award, during performance, and through final payment of any resultant contract. Refusal to register shall forfeit award.
Offerors shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services (OCT 2022) (DEVIATION DEC 2022), with its offer. The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.
Period of Performance:
The Contractor shall have a maximum of ninety (90) calendar days from the date of award.

BASIS FOR PURCHASE ORDER AWARD: This is a competitive best value source selection utilizing Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR 13.106-2(b)(1) for award of this award. The evaluation process shall proceed as follows:
1. By submission of an offer, the Offeror accepts all solicitation requirements, including terms and conditions, representations and certification and technical requirements related to this contract.
2. The Government intends to award a contract without discussions with respective Offerors. The Government, however, reserves the right to conduct discussions if deemed in its best interest
3. Evaluation Criteria: Acceptable/Unacceptable
4. Offerors must be acceptable in all elements of criteria one (1) to be found technically acceptable for award.
REQUIRED SUBMISSIONS
The submission must include all the below elements to be considered acceptable.
Contractors shall submit the following:
a) Offeror shall submit no more than ONE (1) single page demonstrating their understanding of the requirement which shall include all aspects of the supply as described in the Salient Characteristics/Specifications.
b) On a separate page, offeror will submit a price proposal for VS-17 panel
c) Price proposal will include a general description of the VS-17 panel, lead-time from point of order to delivery.
d) Price proposal will not include tax.
1. Price: Contractors shall provide pricing for the following line items. All equipment must be new. Used or remanufactured equipment will not be considered for award:

2. Offers of "equal" products, including "equal" products of the brand name manufacturer, must meet the following salient characteristics/specifications:
· Orange/Cerise
· Minimum 66 inches wide and 17 inches tall
3. If the Contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:” [Contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the contractor to identify in their quote any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor’s acceptance of the Government’s terms and conditions for inclusion into the resultant purchase order. The provisions and clauses contained in this attachment are applicable to this procurement and will be incorporated into the resultant award, if applicable.
4. Contractors shall provide an active UEI # for the System for Award Management (SAM) registration.
Please note that this procurement IS NOT being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If a contractor submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the contractor’s FSS or GWAC contract, and the statement required above shall be included in the quotation.

52.211-6 Brand Name or Equal (Aug 1999)
(a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation.
(b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must-
(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;
(2) Clearly identify the item by-
(i) Brand name, if any; and
(ii) Make or model number;
(3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and
(4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.
(c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.
(d) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services.
