SECTION A: GENERAL INFORMATION AND BACKGROUND
This Request for Quote (RFQ) is issued as a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
The incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2023-04. In accordance with FAR 12.603, the following provisions and clauses are applicable to this solicitation and may be reviewed/obtained in full text form either later in this RFQ and/or at http://www.acquisition.gov/far.
The U.S. General Services Administration (GSA) is requesting quotes for the below quantity of unbundled Green‑e® Energy Certified (Green‑e®) Renewable Energy Certificates (RECs or Green‑e® RECs) from generation resources that deliver to the ISO-NE (Independent System Operator - New England) Balancing Authority and qualify as carbon pollution-free electricity (CFE) in order to meet Federal environmental goals laid out in Section 203 of Executive Order (E.O.) 14057, Catalyzing Clean Energy Industries and Jobs Through Federal Sustainability (December 8, 2021) and its associated White House Council on Environmental Quality Implementing Instructions. Such Green‑e® RECs must meet the requirements outlined below.
GSA anticipates a single, one-time award of a Firm-Fixed Price Purchase Order as the result of this solicitation. This solicitation is being issued as 100% small business set aside. The applicable North American Industrial Classification Code System (NAICS) code is 221122, Electric Power Distribution. The Small Business Size Standard is 1,100 employees. Any supplier with the number of employees exceeding this standard for three continuous calendar years is considered a large business for the purposes of this procurement.
SECTION B: DEFINITIONS
Renewable Energy Certificates (RECs): RECs are instruments that convey information (attributes) about a unit of energy, including the resource used to create it, and the emissions associated with its production and use. A REC is a type of Energy Attribute Certificate (EAC).
Each REC certifies that one (1) megawatt-hour (MWh) of energy has been generated, and fed into the grid, from a particular source such as a solar or wind power plant. For the purposes of this RFQ, the terms REC, EAC, Tradable Renewable Certificates, renewable power, or Green Tags are equivalent terms. These other instruments may fulfill the requirement to provide an REC, so long as all other terms and conditions are met. Unbundled RECs are sold separately from the physical electricity.
SECTION C: STATEMENT OF REQUIREMENT
C.1 QUALIFYING RECS
GSA has the goal of achieving LEED (Leadership in Energy and Environmental Design) Platinum certification for the John A. Volpe National Transportation Systems Center located at 220 Binney Street in Cambridge, Massachusetts (Volpe). In order to achieve LEED Platinum certification, GSA requires Green‑e® RECs that also qualify as CFE in order to meet Federal https://www.acquisition.gov/far/subpart-12.6#FAR_Subpart_12_6 environmental goals laid out in Section 203 of E.O. 14057. In order meet LEED standards and qualify as CFE, the RECs must meet the following requirements:
● Green‑e® Energy as certified by the Center for Resource Solutions’ Green‑e® certification program. The Green-e® RECs offered must be certified Green-e®. RECs from Center for Resource Solutions (CRS) listed facilities that are certifiable, but have not yet been certified as Green-e are not acceptable.
● Renewable Resource Type: RECs shall only come from resources that generate no carbon emissions, including marine energy, solar, wind, hydrokinetic (including tidal, wave, current, and thermal), geothermal, and hydroelectric. Green‑e® RECs from other sources such as biomass, biodiesel and fuel cells will not be accepted, because those sources do not meet the definition of CFE in E.O. 14057 and its associated Implementing Instructions.
● Generation Resource Commercial Operation Date: all RECs delivered under this purchase order must be generated from CFE resources that were placed in service on or after October 1, 2021, either as a new resource or as new capacity at an existing resource modified to increase output. If a quoter intends to supply RECs from a resource “modified to increase output” after October 1, 2021, the quoter shall submit detailed information1 on this resource to GSA no later than five (5) calendar days prior to date the solicitation closes, so the Government can verify that the resource EACs meet this requirement.
Note: For the purposes of this requirement, modifications to increase output must result in new resource capacity additions. Modifications that result in increased power output from existing capacity or that reestablish an existing generating resource’s placed-in-service date do not qualify as new resource capacity additions.
● Renewable Resource Balancing Authority: RECs must be sourced from generation resources that deliver to the ISO-NE Balancing Authority.
● REC Vintage: GSA intends to count these RECs either towards its FY 2023 or FY 2024 CFE goals; therefore, RECs must be generated between April 1, 2023 and December 30, 2023.
C.2 PAYMENT AND BILLING
The Contractor shall invoice for the total amount of RECs delivered to GSA. Before an invoice may be paid, the Contractor must submit Attachments 1 - 5. The Contractor's bill shall encompass ALL applicable charges. Payment shall be in accordance with FAR 32.9 (Prompt Payment), see incorporated clause 52.232-25. If payment is to be made by electronic funds transfer, the provisions of FAR 32.11 (Electronic Funds Transfer), the incorporated clause 52.232-33 shall apply. Invoices and supporting documentation shall be submitted for approval
1 For resources that have been modified to result in new resource capacity additions, please indicate either the new capacity or new capacity added to existing resource capacity in megawatts (MW), the placed-in-service date of the new resource capacity (MM/DD/YYYY), whether the new resource capacity additions are independently metered (Y/N) apart from existing resource capacity, the megawatt-hour and EAC output resulting from the new resource capacity only and provide a brief description of the modification (e.g., new wind turbines, additional solar panels).
via electronic mail to the Contracting Officer at Bonnie.Bueter@gsa.gov. Upon approval, invoices will be submitted electronically to:
pfsutilities@mettel.net METTEL General Services Administration c/o MetTel Bruin Team New York, NY 10008.
C.3 RECORD KEEPING
The Government reserves the right to validate source and transaction history as indicated above and to ensure the RECs adhere to the requirements herein. The Contractor must meet all applicable local, state and federal documentation requirements necessary to successfully complete any contract. These records shall be made available upon request to the Government or to any party designated by the Government as authorized to request this data.
C.4 DELIVERY
Green-e® RECs shall be retired on the Government’s behalf. No later than 60 days from the Effective Date of Award for the Base or from the date each option is awarded, as applicable, the Contractor shall complete the Attestation Forms found at Attachments 1 - 4, which shall affirm delivery and retirement of EACs. The Contractor shall also provide a Prospective Product Content Level documenting that the RECs are Green-e® Energy Certified (documentation shall include the Green-e® Energy Logo). Attachment 5 is a template, which resembles the Prospective Product Content Label that a Green-e® Energy Certified seller should deliver.
Attestation Forms and the Green-e® certificate shall be submitted via electronic mail to the Contracting Officer at Bonnie.Bueter@gsa.gov.
C.5 ANTI-DEFICIENCY
In accordance with the Anti-Deficiency Act (31 U.S.C. 1341(a)(1)), nothing contained herein shall be construed as binding the Government to expend, in any one fiscal year, any sum in excess of the appropriation made by Congress for that fiscal year in furtherance of the subject matter of the contract or to involve the Government in an obligation for the future expenditure of moneys before an appropriation is made.
