About this file

This is a Justification for an Exception to Fair Opportunity document for a U.S. Air Force bridge contract action. The document justifies a direct award to incumbent contractor GiaMed for the VIPER II Sports Medicine contract at Joint Base San Antonio (JBSA)-Lackland, Chapman Annex, and Camp Bullis, Texas, under the 37th Training Wing. The bridge contract covers a 12-month performance period from August 29, 2025, to August 28, 2026, with a firm-fixed-price structure under NAICS code 622110 (General Medical and Surgical Hospital). The requirement encompasses 33 full-time equivalent positions including 15 Athletic Trainers-Staff (28,800 total hours), 13 Athletic Trainers-Senior (24,960 total hours), 1 Athletic Trainer-Head (1,920 total hours), 2 Exercise Physiologists (3,840 total hours), and 2 Dietitians (3,840 total hours), generating approximately 20,000 visits annually.

The justification cites FAR 16.505(b)(2)(i)(C) as the exception basis, emphasizing continuity of services to prevent disruptions in critical sports medicine support for Basic Military Training (BMT). Key supporting factors include the 37th Training Wing's lack of a certified Services Acquisition Lead (SAL) who must complete Defense Acquisition University credentialing within six months, pending approval of a Memorandum of Agreement from the 59th Medical Group for personal services outside the Military Treatment Facility, and the 502 Air Base Wing's contract award lead time of 250 days for services over the specified threshold. GiaMed was originally selected through competitive procedures on DHA's MQS ordering portal in 2019 and maintains satisfactory performance ratings. The follow-on requirement will be competitively solicited under DHA's new MQS2-NG mandatory contract vehicle with 33 authorized vendors able to compete.

Justification for an Exception to Fair Opportunity or to Use Brand-Name Restriction

CONTROLLED UNCLASSIFIED INFORMATION

v 18 Jan 2024 CONTROLLED UNCLASSIFIED INFORMATION Page 2 of 6 in preventing serious injuries. Without their expertise, the risk of additional harm increases significantly, and additional services may be required if issues are not identified early. Without this requirement, serious mission impact will occur. Musculoskeletal injuries are the leading cause of trainee related medical waivers and have a profound impact on Basic Military Training (BMT) meeting its production metrics. This capability is critical to reducing trainee attrition, and lowering healthcare visits for those injured. While difficult to ascertain an exact figure, a historic 2018 study projected a cost avoidance of $ per year. Currently, our VIPER contractors generate ~20,000 visits annually. The loss of this contract and associated workload could not be absorbed by the 59 MDW.

See the periods below for the estimated total base for a year's performance.

The projected (Bridge Action) Period of Performance:

29 August 2025 to 28 August 2026 (12-month duration)

0003 Athletic Trainer-Head 1 HR 1,920 $ $

0004 Exercise Physiologists 2 HR 3,840 $ $

0005 Dietitians 2 HR 3,840 $ $

Base Year Total: $

The North American Industry Classification System (NAICS) code for this requirement is 622110, General Medical and Surgical Hospital. The final determination is that 502 CONS will directly award this requirement to GiaMed as a FFP Task Order IAW procedures in FAR 16.505(b)(2)(i)(C), Department of the Air Force Federal Acquisition Regulation Supplement (DAFFARS) 5306.303-1-90(a) - Bridge Actions for Service Contracts Only, DHA Medical Q-Coded Services (MQS) mandatory use letter, and Defense Logistics Acquisition Directive (DLAD) 16.191(b)(3).

(4) Identification of the exception to fair opportunity and the supporting rationale:

In accordance with FAR 16.505(b)(2)(i)(C), a direct award is being issued to GiaMed, the incumbent task order awardee. This decision prioritizes continuity of services, ensuring uninterrupted service quality and minimizing potential disruptions associated with transitioning to a new provider. Specifically, retaining GiaMed will avoid the costs and risks associated with a full transition, including potential service interruptions, reduced operational efficiency during on-boarding, and increased training requirements for a new workforce. Furthermore, leveraging GiaMed's established expertise and familiarity with the existing systems will mitigate potential performance risks. Given the current economic climate, characterized by inflation and the need for efficiency, extending the task order with a one-year follow-on bridge represents the most advantageous approach for the Government, preserving the proven benefits of the existing service delivery model. The original Task Order Proposal Request ( was posted on DHA's Ordering portal from October 09, 2019, to October 22, 2019, per the MQS ordering guide, resulting in proposals.

GiaMed was initially selected for award valued at $ based on superior performance and competitive pricing under NAICS code "622110." This award encompassed a base period and four option years, utilizing DHA's MQS IDIQ contract

(5) Contracting Officer's determination that the anticipated cost to the Government will be fair and reasonable:

Market research indicated GiaMed continues to be listed as a contractor under DHA's MQS, Multiple Award Contracts (MAC) and is capable of performing services listed under this requirement. The Contracting Officer (CO) will use FAR 15.404-1(b) procedures to determine fair and reasonable costs. The proposal will be rigorously compared to the market and previous awards to ensure a fair and reasonable price.

(6) Other facts supporting the justification:

GiaMed is the incumbent contractor currently performing this service and is in the governments best interest of continuing these services under a bridge contract to prevent a break in service. The purpose of the bridge is to provide additional time for competing the new requirement package. IAW Department of the Air Force Instruction (DAFI) 63-138 paragraph 2.11 and Table 2.3, the Services Acquisition Lead (SAL) must be designated for all services acquisitions greater than or equal to $10M up to $100M that are categorized under S-CAT IV. The 37TRW is currently without a certified SAL and is undergoing the required Defense Acquisition University (DAU) Services Acquisition Team Member Credentialing, which must be completed within 6 months of designation. Furthermore, the 37TRW is awaiting an approved Memorandum of Agreement (MOA) from the 59th MDG to authorize the continuation of personal services outside of the Military Treatment Facility (MTF). Additionally, the 502 Air Base Wing (ABW) Fiscal Year 2025 & 2026 Contract Cut-off Dates letter indicates an contract award lead time of 250 days for services over $ Awarding this bridge task order will allow the 37TRW to complete these essential prerequisites before transitioning to a new contract. Maintaining these services through GiaMed for the bridge award while preparing the follow-on requirement ensures the 37th can continue to train trainees efficiently and effectively, mitigating the risk of serious injuries. GiaMed's satisfactory performance throughout the current task order, evidenced by a Supplier Performance Risk System (SPRS) rating of further supports the decision to award a bridge contract. The follow-on requirement will be competitively solicited under DHA's new MQS2- NG mandatory contract vehicle.

(7) Actions the agency may take to remove or overcome any barriers to increasing fair opportunity before any subsequent acquisition for the supplies or services:

The Government will post the follow-on package requirement on DHA's Ordering Portal Symphony in an effort to promote competition from the 33 authorized vendors able to compete under the DHA MQS contract.

This will allow the Government to choose the contractor with the best performance rating and price, which would be in the Government's best interest.
