About this file

This Sole Source Justification document details the Department of Veterans Affairs' (VA) procurement of 10 digital Veteran images from F8PJ, LLC (doing business as Veterans Portrait Project) for VA.gov website marketing purposes. The contract will be a firm fixed-price purchase order with a 12-month base period and two 12-month option periods, funded under the Promise to Address Comprehensive Toxic (PACT) Act. The vendor is a woman-owned small business with exclusive rights to the specific photographs, which have been used in VA branding for several years and are uniquely configured to work with VA.gov websites.

VA technical experts determined that these particular images cannot be replaced without significant redesign costs, and F8PJ maintains critical contact information for the photograph subjects. Market research conducted by VA included searches on stock photography platforms like iStock and Shutterstock, which confirmed the images' exclusivity. The procurement will be synopsized on the Contract Opportunities Page, with any received bids/proposals to be evaluated. The document includes certifications from a Program Analyst and Contracting Officer confirming the accuracy of the justification and the fair and reasonable pricing of the contract action.

FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold.

Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.

5. Reason for Authority Cited.

The proposed source for this action is:

F8PJ, LLC (F8PJ)

DBA Veterans Portrait Project (VPP) Tax ID: 26-1372352

DUNS: 011949755

Vendor is a Woman Owned Small Business

The 10 photographs required by this effort have been used as part of VA branding across VA.gov websites for several years and are configured to work with the specific VA.gov websites. Utilizing the 10 specific images on VA.gov will ensure the integrity of the web design and eliminate the need for an entire re-design of VA.gov, whereas the use of any other photographs would require a significant level of effort and incur additional costs for reconfiguration to work on VA.gov, of which the costs are not anticipated to be offset by competition. The Government’s technical experts contacted F8PJ about the purchase of perpetual rights to these images. However, the technical experts determined that it is not in the Government’s best interest as it would not lead to an overall price savings. F8PJ holds exclusive rights to the 10 required photographs;

thus, no other vendor can provide access to the 10 necessary photos. Additionally, F8PJ maintains contact information for the subject of each photograph and supports the maintenance of agreements with each subject ensuring they properly authorize the use of their image and the conditions under which they may be used. Use of a vendor other than F8PJ would risk the lapse or mishandling of those agreements.

6. Efforts to Obtain Competition.

The sources proposed above are the only sources that can meet the immediate need requirements for the reasons given above. Procurement data does not include any unnecessary requirements that may inhibit competition.

7. Actions to Increase Competition.

Other actions will be accomplished to increase competition in future efforts for similar supplies. The VA.gov roadmap includes discovery efforts to determine if a site-wide design change is necessary.

8. Market Research.

The Government’s technical experts reviewed other digital photograph options via web searches, including iStock, Shutterstock and Pixabay (other common sites such as Pexels were blocked by VA network and eliminated from the search). The vendor’s exclusive images are not available through these commercial stock platforms. Since the vendor has exclusive rights to the 10 necessary photographs, these photographs are configured to VA.gov and contain contact information utilized by VA.gov. Thus, the Government’s technical experts determined there are no other sources that meet VA’s requirements.

9. Interested Sources.

This procurement will be synopsized in the Contract Opportunities Page and any bids/proposals received shall be evaluated.
