1. Description of Requirement

The contractor shall provide vehicle leasing for the United States Government (USG) on Camp Lemonnier (CLDJ), and Chabelley Airfield (CADJ), Republic of Djibouti. The contractor shall provide vehicles, to include personnel, equipment, supplies, preventive maintenance (i.e. oil, tires, shocks, etc.), repairs, supervision, and other incidentals necessary to meet the terms and specifications of this requirement.

1.1. Period of Performance (PoP)

The BPA period of performance to place calls is from 1 October 2024 through 30 September 2029 unless the BPA Master Dollar Limit ($3,000,000) is reached prior to the performance end date. All calls placed under this BPA/PWS must go through the 726 EMSS Vehicle Management flight as stated in AFI 24-302: “Host/Servicing Vehicle Management reviews, validates and processes all lease and rental requests for all installation activities. Units with new lease or rental request will coordinate and process their requirements through the host/servicing vehicle fleet management activity.”

The Government is only obligated to the extent of any placed calls. The Government is under no obligation to place any certain number of calls. There is no termination liability if the Government does not places calls or if the Government elects to terminate the BPA early. The Government may place a call for any number/combination of vehicles for any lease duration (in months and/or years). The Government reserves the right to return any vehicle with a 15-day written notice at no additional cost, and the Government shall only be responsible for the pro rata costs of the rental.

The Government may also extend the lease duration, with advanced notice to the contractor, at the same terms and conditions as the original call

1.2. Scope

The Contractor shall provide safe, operable vehicles and services in accordance with this agreement. All vehicles shall be: fully operational at all times, acceptable to the government representative, in good running condition, delivered with all fluids full and all maintenance services up to date, and maintained by the Contractor via both scheduled and unscheduled maintenance.

Vehicles manufactured in China or made by any Chinese company or subsidiaries shall not be accepted. If a vehicle is unavailable due to mechanical malfunction or scheduled maintenance for more than 24 hours, the contractor shall provide a fully operational replacement vehicle within 24 hours.

LEE, ANGELIQUE B Capt USAF AFAFRICA 406 AEW/JA Somewhere it should be expressly stated in the PWS something along the lines of, “The Government is only obligated to the extent of any placed calls. The Government is under no obligation to place any certain number of calls. There is no termination liability if the Government does not places calls or if the Government elects to terminate the BPA early.”

Fine with addition of AFI 24-302. However, still recommend adding the language in first comment.

Reason: Makes it extremely clear to the contractor that Government is not liable if it does not place calls, terminates early, and is not obligated unless a call is placed.

LEE, ANGELIQUE B Capt USAF AFAFRICA 406 AEW/JA Also recommend adding duration. I understand duration can be defined in the call, but why not include in the PWS? Consider a provision that states, “The Government may place a call for any number/combination of vehicles for any lease duration (in months and/or years). The Government reserves the right to return any vehicle with a 15-day written notice at no additional cost, and the Government shall only be responsible for the pro rata costs of the rental. The Government may also extend the lease duration, with advanced notice to the contractor, at the same terms and conditions as the original call.”

operation basis. The Government shall not perform maintenance on leased vehicles; will inform the contractor immediately of any discovered vehicle discrepancies; will check all fluid levels and report to the contractor for servicing when required; shall be able to jump start vehicles at no risk. Any loss or damage, to include missing accessories, (total for each vehicle) that is valued less than $1000 shall be solely the responsibility of the Contractor, without any reimbursement or compensation from the Government.

Within 24 hours of return of the vehicle to the Contractor, the contractor is required to submit any notification of damage (with photos) by e-mail to the Government.

Failure to provide such notification shall preclude reimbursement to the Contractor for any loss/damage.

Within fourteen days of return of the vehicle to the Contractor, the Contractor must also provide an itemized damage assessment estimate from an independent repair company, specifically identifying the damage, the location of the damage, and the cost of repair for that damage, to include parts and labor hours.

The Contractor shall not be entitled to reimbursement if the Contractor’s submitted damage assessment does not meet these requirements. The damage valuation must be based on at least one damage valuation estimate, and may, at the discretion of the Government, be subject to a second damage valuation estimate by the Government.

If the Government requests a second damage valuation estimate, the Contractor shall facilitate inspection of the vehicle, and the Government will determine the repair company and provide funding for the damage valuation estimate thereof.

A copy of the insurance policy and registration shall be provided to the contracting officer or designated representative. The contractor shall carry full insurance coverage with zero deductible from the government to cover the cost for replacement or repair of vehicles lost, stolen, or damaged through criminal acts, natural acts, or hostile acts. This is to preclude the Government from being held liable for claims generating from any of the above. In addition to full coverage, the contractor shall carry full coverage liability, medical, and collision insurance with zero deductible to the Government to cover all medical, legal and accident repair expenses to be paid for repairs, injuries or death settlement expenses when a vehicle is involved in a motor vehicle accident.

All vehicles damaged as a result of an accident and documented by valid Djiboutian Police report, or applicable Government substitute (Standard Form 91), shall be covered under contractor’s full coverage insurance to include full cost of vehicle replacement. Any repairs disputed by contractor’s insurance company shall be brought to the Contracting Officer’s attention.

2.13. Return Condition
