About this file

This document is an addendum to an Invitation for Bids (IFB) issued by the Virginia Community College System (VCCS) for the procurement of aircraft and aviation parts and equipment for Blue Ridge Community College (BRCC). The addendum provides clarification on the delivery terms, warranty coverage, and pricing structure of the contract. Specifically, it states that freight costs must be included in the item prices, with any additional shipping charges for rush, oversized, or special orders to be quoted and paid for separately by the college. The warranty period is a minimum of one year or the manufacturer's warranty, whichever is longer, and covers defects in materials and workmanship. The contract will be awarded as a blanket percent-off the manufacturer's most recent published price list, with the discount remaining constant throughout the contract term, including any renewals. The addendum also notes that cost-plus-percentage-of-cost pricing is prohibited under the Commonwealth of Virginia Procurement Manual.

The underlying contract opportunity is for the procurement of aircraft and aviation parts and equipment on an as-needed basis for BRCC, located in Weyers Cave, Virginia. The VCCS, acting as a shared services center, is soliciting bids from qualified vendors to establish one or more contracts for these products and services. The contract term and any renewal options are not specified in the provided information.

The VCCS Procurement Office is providing clarification of language within the IFB to potential offerors in reference to IFB # VCCS-BRCC-25-74261, Aircraft and Aviation Parts & Equipment for Blue Ridge Community College. Clarifications below are hereby incorporated into the IFB.

Clarifications:

1) Page 3, Section C

DELIVERY: FOB Destination (freight included in price). The prices for all items shall include all standard freight costs. Additional shipping charges for rush, over-size or special orders will be the responsibility of the college and shall be quoted to the college prior to shipment.

FOB Destination shipping charges must be provided at the time of the quote, either included within each line item or as a separate line item. No extra charges can be billed after shipment.

2) Page 3-4, Section D WARRANTY: The Contractor(s) is to guarantee its products to be free from defects in materials and workmanship, given normal use and care, over the period of the manufacturer warranty. The Contractor(s) agrees to warrant new products for a minimum of one (1) year from purchase date or the warranty period stated by the manufacturer, whichever is longer. The Contractor(s) is to agree to repair and/or immediately replace without charge (including freight both ways) to the Contract Users any product or part thereof which proves to be defective or fails within the warranty period as specified.

Products which are inoperative at installation shall either be replaced by the Contractor or repaired under warranty. The decision to replace such products, or accept warranty repair shall be at the sole discretion of the College, except in the event the College fails to provide timely notice of product failure to the Contractor. The contractor(s) shall provide a toll-free number for requests.

Remanufactured/rebuilt items shall be warranted for a period of 90 days from the purchase date or the warranty period stated by the manufacturer, whichever is longer. The Contractor(s) agrees to honor all manufacturers’ warranties and shall issue credit to the College for all warranty merchandise returned.

The Contractor(s) shall pursue any claim directly with the manufacturer without any expected obligation from the College. In the event that there is a catastrophic manufacturing defect problem, the Contractor(s) shall assist in contacting the appropriate vendor to file a claim for any labor charges incurred to replace the alleged defective product.

Warranty terms and conditions stand as is.

3) Page 4, Section F PRICING: The Contract shall constitute a blanket percent off the most recent manufacturer’s published price list. The discount shall include all other applicable charges. The percentage discount will remain the same throughout the term of the Contract, to include all renewals, and shall apply to any new similar products and/or accessories which may be introduced and added to the manufacturers’ product lines, and shall exclude only those items indicated by the Bidder on the Pricing Schedule. The Bidder shall furnish current catalogs and published price list upon request from the using agency. Delivery charges must show on the quotes, resulting purchase orders or punch out catalog order, if utilized. After the fact charges are not allowed.

If list price and discounted prices are the same, then vendor should enter the price in both columns on the pricing schedule.

Our Commonwealth of Virginia Procurement Manual, APSPM, prohibits awarding contracts on a cost plus a percentage for this contract.

APSPM 3.7 - Contract Pricing Arrangements. Contracts may be awarded on a fixed price or cost reimbursement basis or on any other basis that is not prohibited. For a discussion of contract types, see 4.3d. No public contract shall be awarded on the basis of cost plus a percentage of cost except: in the case of an emergency affecting the public health, safety or welfare; when a policy or contract for insurance or prepaid coverage has a premium computed on the basis of claims paid or incurred, plus the insurance carrier’s administrative costs and retention stated in whole or part as a percentage of such claims; or in other instances allowed by Code of Virginia, § 2.2-4331.
