Justification and Approval (J&A) For
Other Than Full and Open Competition Acquisition Plan Action ID: 36C263-26-AP-2986
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 23 (NCO23), 2501 W 22nd Street, Sioux Falls, SD 57105.
2. Nature and/or Description of the Action Being Approved: The VA Nebraska-Western Iowa Health Care System is requesting a procurement to clean and wax the floors for the Omaha Medical Center.
3. Description of Supplies/Services Required to Meet the Agency’s Needs The VA Nebraska- Western Iowa Health Care System is requesting a procurement to clean and wax the floors for the Omaha Medical Center. The total estimate for this procurement is $520,600.00.
Funding is available on 2237 number 636-26-3-5127-0057
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by RFO 6.103-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION)- up to $5,000,000. Check the specific VAAR clause used below:

or ( ) 819.7009 Sole source awards to a certified veteran-owned small business
5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The anticipated award is below the $5 Million threshold, the requirements will be synopsized at the time of award, Mark VII is a certified Service-Disable Veteran Owned Small Business as listed on the SBA Small Business Search, and the contract award will be found fair and reasonable making this eligible for a sole source award to a SDVOSB based on 38 U.S.C. 8127(c) and VAAR 819.7008.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by RFO
6.301 and, if not, which exemption under RFO 5.101(b)(1) applies: The contracting officer’s determination to make a sole source award is a business decision wholly within the discretion of the contracting officer. To ensure that opportunities are available to the broadest number of certified SDVOSBs, this authority is to be used judiciously and only when in the best interest of the Government.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The CO will compare the contract price to similar procurement listed in USASpending.gov.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
1) The following Market Research was conducted.
a) Search the US Small Business Administration Small Business Search for Certified SDVOSB and
VOSB Companies searching NAISC Code 561720 total of 3,688 Veteran Owned Small Business capable of performing this service.
i) 3,369 SDVOSB
ii) 3669 VOSB).

b) Janitorial services are on the AbilityOne Program Procurement List however the Rule of Two overrides this list since this is a follow on contract that was a SDVOSB Set Adie.
c) Janitorial services are available through the GSA’s eLibrary. A search of the available contact do not find any in the Omaha, NE area.
d) A search of the US Small Business Administration Small Business Search Database for small businesses using a search criterion of NAISC Code: 561720 for the State of Nebraska and Iowa found:
i) Two hundred thirty-one companies. Sixty-eight are in the Omaha, NE and Council Bluff, IA area.
ii) Fifteen are 8A small businesses.
iii) Four are HUBZone small businesses.
iv) Twelve are Women Owned small businesses.
v) Fifty-three are self-certified veteran owned small businesses.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

12.
