VHAPM Part 808.405-6 Limiting Sources Original Date: 08/30/2017
An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays.
This is a 5-Month bridge Task Order to allow additional time to procure and compete this requirement and award a long-term award. The current Task Order, VA260-16-A-0008 36C260190468, expires 4/30/2020. Access to reference lab testing services is a critical component of providing patient care at the Portland VAMC. Without access to laboratory test results healthcare providers will be limited in their ability to diagnose and treat which has a direct negative impact on patient care.
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
Reference lab testing service are currently provided by Labcorp, Inc. at the Portland VAMC.
Labcorp provides the testing services and provides test results via IT interface from their system to the VA VISTA system. This ensures test results are provided to VA healthcare providers in an accurate and timely manner. The process to develop the IT interface between a reference lab provider and the VA VISTA system requires 6 months to complete. This process includes loading the array of laboratory tests into the VISTA system and time to validate the results provided by the vendor. Furthermore, attempting to use a Lab contractor without the interface and validation completed would require each test to be manually entered into the vendors system, allowing for the potential for human error and resulting in an unacceptable level of risk to patient care. Therefore, the Portland VAMC PALM Department needs LabCorp to continue these services until a long-term procurement can be requested, awarded and the interface completed.
In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.
Items peculiar to one manufacturer:
is:
A patent, copyright or proprietary data limits competition. The proprietary data (If FAR 8.405-6(a)(2)iii before posting. Do not include specific proprietary data.
Only mention the type of equipment, procedure, etc. to show that proprietary supplies or services are being procured.)
These are “direct replacements” parts/components for existing equipment.
The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe the equipment/function
VHAPM Part 808.405-6 Limiting Sources Original Date: 08/30/2017 you have now and how the new item/service must coordinate, connect, or interface with the existing system.
5. DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH
FAR 8.404(d) TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE
DETERMINATION:
This bridge award will be a Task Order from the WSNC BPA VA260-16-A-0008. This BPA was competed among FSS contract holders and all per test pricing awarded on the BPA is offered at a discounted rate from the FSS contract. Per FAR part 8 pricing on FSS awards is determined to be fair and reasonable. In addition, Labcorp Inc. currently has a functioning IT Interface with the VA VISTA system and can provide accurate and timely reference lab test results. Therefore, considering price and ability to perform, this Task Order represents the best value to the Government.
6. DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE
RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT
CONDUCTED:
Market research was conducted to assess the availability of SDVOSB/VOSB’s and other Small Businesses to fulfill this requirement. The market research findings indicate this requirement can only be met by the incumbent provider Labcorp, Inc. due to the length of time it takes to transition to another vendor and develop the necessary IT Interface. Therefore, the recommendation of the market research is to award a Task Order from the existing WSNC BPA VA260-16-A-0008 to Labcorp, Inc.
7. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION: N/A
8. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE
ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE:
This is a 5-month bridge award to allow the time required to procure the reference lab services through competition. The Portland VAMC PALM will submit a complete procurement package to NCO 20 within this quarter to allow the needed time to ensure adequate competition is sought and the necessary time to develop the IT Interface and ensure a seamless transition to any potential change in awardee for these critical reference lab testing services.
9. REQUIREMENTS CERTIFICATION: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
