VHAPM Part 819.7007/7008 Page 1 of 3 Original Date: 08/30/2017
DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>$250K)
Acquisition Plan Action ID:___VA256-18-AP-7154___________________
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Agency 16, Alexandria Veterans Healthcare System, Pineville, LA. Purchase Request # 564-18-3-1101-0012.
2. Nature and/or Description of the Action Being Processed: Acquisition and installation of furniture and fixtures. The action will be awarded as a new firmed fixed price contract.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: Project consist primarily of delivery, assembling and installation of furniture and fixtures in the newly constructed Gene Taylor Community Based Outpatient Clinic (GTCBOC) Springfield, Missouri for the Veterans Health Care System of the Ozarks VA Medical Center located in Fayetteville, AR. The furniture products shall consist of office chairs, tables, workstations, systems furniture, cabinets, modular casework, etc. The total estimated value of the acquisition is $1,756,287.93. The estimated delivery date/period of performance is August 1, 2018.
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.
Code § 8127, as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below:
( X ) 819.7007 Sole source awards to a verified service-disabled veteran-owned small business;
or ( ) 819.7008 Sole source awards to a verified veteran-owned small business
5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Veterans Office Design, LLC is a “verified” Service Disabled Veteran Owned Small Business (SDVOSB) with NAICs Code 337214. They are an authorized reseller of furniture manufactured by the vendors identified in the technical specifications and statement of work. They have the necessary unique technical expertise required to provide the products and services which include shipping, delivery, installation, project management and design. Their satisfactory or better past performance rating on similar projects confirms their ability to meet the performance requirement. VOD estimates a lead time of 6-8 weeks for manufacture, assemble and installation of furniture as compared to the average lead time of 12 to 15 weeks and their quoted price is considered fair and reasonable when compared to other quotes for the same products. It is in the best interest of the Government to make this award sole source due to two primary factors: (a) The process to compete this procurement could delay the opening of the CBOC, which would delay patient care in the area and potentially harm patients by doing so and
(b) VOD's aggressive estimated lead time of 6-8 weeks ensures the activation date remains on schedule thus avoiding patient delays and rescheduling of appointments.

. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
A sources sought notice was issued on FedBizOpps on 5/17/2018 under RFI # 36C25618Q9421 seeking small business “manufacturer” of furniture under NAICS 337214. Eight (8) small businesses “resellers” responded and three (3) were SDVOSBs. However, no small manufacturers were capable of meeting the requirement of this procurement and thus an individual non-manufacturer waiver (NMR) was granted by the U.S. Small Business Administration. In addition, three informal competitive quotes were received from SDVOSBs as part of the customer/end-user market research.
Considering the fact, there is a known SDVOSB capable of meeting the procurement requirement, their price is considered reasonable based on comparison to other quotes and a delay in opening the CBOC will directly impact patient care, the non-competitive procurement is in the best interest of the Government.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The basis of fair and reasonable is based on comparison to other informal quotes received as a result of customer market research for the same items and comparison to the IGCE. three informal competitive quotes were received from SDVOSBs.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted in accordance with FAR Part 10 at least 2 or more verified SDVOSBs were identified on GSA under Schedule 71 1. Furthermore, historical data indicate that the same or similar requirements was awarded to “verified” SDVOSBs with GSA schedules. Also, a source sought notice using NAICS 337214 was issued on FedBizOpps (FBO) on 5/17/2018 and a least three “verified” SDVOSBs response was received. NOTE: An individual NMR waiver was granted by U.S. Small Business Administration.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: In accordance with VAAR 819.7007(b), "The contracting officer's determination to make a sole source award is a business decision wholly within the discretion of the contracting officer's authority.” For this procurement, this authority is being used judiciously because based on market research there is no clear evidence that competing this requirement will result in additional value in respect to timeliness, quality or price to the Government and the risk of not opening the clinic timely can have an adverse impact on Veteran patients. The Contracting Officer has determined this sole source requirement to be in the best interest of the Government. The suggested sole source vendor, Veteran Office Design LLC is a “verified” SDVOSB with the NAICS337214. They have necessary capability and technical expertise to meet the procurement requirements. The price quote is considered reasonable based on comparison to other informal quotes received through customer market research. Finally, the PPIRS report reflects 5 difference projects for similar CBOC activations that involves purchase and installation of furniture.
All projects performed by the vendor received satisfactory or exceptional ratings.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: The following is list of source that provided informal quotes:
- JPL & Associates LLC
- Aegis Business Solutions, LLC
- Veteran Office Design, LLC
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The customer/end-user will consider more advanced acquisition planning and notification to remove barriers to competition while also considering procurement as part of future CBOC activation planning. In addition, contingency planning to combat other unrelated media attention incidents will be considered as part of the activation plan.
