DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID:_VA249-17-AP-1633

1. Contracting Activity: Department of Veterans Affairs, VISN 09, Tennessee Valley Healthcare System

(TVHS), Network Contracting Office (NCO) 9. The purchase request number for this requirement is 626-19-1-4138-0003. This requirement is for an out of scope modification, modification P00005 of contract VA249-17-C-0058.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The base contract was competitively awarded to the successful awardee, Environmental Monitoring and Technologies, Inc. (EMT), to provide temperature monitoring services for one base year plus four option years on all faucets in patient care areas (approximately 800 each) at the TVHS, Alvin C. York VA Medical Center, 3400 Lebanon Pike, Murfreesboro Tennessee, 37129. EMT was to provide certified technicians, transportation, equipment, maintenance parts, materials, specialty tools and supervision to complete the quarterly temperature measuring and recording of all faucets in patient care areas at TVHS per specifications.

This modification is to increase the number of water tests performed at the Alvin C. York VA Medical Center, from quarterly to monthly. The intent of this modification, P00005, is to ensure temperature water testing occurs on a more frequent basis to prevent harm to Veterans. Temperature fluctuations can occur and lead to high temperature readings. By having these water temperature inspections occur more frequently, if the temperatures begin to increase, these inspections provide a proactive measure to ensure said temperature increases are drastically mitigated.

The period of performance for the work impacted by the modification is 7-1-2019 to 6-30-2020. Two inspections are added via contract line item number (CLIN) 2005 (option year two), and six inspections are added to CLIN 3005 (option year three).

The total price for this modification is $61,800.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This modification is being procured in accordance with Federal Acquisition Regulation (FAR) 6.302-5, Authorized or Required by Statute (See 38 U.S.C. 8127 (b)). EMT is verified in the Veterans Information Pages (VIP) as a Service Disabled Veteran Owned Small Business (See https://www.vip.vetbiz.va.gov/). But for making this a monthly water testing requirement for no more than twelve (12) months, Veterans could be harmed dangerously high temperatures that could lead to emotional and physical harm or even death. This sole source justification is being pursued to avoid said danger and to allow for a new procurement package to be provided that will lead to the establishment of a competed replacement contract https://www.acquisition.gov/?q=/browse/far/13 https://www.vip.vetbiz.va.gov/

4. Description of market research conducted and results or statement why it was not conducted:

Market research was not conducted because this modification is for extra work beyond the original scope of the contract, this out of scope work is approved by statute due to it being awarded to a Service Disabled Veteran Owned Small Business, and the current contractor can perform the work.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
