In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

Items peculiar to one manufacturer:

A patent, copyright or proprietary data limits competition. The proprietary data is: (If FAR 8.405-6(a)(2)iii before posting. Do not include specific proprietary data.

Only mention the type of equipment, procedure, etc. to show that proprietary supplies or services are being procured.)

These are “direct replacements” parts/components for existing equipment.

The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe the equipment/function you have now and how the new item/service must coordinate, connect, or interface with the existing system.

(5) DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH

FAR 8.404(d) TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION: The priced offer the only authorized SDVOSB, Federal Supply Schedule holder contains additional discounts, saving the Government $1,120.84. This price is less than the manufacture’s price.

(6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE

RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED:

Market research has revealed GE Healthcare (Large Business) as the sole proprietary manufacturer of the needed equipment. GE Healthcare has 4 authorized Small Business distributors/resellers of their equipment. (1-SDB, 1-SB, 1-VOSB, 1-SDVOSB).

Jaken Medical (DUNS: 068665699) is a licensed GE Healthcare Distributor and an SBA certified 8A SDB business which has their own VA FSS contract (V797P-4294B). Since Jaken primarily sells into the non-hospital market, they carry some but not all of the equipment necessary for a large hospital project.

However, they can provide the reminder of the items on an open market/mixed FSS basis.

DXE Medical (DUNS: 078760417) is a licensed GE Healthcare Distributor and an SBA certified small business which has their own VA FSS contract (V797P-4005B). Since DXE primarily sells into the non-hospital market, they carry some but not all of the equipment necessary for a large hospital project.

However, they can provide the reminder of the items on an open market/mixed FSS basis.

ALKO (181118738) is a licensed GE Healthcare Distributor and an SBA certified Veteran Owned Small Business (VOSB) which has their own VA FSS contract (V797P-2180D). They do not currently have anesthesia/monitoring items on their FSS. However, they can provide all items on an open market basis.

TrillaMed (828126321) is a licensed GE Healthcare distributor and a certified Service Disabled Veteran Owned Small Business (SDVOSB) and GEHC Outsource Manufacturer. TrillaMed has their own FSS contract (V797P-4269B) and is in the process of adding GE Healthcare items to it. Further, they are the only Authorized Distributor of GE FSS contracts V797P2227D and V797P2239D. Finally, TrillaMed was the sole source awardee of the previous contract (VA246-17-P-3574) awarded on behalf of the Asheville VAMC for a Carescape Upgrade.

1. (7) ANY OTHER FACTS SUPPORTING THE JUSTIFICATION:

41 USC §3304(a)(5), 38 U.S. Code § 8127, as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. 819.7007 permits sole source awards to a verified service-disabled veteran-owned small business.

(8) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR

OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY

SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE: n/a

(9) REQUIREMENTS CERTIFICATION: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
