FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays: This order is in response to the increase volume of patients as a result for the COVID-19 disease.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: Stryker Corporation is the only source for this type of stretcher. They can provide these items through their NAC FSS schedule. GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. In addition, pricing is the same as FPDS historical pricing:
Acq History: 36C25020F0779 – Awarded 03-07-2019 - $104,520.12. For the same items, at the same price, but for less quantities.
The NAC competed the overarching FSS contract, therefore competition and subsequent award presumes best value at a fair and reasonable cost. Lastly, IAW FAR 8.405-4 Price Reductions, additional discounts were sought, but none were provided. As a result of the information listed above, the Contracting Officer has determined that the anticipated cost will be fair and reasonable and represents the overall best value to the Government.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. Market research conducted only to verify vendor inventory quantities and delivery response time in response to this critical requirement. Stryker is the only source for this type of stretcher.
(7) Any Other Facts Supporting the Justification: No additional facts are needed to support this decision.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: Due to the increased volume of patients, as a result of the COVID- 19 pandemic, there was not enough time to properly submit Request for Quotes in search of other manufacturers or sources that would have allowed for increased competition.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
