2.a Nature and/or description of the action being approved: The purpose of this limited sources justification is to obtain approval to award a sole source Firm-Fixed price (FFP) task order to Technology Blue Inc., a small business GSA IT Schedule 70 contract holder, to provide continued services. The period of performance will be August 31, 2021 through August 30, 2022 with an optional six (6) month extension period.
2.b Name of the vendor: Technology Blue Inc.
2.c Requisition No.: 5000128194 2.d Bridge contract: Yes X No 2.e Brand name: Yes X No 3.a A description of the supplies or services required to meet the agency’s needs: The proposed acquisition is to procure contract support services for support, maintain, and enhance the data warehouse, Acquisition Workflow Approval Routing Efficiency tool (AWARE), OCPO dashboards, and OCPO document libraries, workflows, and knowledge repositories. The period performance consist of twelve (12) month base period of August 31, 2021 – August 30, 2022 and an optional six (6) month extension period.

4.a Identification of the authority being used (Check the appropriate box that applies).
X FAR 8.405-6(a)(1)(i)(A) – An urgent and compelling need exists and following the procedures would result in unacceptable delays.
FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
FAR 8.405-6(a)(1)(i)(C) – In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order or BPA provided that the original order or BPA was placed in accordance with FSS procedures in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
FAR 8.405-6(b) – Items peculiar to one manufacturer.
This acquisition is conducted under the authority of the Multiple Award Schedule Program (see FAR 8.401)
Treasury Standard Form – 1012 (Rev 5/18)
4.b Supporting Rationale: This is a sole source procurement that will support, maintain, and enhance the data warehouse, Acquisition Workflow Approval Routing Efficiency tool (AWARE), and OCPO document libraries, workflows, and knowledge repositories. The new work under this effort consists of OCPO digital transformation and maintenance. The Government intends to release a competitive solicitation for the recompete by November 1, 2021. The IRS has addressed all matters that prolonged the acquisition process. As a result, approval of this sole source provides reasonable time to meet both the Government’s urgent requirement and plan for the recompete action. It will provide the necessary time to complete the solicitation and evaluation process, make new award and continue the vital services required to address OCPO data warehouse, AWARE, and OCPO transformation to maintain operational success for all IRS procurement actions.
If these requirements were to transition during the re-compete it would represent a risk and unacceptable delays. A failure to obtain contract support will jeopardize the work effort to provide essential support to maintain and enhance data warehouse, workflows, dashboards, AWARE, and transition OCPO to O365, SharePoint Online, and migrate existing workflows to the cloud.
5. A determination by the ordering activity Contracting Officer that the order or BPA represents the best value consistent with FAR 8.404(d): The Contracting Officer will determine that the price will be fair and reasonable based upon the IGCE. The current task order has prices established under GSA. GSA has already determined prices under schedule contracts to be fair and reasonable for fixed-price services.
6. A description of the market research conducted among schedule holders and the results or a statement why market research was not conducted: A SF1010 market research summary report was completed stating that FAR part 8.405-6(a)(1)(A) will be utilized to issue a sole source acquisition to Technology Blue, a small business GSA schedule holder. There is an urgent & compelling need that exists and following the fair opportunity procedures at this time would result in unacceptable delays. There is an urgent need to continue service for the AWARE Dashboard and COVID monitoring. If the requirements in this task order were to lapse there would be significant impacts on tracking, monitoring, and maintenance. There is a current recompete going on for this effort that will not be awarding on time before this task orders expiration.
7.a Any other facts supporting this justification: Other supporting documentation for this requirement are: Requisition (SC), PWS, IGCE and Market Research Report.
7.b Attachments: Yes X No
8. A statement of the actions, if any, the Requiring Activity and Contracting Activity may take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for the supplies and services is made: The IRS, Office of Chief Procurement Officer (OCPO), Office of Business Solution Acquisition(OBSA) are currently in the pre-solicitation phase of the recompete for the AWARE Dashboard.
This recompete will be a competition set aside to small businesses utilizing mandatory resources.
