Notice of Intent to Sole Source
The Uniformed Services University of the Health Sciences (USU) intends to award a sole-source, firm-fixed-price contract to Nikon Instruments Inc. for an upgrade to a Nikon A1R confocal microscope system. The upgrade includes HD hardware, a high-end workstation, control cards, and software upgrades. The intended recipient is Nikon Instruments Inc., located at 1300 Walth Whitman Road, Melville, New York 11747.
USU justifies the sole-source procurement based on Nikon's proprietary integration through Nikon Instruments Software-Elements Software, an exclusive Nikon interface. Items integrated and supported by Nikon must be purchased directly from the company to ensure proper integration, safety standards, and compliance with Center for Devices and Radiological Health certification requirements. Purchasing components from outside sources would void the factory warranty and create compliance violations. The procurement will be conducted in accordance with FAR Part 13.106-1(b)(1)(i). In accordance with 5.207(c)(16)(i), all responsible sources may submit a bid, proposal, or quotation demonstrating clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and that the offeror can meet the stated government needs. Responses must be submitted via email to the listed contact by the notice's closing date. The Government will not be responsible for any costs incurred by responding to this notice.

Intent to Sole-Source:
USU intends to award a sole-source, firm-fixed-price contract to Nikon Instruments Inc. (Nikon) for an upgrade to a Nikon A1R confocal microscope system. This upgrade includes HD hardware, a high-end workstation, control cards, and software upgrades.
Sole Source Justification
Nikon Instruments Inc. integrates products as a proprietary integration via Nikon Instruments Software-Elements Software, an exclusive Nikon interface. Items to be integrated and supported by Nikon Instruments, Inc. must be purchased through Nikon to ensure proper integration, safety standards, and performance to factory specifications. Obtaining these products from an outside source with the intent to integrate with the Nikon system would result in a voided factory warranty and could be in violation of being non-compliant to Center for Devices and Radiological Health certification safety standards. This requirement will be procured in accordance with the procedures of FAR Part 13.106-1(b)(1)(i).
In accordance with 5.207(c)(16)(i), all responsible sources may submit a bid, proposal, or quotation which shall be considered by the agency. Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and that the interested potential Offeror can meet the needs of the Government as stated above. Information received will be considered for the purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice.
Responses must be received via email to the contact listed in the notice by the closing date of the notice.
