JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Puget Sound Naval Shipyard and Intermediate Maintenance Facility (PSNS & IMF), Contracts Division Code 423, Everett Detachment.

2. Description of the Action Being Approved

CASREP # 22082 surface combatant maintenance and repair to the seawater cooling piping for Main Engine Room number one (MER1) onboard the USS JOHN S. MCCAIN (DDG-56) with availability dates of

3. Description of Services or Supplies Required.

Provide all services required to urgently repair the ship’s seawater cooling piping for MER1, without the repair the ship is unable to meet operational commitments due to the starboard shaft being nonfunctional. Estimated schedule for repair is three weeks. The Independent Government Estimate (IGE) for work is .

000-00-001 Administrative Purpose; accomplish 251-11-001 Seawater Cooling Piping Replacement; accomplish 992-10-001 Wharf and Pier Laydown Area; utilize and manage 992-11-001 Temporary Service; provide 998-31-001 Environmental Protection and Hazardous Waste Program;

4. Statutory Authority Permitting Exception to Fair Opportunity

FAR 6.302-2 Unusual and compelling urgency;

The supplies or services are of such unusual and compelling urgency that the government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals and waive the solicitation period. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the government.

5. Rationale for Selecting Contractor

USS JOHN S MCCAIN A2EM EXCEPTION TO FAIR OPPORTUNITY

On , the government contacted the Lot 2 NWRMC MACMO holders to request their ability to support this requirement. Two of the three Lot 2 NWRMC MACMO indicated they were interested and capable, while a the third indicated that due to current workload they could not support this requirement. As a result, an RFP was issued to the two Lot 2 NWRMC MACMO holders that had indicated they were interested and capable. The RFP was issued on with a response date of . No viable proposal was submitted to the government in response to the RFP that was issued. Based on this the government engaged NASSCO who stated they could support the requirements. On the government submitted an RFP to NASSCO who in turn provided a proposal on .

6. Efforts to Promote Competition

In order to gage the industrial capacity to complete the USS JOHN S.

MCCAIN urgent requirement, the government contacted NWRMC MACMO holders to see if they have capacity support this effort. The government reviewed the option to move requirements to a future CMAV but no workable alternatives could be identified.

7. Fair and Reasonable costs

Contracting Officer anticipates the costs to be fair and reasonable and will request and review a technical advisory report to assess the technical acceptability of the proposed amounts. Contracting Officer will determine fair and reasonableness in accordance with FAR 15.

8. Market research Performed.

On , the government contacted the three Lot 2 NWRMC MACMO holders to request their ability to support this requirement.

Two of the three Lot 2 NWRMC MACMO indicated they were interested and capable, while the third indicated that due to current workload they could not support this requirement. As a result, an RFP was issued to the two Lot 2 NWRMC MACMO holders that had indicated they were interested and capable. The RFP was issued on with a response date of . No viable proposal was submitted to the government in response to the RFP that was issued. Based on this the government engaged NASSCO who stated they could support the requirements.

9. Factors Supporting Other than Full and Open Competition.

Rationale as to the extent & nature of the harm to the government The USS JOHN S. MCCAIN (DDG-56) has suffered a Category III CASREP to MER1 seawater cooling piping (leaks), which without repair restricts the ships ability to meet all operational requirements. The ship’s schedule will require that the ship get underway as early as

USS JOHN S. MCCAIN (DDG-56) has already postponed TYCOM sea trials originally scheduled for . The casualty prevents the ship from operating the number one shaft which is needed for the full power run during TYCOM sea trials, and other Basic Phase

commitments. Estimated schedule for repairs is three weeks, any delay to the repair schedule or in awarding this repair contract will cause serious undue injury to the government. Ship cannot meet operational commitments until this repair is made.

11. Actions Taken to Overcome Barriers

The requirement was first identified on . Due to urgency and the period of performance required for repair the team was not afforded the opportunity to remove barriers to competition.

On , Code 423 contacted the Lot 2 MACMO holders to seek a form of competition with the period allowing. Lot 2 MACMO holders had expressed interest and the ability to support the project;

however, no viable proposal was submitted in response to the RFP that was issued. This resulted in Code 423 contacting Lot 1 MACMO holder, NASSCO. NASSCO indicated they were interested and capable of completing the work in the required period.
