About this file
This is a Justification and Approval (J&A) document for use of other than full and open competition issued by the Department of the Navy, Military Sealift Command (MSC) Norfolk under document number N10426Q7248. MSC Norfolk is procuring Controllable Pitch Propeller (CPP) blade bolts as Original Equipment Manufacturer (OEM) material from BIRD JOHNSON PROPELLER on a firm-fixed price, brand name, limited source basis. These components are required for work item 0916 during the USNS SOJOURNER TRUTH (T-AO 210) FY2027 Post Shakedown Availability (PSA), scheduled to begin on 16 July 2027. The supplies are direct replacement parts for existing equipment currently installed on the vessel.
The procurement is justified under 10 U.S.C. 3204(a)(1) citing only one responsible source, as BIRD JOHNSON PROPELLER is the sole manufacturer of the CPP blade bolts and holds proprietary rights, patent rights, and secret processes that make the item available from no other source. The requirement is further justified on standardization grounds per COMSCINST 4790.3 to maintain fleet configuration baseline for the entire T-AO 205 Class. The procurement will be funded using FY26 Operation and Maintenance, Navy (O&M,N) funds because these are long lead time materials requiring immediate ordering to ensure delivery prior to the availability start date. The Contracting Officer has determined the anticipated cost to be fair and reasonable in accordance with FAR 15.404-1(b)(2). A Procurement Planning Agreement and Commercial Item Determination are pending or attached as required documentation. Market research confirmed BIRD JOHNSON PROPELLER is the only capable source, and no synopsis was published in accordance with FAR 5.202(a)(2).

JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION (ANNEX 1)
1. Contracting Activity:
Department of the Navy, Military Sealift Command (MSC) Norfolk
2. Description of the Action Being Approved:
Award a firm-fixed price contract on a Brand Name, limited source basis to procure Original Equipment Manufacturer (OEM) material from BIRD JOHNSON PROPELLER in support of the USNS SOJOURNER TRUTH (T-AO 2 1 0 ) to install approved Controllable Pitch Propeller (CPP) blade bolts during the ships' FY27 Post Shakedown Availability (RSA).
3. Description of Supplies/Services:
This requirement is for the purchase of Controllable Pitch Propeller (CPP) blade bolts as GFM for work item 0916 in the USNS SOJOURNER TRUTH FY2027 PSA. These are a direct replacement of parts currently installed on the vessel.
Funding: This procurement will be funded using FY26 Operation and Maintenance, Navy (O&M,N) funds.
Justification for FY26 Funding: Although these components are required for a FY27 Availability (PSA), FY26 funds must be utilized now because these are Long Lead Time Materials (LLTM). The production and delivery lead time dictates that orders must be placed immediately to ensure the components are manufactured and delivered prior to the start of the ship availabilities. The SJT FY2027 PSA starts on 16July2027.
4. Statutory Authority Permitting Other Than Full and Open Competition:
10 U.S.C. 3204(a)(1) - Only one responsible source and no other supplies or services will satisfy agency requirements. (FAR 6.302-1).
5. Rationale Justifying Use of Cited Statutory Authority:
The subject requirement is restricted to BIRD JOHNSON PROPELLER. BIRD JOHNSON PROPELLER is the manufacturer of the CPP blade bolts, and is the ONLY SOURCE of these parts. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the product. These restrictive rights make the required item available from only one source, and another company could not satisfy the Government's need. Furthermore, for STANDARDIZATION: Per COMSCINST 4790.3, to maintain fleet configuration baseline, only the specified make/model of the equipment/parts will satisfy the Government’s needs for the TOTAL FLEET OF T-AO 205 CLASS. The product is a direct replacement part for existing equipment and must be compatible.
