| Question and Response Form | ||||||||||
| Date of | ||||||||||
| Request | Offeror | Question Number | ||||||||
| Topic | Subject (title) | Question/Comment | Answer | Question Reference (Draft SOW, Industry Day Presentation, Page #s, etc.) | Proprietary (Yes or No) | Time | ||||
| Quantum3D | 0001 | Mobilization | Are we required to open an office in Saudi or we can work with a local company? | The USG IPT is not an expert in foreign companies doing business in KSA, so we cannot confirm is a physical office in the country is required. The offeror is responsible for complying with Saudi Arabia's Vision 2030. | Presentation Slide 9 | No | 8:47am | |||
| Advise Right LLC | 0002 | OW Para 6.1 Contractor requirements: There is no FTE or any way to determine how many people are needed for each task? Please advise. | The Government understands there are unknowns with respect to the number of employees required to perform CLS & CIS. The Government intends to provide a table within the SOW that will dictate the number of FTEs the contractor is required to provide. | No | 8:50am | |||||
| Serco | 0003 | Will CLINs 1000/1001... include labor only, or material as well? | CLINS 1000/1001 is for the CLS&CIS labor only. | |||||||
| The OAWR CLIN will support other requirements (i.e. materials, spares, technical data revision, ODC, etc.). | Presentation Slide 13 &14 | No | 8:53am | |||||||
| Quantum3D | 0004 | Past Performance | Past performance - Does it have to be Saudi NAVY past performance or RSAF programs are considered? | The USG IPT is working on the L&M for past performance. Interested offerors can expect the relevancy criteria to require that for a record to be considered relevant (any category) that it must have overseas or OCONUS performance. The Government is still drafting the remainder of the scope, complexity and magnitude criteria. No decision has been made to specify Navy/Air Force performance. | Presentation Slide 16&17 | No | 9:02am | |||
| GovCIO | 0005 | Are there any companies prohibited from priming this opportunity due to OCI issues? | The USG is not aware of any OCI issues with any of the known interested Offerors that would prohibit a teaming arrangement or proposing. | Industry Day | No | 9:12am | ||||
| Engenium | 0006 | We have OCONUS PP on US Navy Ship handling Trainers. Would you view that is highly relevant? | The USG IPT is working on the L&M for past performance. We are looking at having all overseas performance. No decision has been made to specify Navy/Air Force performance. |
| The Government will not comment on if a specific record is potentially "highly relevant." It is up to the offeror to submit records that meet the criteria to be set forth in the solicitation. | Presentation Slide 16&17 | No | 9:12am | ||||||
| Serco | 0007 | Who is the current service provider? | Technically there is no current service provider due to lapse in service. The incumbent from 2016 - 2020 was Kratos and the period of performance concluded as the global COVID pandemic began. | Industry Day | No | 9:21am | |||
| Pinnacle Solutions | 0008 | Navy gone in agreement with Kratos. Will Kratos support pricing for licensing? | The Navy does not have an agreement or contract with Kratos. It is incumbent for each offeror to reach out to Kratos. | ||||||
| At this time it is the Government's understanding that Kratos's does not intend to support licensing pricing or subcontracting. The Government understands this presents challenges to interested offerors. It is noted that the Government cannot force a contractor to sell their product to other contractors. | Presentation Slide 9 | Yes | |||||||
| Serco | 0009 | What is anticipated availability timeline for Appendices - A and B? | The USG IPT is currently working on the requirements. | ||||||
| The goal is to post the draft RFP 30 days prior to final RFP release. | Industry Day | Yes | |||||||
| LSI | 0010 | Unknowns with the CDRLs | The draft RFP will include the Exhibits. The OAWR CDRLs are meant to be scalable to support the requirements. For example, an OAWR effort may require the various development, design and testing CDRLs for a large upgrade or simply a technical report for a minor repair. | ||||||
| The CLS & ICS CLINs will contain the standard monthly report and programmatic CDRLs. | Presentation Slide19 | No | |||||||
| AITC | 0011 | Software license/sub-contracting agreement with Kratos. What is to prevent Kratos offer to deny everyone else. | Please see answer to question number 19. | Industry Day | Yes | ||||
| LSI | 0012 | a. Would the government provide further clarification on the specific of the residuals and locations of the tentative KSA facilities where the work will be performed. | |||||||
| The detailed site information will be provided in Appendix A with the Draft RFP. | Industry Day | Yes | |||||||
| LSI | 0013 | b. Since the OEM owns a proprietary software solution, how government perceives the contractor to do design/upgrades/technical refresh on these trainers. | The customer and FMS case requires the utilization of the OEM software. The contract will also contain this requirement. It will be incumbent upon the offeror to meet the contract requirements. | Industry Day | Yes | ||||
| LSI | 0014 | c. Is the government providing the LCATs/pool and projected hours to support the level of effort. e.g. pricing matrix? | The USG will provide a draft RFP package which will include Appendix A and B to the SOW 30 days prior to RFP. | Industry Day | Yes | ||||
| LSI | 0015 | d. Would you provide a ROM of how many trainers the scope of work shall include for this requirement. | Please refer to Industry day presentation day slide 21 and 22. | Industry Day | No | ||||
| LSI | 0016 | e. Is the spare parts provisioning per the scope of work (section 6) includes for the contractor to own inventory (assumption) in country. Is this inventory in multiple sites? Locations? Any historical data info. …rate of consumables, etc.? | Please refer to the Draft SOW. |
Please see Industry Day Presentation Slides 22 for the site locations.
| The USG will release available historical performance report data with the RFP. | Industry Day | No | ||||||
| LSI | 0017 | f. We understand no site visit to KSA, would the government reconsider a tentative site visit. | No, the RSNF has declined the request for a site visit for this effort and will not reconsider a site visit. | Industry Day | No | |||
| LSI | 0018 | g. Would the government provide the POC at Kratos defense for industry to assess the limitations and any opportunity assessment for this requirement. | The Kratos POC is Mike Bennett, VP, Business Development, 1-757-630-2014. | Industry Day | Yes | |||
| AITC | 0019 | When looking at the requirements, it appears that you have set this up as a sole source to KRATOS. By requiring each offeror to have a license/TA/Sub K with Kratos as a BASE requirement to bid, AND allowing KRATOS also to bid, you have made KRATOS the only company capable of meeting the requirements. KRATOS will NOT share their software with ANY other vendor as they too are aware of this. This effectively eliminates all competition and makes this a sole source award. No other company can offer a proposal if this remains a base requirement to bid. Here are possible remedies to the situation: |
1. Remove the requirement for the OEM Software License and add a T&M CLIN to cover software expense. This would force KRATOS to a level playing field and allow other competitors to bid. They would then add KRATOS to their team or purchase the license from them as a vendor after award.
2. Break the opportunity into two portions, one for the KRATOS Software portion, and the other for the remaining work. This increases competition and would give the USG the best possible price.
As it stands right now, no other companies will be able to bid on this based upon the software requirement and using KRATOS Proprietary software. AITC is well positioned with past performance, KSA Business License and presence in country to bid, however as it currently stands, we will no bid as we cannot meet the requirement to have access to KRATOS Software. Unfortunately, that will leave the Government with only one vendor and the lack of competition to drive down price. I hope you will consider my recommendations , as that will increase competition, drive down costs and provide the customer with the best overall value, as well as leveling the playing field for all potential offerors.
| The Government is aware of the challenges with this effort and that there are potential barriers to competition. Specifically that Kratos does not intend to license the NTTT software or subcontract to other offerors. The Government has engaged with Kratos on this subject, but cannot force a contractor to sell their software (i.e. a NDI software) to other companies. The Government has already considered some of the presented COAs internally and they either: (1) do not make sense from an acquisition perspective (e.g. pursing multiple contracts creates cost increases or resourcing challenges for the customer and Government); (2) they are not allowed per the FMS case (e.g. the FMS case prohibits contract types other than FFP); or (3) conflict with the FMS customer's needs (e.g. provision of a single contract). Many of the requirements for this effort are specific to the FMS case requirements. | Industry Day | |
