Dear Mr. Hinch:

This is in response to your request, received March 4, 2020, to modify Department of the Army Permit Number LRE-2007-00550-38-L18. We have modified the Department of the Army Permit to include the following revision (as shown on the enclosed plans):

Annually dredge, by mechanical means, a maximum total of 1000 cubic yards annually from the Powell Point and Williams Ferry Landings, to a depth of 5.1’ below the Low Water Datum elevation of 601.1’, IGLD 1985. Dredging is authorized through December 31, 2025.

This authorization is contingent upon compliance with the following terms and conditions:

1. All dredged and/or excavated materials will be disposed of in upland location(s) landward of the Ordinary High Water Mark with no placement in, or return to, any waterway or wetland.

2. Prior to beginning any dredging, the permittee shall install commercial-grade silt curtains that extend from a floating boom on the lake surface down to the bed of the waterway. The silt curtain shall continuously and completely enclose the dredge area. The silt curtain shall be properly anchored onshore, and anchored offshore at 25-foot intervals to provide a stable and functional barrier. The silt curtain shall be maintained in effective working condition until all dredging is completed and turbidity has returned to background levels. In the event that the silt curtain remains in place overnight, the applicant will coordinate proper marking of the silt curtain with the USCG and their requirements (e.g. lighting, reflective paints, etc.) will become special conditions under this permit.

3. Dredge spoils must be adequately contained during dewatering so that return water is below background turbidity levels, or runoff is contained by the sediment curtain in the project area.

You must attach a copy of this letter, authorizing this permit modification, to your copy of the original permit. Keep it at the work site during project construction so that it will be available for inspection by Corps representatives, if requested.

We remind you that all other original conditions of Department of the Army Permit Numbers LRE-2007-00550-38-L18 and LRE-2007-00550-38-L13 remain in full force and effect. Also, we advise you that this authorization does not excuse you from the obligation to secure any other necessary State and/or local approvals.
