About this file
This document is a Justification and Approval for Other Than Full and Open Competition under FAR Part 6. It describes a sole source contract award to Bowen Collins & Associates LLC for a design update to repair base parking lots at a military installation.
The original design was completed in 2018-2020, but significant layout changes from other construction projects and deterioration of the parking lots require an update to the design before construction can proceed. The contracting authority determined that the original A-E firm, Bowen Collins & Associates, is the only responsible source that can efficiently and effectively update the design, as engaging a new firm would create significant liability and schedule risks. The anticipated contract value is unknown, but an Independent Government Estimate was used to determine the cost is fair and reasonable. The contract is planned to be awarded in fiscal year 2024 using SRM funds.

Justification and Approval for Other than Full and Open Competition – FAR Part 6
Contracting Activity: 151 MSG/MSC
Description of Action: The 151 CES requests a contract with Bowen, Collins & Associates, INC. The Government projects award for 2024 and fiscal year 2024, SRM funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
Description of Supplies/Services:
and completed from 2018 to 2020, with an anticipated construction start year of 2020.
The construction effort associated with the completed design is now anticipated to begin in fiscal year 2025. However, significant physical layout changes due to other construction projects necessitate an update to the design before construction can proceed. Additionally, the condition of the parking lots has likely deteriorated since the design's completion, requiring an evaluation and incorporation of the pavement condition into the updated design. Finally, due to the time elapsed since the original design, a code and criteria review will be necessary to ensure compliance with current codes and standards.
Authority Cited: 10 United States Code 3204(c)(1) as implemented in Federal Acquisition Regulation 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
Reason for Authority Cited:
The original A-E firm that completed the initial design in 2020 is uniquely qualified to perform the required design updates. The updates required are minimal compared to the drafting of the original design, involving primarily the incorporation of changes due to degradation of parking lots and modifications from a subsequent project affecting the layout of the building 210 parking lot. Engaging a different A-E firm would be extremely difficult and inefficient, as a new firm would need to invest significant time and resources to understand the original design, existing conditions, and changes made since the initial design. This would lead to significant liability and schedule risks, compromising the project's timeline and budget. The original A-E firm is already responsible for correcting any errors or deficiencies under the initial design contract. Introducing another A-E firm would create an additional party for the government to manage, leading to potential delays and complications, especially if there were disagreements between the firms.
The original A-E firm's familiarity with the project's specific requirements and background ensures a seamless and efficient update process. Having two firms involved in a single design would complicate project management and extend the timeline, jeopardizing the project’s success. Because of these factors, full and open competition would not be in the best interest of the government.

6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered.
a. Effective competition. Because this is a sole source action, effective competition is not applicable.
b. Subcontracting competition Due to the nature of the contract services, no subcontracts are expected to be awarded by the A-E for this effort.
7. Actions to Increase Competition: At this time there are no efforts to increase competition as this is a one-time requirement that is related to the construction phase requirement.
8. Market Research: No market research was conducted for this acquisition. A lack of other qualified sources was not the reason for the sole source selection.
9. Interested Sources: To date, no other sources have written to express interest in the acquisition.
10. Other Facts:
a. Procurement history:
(1) Task Order W011YP-13-D-2211 was a single award IDIQ to Bowen, Collins & Associates LLC. Bowen, Collins & Associates was competitively selected through the A-E selection process.

13. Fair and Reasonable Cost Determination:
I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.
The anticipated cost determination was made using an IGE. The IGE costs were developed utilizing Local AE IDIQ hourly rates adjusted for inflation. Hours were determined by comparing project scope to previously performed design projects. As part of this basis, certified cost or pricing data will not be required as the estimated cost of the contract action is less than the threshold for certified cost or pricing data.
