C Statement of Work
C.1 Background
C.1.1 The United States Department of Agriculture (USDA), Natural Resources Conservation Service
(NRCS) is committed to “helping people help the land”. Their mission is to deliver conservation solutions, so agricultural producers can protect natural resources and feed a growing world. For more information regarding the agency and its programs visit http://www.nrcs.usda.gov/.
C.2 Scope of Work
C.2.1 Through the Agricultural Conservation Easement Program, the USDA Natural Resource
Conservation Service works with landowners to restore wildlife habitat on farmland. NRCS owns more than 600 of these easements in Wisconsin. The terms of the easement give NRCS control over the vegetation management while the fee landowner retains the right to control access to the property.
C.2.2 Wisconsin NRCS started treating Phragmites patches on one site in fall 2020. USDA NRCS has a need to develop contracts to spray the sites and patches. In order to develop these contracts, NRCS is in need of accurate maps of the current distribution of Phragmites.
C.2.2.1 After each fall treatment, maps are needed of the Phragmites that survives treatment the following summer.
C.2.2.2 Although people can easily visit some of the patches on foot, other patches are surrounded by soggy ground, streams and/or dense vegetation that blocks easy access on the ground during the growing season. NRCS allows vendors to collect their own imagery by unmanned aircraft system or to utilize existing private or published imagery.
C.2.3 The vendor will provide shapefiles showing the extent of Phragmites populations during the summer, fall or winter of 2020 and June 2021, June 2022, and June 2023. The deadlines are as follows:
C.2.3.1 Summer- Imagery – June 1, 2021
C.2.3.2 June 2021 Imagery – July 12, 2021
C.2.3.3 June 2022 Imagery – July 11, 2022
C.2.3.4 June 2023 Imagery – July 10, 2023
C.2.4 NRCS prefers proven methods over untested methods. To aid in the selection of a vendor, NRCS requires documentation showing expert determination that the vendor’s chosen method is effective and reliable for delineating one-square-meter patches of Phragmites or similar species.
The method includes the season of imagery, the type of imagery, and the type of analysis. The selection team prefers peer-reviewed articles for this determination but will consider other types of documentation.
C.3 Deliverables:
C.3.1 The following items are required to be delivered via email to Wisconsin NRCS point of contact who will be provided upon award:
C.3.1.1 Point shapefile
C.3.1.2 Polygon shapefile
C.3.1.3 Wisconsin Transverse Mercator of 1983
C.3.1.4 Report on data sources and analysis methods
C.3.2 If vendors choose to visit the sites on the ground, the vendors will contact landowners by phone, email or letter before the visit. These vendors will provide notes on field observations to include the following with the above deliverables. Landowner information will be provided as needed.
C.3.2.1 Difficulty of ground access to the Phragmites patch from the NRCS legal access (is it passable by truck, ATV, Argo, or boat);
C.3.2.2 Water depth under Phragmites;
C.3.2.3 Dominant vegetation surrounding Phragmites;
C.3.2.4 Map of tree canopy within 20’ of Phragmites.

(u) Unauthorized Obligations.
(1) Except as stated in paragraph (u)(2) of this clause, when any supply or service acquired under this contract is subject to any End User License Agreement (EULA), Terms of Service (TOS), or similar legal instrument or agreement, that includes any clause requiring the Government to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti-Deficiency Act violation (31 U.S.C. 1341), the following shall govern:
(i) Any such clause is unenforceable against the Government.
(ii) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an “I agree” click box or other comparable mechanism (e.g., “click-wrap” or “browse-wrap” agreements), execution does not bind the
Government or any Government authorized end user to such clause.
(iii) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.
(2) Paragraph (u)(1) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures.
(v) Incorporation by reference. The Contractor’s representations and certifications, including those completed electronically via the System for Award Management (SAM), are incorporated by reference into the contract.
