Justification– USBF Electronics Subsystem
General Services Administration Federal Acquisition Service (FAS), Southwest Supply Operations Center (SSOC)
Acquisition Division
JUSTIFICATION AND APPROVAL FOR
OTHER THAN FULL AND OPEN COMPETITION
Requisition WX3WVD10909001
IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY
The requiring agency is the 25th Combat Aviation Brigade, located at Wheeler Army Airfield, Hawaii. The contracting activity is the General Services Administration, Global Supply, Southwest Supply Operations Center, 819 Taylor St., Fort Worth, TX 76102.
DESCRIPTION OF THE ACTION BEING APPROVED
The 25th Combat Aviation Brigade, contracting through the FAS Southwest Supply Operations Center, has a requirement for one USBF Electronics Subsystem.
This Justification for Other than Full and Open Competition (JOTFOC) serves to support the brand name procurement of one USBF Electronics Subsystem manufactured by Avion Manufacturing. This equipment will be delivered to Tracy, CA and then forwarded to the customer’s location in Hawaii.
This acquisition will be sourced through a RFQ on BetaSAM. The result will be a purchase order for one USBF Electronics Subsystem.
DESCRIPTION OF SUPPLIES REQUIRED TO MEET THE AGENCY’S NEEDS
USBF Electronics Subsystem, Avion Manufacturing P/N AV-500-001-6 with the following description:
Replace existing electronics subsystem with a new USBF electronics subsystem driven by Avion System 2016 with Avion
2.0 software and operating with a Windows 10 platform. It is comprised of a computer with thermal printer, touch screen monitor with speakers and calibrated load cells. Military grade reusable container for shipping and storage of the USBF or VMB Electronics Subsystem. It stores the computer, monitor, sensor bars with load cells and position sensors. A new heavy duty vinyl tarp for storage and protection, and a new load cell slide bar assembly. This feature removes the load bar from the load cells while completing calibration checks or during periods of non-use to help eliminate the possibility of damaging the load cells.
The estimated cost of this procurement is: $37,000.00.
IDENTIFICATION OF STATUTORY AUTHORITY
This acquisition is conducted under the authority of Section 201 of the Federal Property and Administration Act of 1949 (40 U.S.C. 501). The circumstances and rationale for restricting consideration of contractors is FAR 6.302-1, “only one responsible source and no other supplies or services will satisfy agency requirements.”
DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR
THE NATURE OF THE ACQUISITION REQUIRE THE USE OF THE AUTHORITY CITED
FAR 6.302-1 allows restricting consideration of contractors whenever the supplies or services required by the agency are available from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements.
In an email dated May 3, 2021, the customer stated the following:
“The equipment that we have is manufactured by Avion Manufacturing. The issue that we currently find ourselves with is the software for the equipment is proprietary to Avion. We have multiple quantities of this equipment and they are rather expensive. To replace this equipment with another manufacturers model (if that even exists) would be overly expensive and extremely hard to justify.
This equipment is vital to the readiness of the 25th Combat Aviation Brigades ability to maintain serviceable helicopter blades. This equipment provides capabilities to repair millions of dollars of blades a year. Without it we would spend an exorbitant amount of money on new blades and be subject to the availability/logistical burdens of constantly procuring new blades.”
DETERMINATION BY THE CO THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL
BE FAIR AND REASONABLE.
As was previously stated, in accordance with FAR 6.302-1, competition will be limited to USBF Electronics Subsystem, Avion Manufacturing P/N AV-500-001-6. However, among vendors carrying these items, competition will be promoted to ensure fair and reasonable pricing.
The Contract Specialist will conduct price analysis techniques in order to substantiate the price reasonableness of the items requested in the award decision document. This includes comparing the proposed award price with pricing received from other vendors in response to the RFQ, as well as making direct and indirect price comparisons to the same and similar commercial items.
IAW FAR 5.2, the Contracting Officer will synopsize and post the solicitation and Justification for Other Than Full and Open Competition to BetaSAM.
DESCRIPTION OF THE MARKET RESEARCH CONDUCTED
The Contract Specialist conducted a search of GSA Advantage and this item was not listed. Further, the manufacturer of the item confirmed that they do not have this item on their GSA Schedule contract. Therefore, the Contract Specialist determined that an Open Market procurement would be the best course of action.
DESCRIPTION OF ANY OTHER FACTS SUPPORTING THE JUSTIFICATION
Please see DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED for details.
STATEMENTS OF ACTION TO OVERCOME BARRIERS TO COMPETITION BEFORE ANY
SUBSEQUENT ACQUISITION
See DESCRIPTION OF THE MARKET RESEARCH CONDUCTED for details.
CONTRACTING OFFICER CERTIFICATION
The contracting officer has determined that the actions taken under this acquisition meet the conditions described in FAR 6.302-1. Based on the circumstances described in this document, it is in the best interest of the Government to solicit quotes only from vendors carrying USBF Electronics Subsystem, Avion Manufacturing P/N AV-500-001-6.
The information contained in this Justification for Other than Full and Open Competition for this acquisition is accurate and complete to the best of the Contracting Officer’s knowledge.
